SUMMARY:Webinar: Evaluating and Preparing Successful Qui Tam Actions from Intake to Filing
DESCRIPTION:This webinar will provide a comprehensive overview from evaluating potential qui tam actions at intake to the steps necessary to prepare a case for filing. Initially\, we will examine the legal\, evidentiary\, and practical issues and factors the relator’s counsel should consider before filing a case. Then\, upon determining to file\, we will discuss how relator’s counsel can put together an effective Disclosure Statement and complaint; one that will not only get the government’s attention but dramatically increase the likelihood of intervention. Historically\, the government intervenes in only ~20% of all filed cases. Further\, and most importantly\, when the government decides to intervene\, the likelihood of successfully resolving the case is ~90%. Thus\, an experienced and successful relator’s counsel evaluates and assesses cases based on multiple factors\, many of which are the same as what the government uses when making intervention decisions. Also\, when deciding to file\, the experienced and successful relator’s counsel prepares the way forward by making informed strategic decisions and following through on the corresponding steps that can\, and will\, have a critical impact on the success or failure of the case. This webinar will take a deep dive into these issues\, and attendees will leave with a better understanding of how to properly assess a case\, determine when to move forward\, and what they need to be successful in securing government intervention. \nPresented by sponsor Morgan & Morgan \n\nAbout the Presenters\n\n\n\n\nClark Bolton\, Attorney\, Morgan & Morgan\nClark Bolton brings unique insight and skills to his law practice. As a former whistle-blower himself\, he has walked the walk. His experience as a whistle-blower\, investigator\, certified fraud examiner\, and now an attorney\, combine to provide a tremendous advantage for Morgan & Morgan clients. Before joining Morgan & Morgan\, Clark practiced whistle-blower law with James\, Hoyer\, Newcomer & Smiljanich\, P.A.\, one of the most successful whistle-blower firms in the nation. After leaving James Hoyer\, and before joining Morgan & Morgan\, he had his own practice\, Bolton Law\, PLLC\, where he effectively represented whistle-blowers. \n\nRegistration\nRegistration for this webinar closed on Tuesday\, March 28 at 2:00 pm ET. \nAttendees will receive the zoom streaming link in their confirmation email. SUMMARY:Webinar: Confidentiality in Mediating Federal Administrative Law Cases
DESCRIPTION:Alternative dispute resolution (ADR) reference materials often cite “confidentiality” as a critical feature of ADR processes.  Confidentiality encourages candid discussions that open the door to negotiated resolutions-  but when ADR programs and neutrals promise confidentiality\, they must know the bounds of their promise under the law and applicable ADR agreements.  This presentation will review statutes\, caselaw\, and ADR agreements so mediators don’t promise more confidentiality than they can deliver.  The program will focus on federal administrative cases with an emphasis on FAA issues\, but will be useful to practitioners in all fields. \n  \nPresented by the Alternative Dispute Resolution Section & Transportation & Transportaion Law Section \n  \nRegistration is Closed \n\nPresenters\nIntroduction & Q&A – James Downey\, Chair\, ADR Section\n \nJames Downey is an Attorney/Advisor for the Department of the Army. He is a Lieutenant Colonel in the Judge Advocate General’s Corps in the Massachusetts Army National Guard and serves on the panel of neutrals for: the Better Business Bureau; FINRA; the Department of Defense; and MWI Inc. He is a graduate of the University of Rhode Island and Suffolk University Law School. He has completed various ADR certificate trainings at among other places: Harvard Law School and the Defense Equal Opportunity Management Institute. He is an instructor in mediation with Quabbin Mediation in Orange\, MA and a member of the Massachusetts Bar. He is a member of the Town of Braintree’s Planning Board and the American Legion Post 86. \nJudge John A. Dietrich\, Director and Chief Administrative Judge\, Office of Adjudication/Office of Dispute Resolution for Acquisition & Federal Aviation Administration (FAA)\n \nJohn Dietrich is an attorney and mediator with a wide range of experience in federal acquisition\, workplace disputes\, aviation enforcement\, and environmental law.  He currently leads FAA Office of Adjudication\, which adjudicates and mediates civil penalty appeals\, other enforcement cases\, contract claims\, and bid protests.  Before joining FAA\, he served in several civilian positions for the Department of the Navy.  These included serving as a Senior Trial Attorney in the Navy Litigation Office and later as the Assistant General Counsel (ADR).  For several years he has been an author and active speaker on ADR matters.  He has served in leadership positions for the Interagency ADR Working Group\, the ADR Committee of the American Bar Association’s Section of Public Contract Law\, and the National Conference of Administrative Law Judiciary. \n\nRegistration\nRegistration is Closed \nRegistration Fees \n\nFBA Member: $0\nGovernment Employees: $0\nNonmember: $75\n\n\n\n\n\n\n\n\n\nLive Captioning: Closed captioning is available for all virtual webcasts. \n\n\nInternet Requirements: Virtual programs require suitable internet strength to stream online panels. SUMMARY:Qui Tam Section: [VIRTUAL] The FCA Beyond Healthcare - New Military Spending
DESCRIPTION:As of December 2022\, the Council of Foreign Relations reports that the United States of America has sent 12.7 billion worth of equipment and weapons to Ukraine to aid in their efforts to repel the invasion by Russia. All those munitions were either pulled from existing military stockpiles\, in which case they will need to be replaced\, or were manufactured expressly to be sent to Ukraine. While this is a fraction of the roughly 900 billion spent on health care it represents a significant increase in government spending on military. Those of us that have been doing the work know greed often fuels fraud\, and fraud follows money. In the coming years as the Federal Government increases its military spending our Bar can expect to see more cases brought by relators against government military contractors\, which will in turn create more work for the defense bar defending these cases. \nThis panel consist of an experienced Department of Defense OIG Investigator\, lawyers representing the Defense\, Relator and the Government. The moderator is a former United States Attorney. The panel is certain to provide a witty\, insightful\, informative\, fun discussion of an area of false claims that is certain to see growth in the years ahead. \n[Register Online] \n\nAbout the Presenters\nBart Daniel\, Nelson Mullins Riley & Scarborough LLP \n  \n  \n  \n  \n \nJames Leventis\, U.S. Attorney’s Office\, District of South Carolina \n  \n  \n  \n  \nBill Nettles\, Law Office of Bill Nettles \n  \n  \n  \n  \nGil Rosen\, Department of Defense \n  \n  \n  \n  \n  \nFran Trapp\, Law Office of Bill Nettles \n\nRegistration\n[Register Online] \n\nFBA Members: $0\nNon-Members: $0\n\n\nCLE\nPlease note that CLE credit is not offered for this webinar. \n\nEmail Communication Policy \nBy registering for this event\, you agree to receive email communications from the Federal Bar Association and affiliated sponsors of the program concerning event details\, Continuing Legal Education certification\, programming changes\, upcoming events\, surveys\, and post-event communications. \nRecording Disclaimer \nBy registering for an FBA webinar\, you agree to the recording of audio and visual content presented during the live event and consent to subsequent use of the recording by the FBA. SUMMARY:Webinar: The Future of Attorney-Client Privilege for In-House Counsel in the U.S.
DESCRIPTION:Although many lawyers assume that communications with clients are privileged\, exceptions to attorney-client privilege make certain categories of otherwise privileged communications discoverable. This presentation covers the attorney-client privilege under Model Rule of Professional Conduct 1.6 and two notable exceptions recognized by federal courts in employment litigation: the fiduciary exception in ERISA actions and reliance on attorney advice in asserting the good-faith defense in FLSA actions. Panelists will provide an overview of the attorney-client privilege and will discuss how federal courts apply these two exceptions in employment litigation. This presentation will also provide practical tips for asserting or challenging these two exceptions from the plaintiff and defendant standpoint. Lawyers will be able to (i) describe the two exceptions to the attorney-client privilege in employment litigation and articulate the logic behind these exceptions\, (ii) articulate when federal courts apply those exceptions\, and (iii) apply the ethics and caselaw surrounding these two exceptions into their employment litigation practice. \nPresented by the Federal Bar Association’s Labor and Employment Law Section and Corporate and Association Counsel Division. \n\nPresenters\nModerator: Lawson Fite\, Partner\, Marten Law\nLawson draws on a wealth of experience to address clients’ practical\, bottom-line business needs. SUMMARY:Oklahoma City Chapter: Section 230 in the Supreme Court
DESCRIPTION:Courts have uniformly held that 47 U.S.C. § 230 gives internet platforms a broad immunity against liability for content posted by the platforms’ users. But until 2023\, the Supreme Court had not interpreted the scope of section 230. This talk explores section 230’s immunity and four pending cases in which the Supreme Court is likely to decide what power the government has to compel—or restrict—content moderation online. \nWith your registration you will also receive a link to attend remotely should you choose to do so. \nRegistration\nDeadline to register is April 28\, 2023\nRSVP: Register Here! \nRegistration Fee: \n\nFree – FBA Member\n$25 – Non Member\n\nIf you have any questions regarding this program\, please contact Amanda Finch at OklahomaCityFBA@okcfedbar.com\,

SUMMARY:Qui Tam Section: [VIRTUAL] Cooperation Credit in FCA Settlements - Is the Juice Worth the Squeeze?
DESCRIPTION:It has been nearly four years since Department of Justice issued guidelines outlining the factors it would consider when determining whether to credit voluntary disclosures\, cooperation\, and remediation in False Claims Act settlements\, yet this may be the first panel to bring together experienced government and defense practitioners to perform a deep dive into those guidelines and how they’ve been implemented in practice. \nWhat steps must a company take in order to receive cooperation credit in an FCA investigation? What is the impact of how voluntary disclosure and cooperation is treated in HHS OIG administrative cases? Just how often are companies cooperating in meaningful ways? And how has the government rewarded companies that invest in strong compliance programs and who cooperate with investigations? SUMMARY:Dayton Chapter: Ethical Responsibilities in Representing Corporate Clients
DESCRIPTION:While many lawyers represent organizations or are engaged in litigation with organizations\, these engagements raise unique ethical issues. Fundamentally\, who is your client? From whom can you take direction? With whom are you allowed to speak? What are your obligations in communicating with former employees of an entity that has counsel? What are you able to do when your client has problems in jurisdictions where you are not admitted to practice? We will discuss these issues in our presentation\, “Ethical Responsibilities in Representing Corporate Clients.” \nSpeaker\nDan Gentry\, Esq.\, Attorney\, President\, and CEO of Coolidge Wall Co.\, L.P.A. \nAs a member of the litigation department\, Dan focuses his practice on business and employment litigation and dispute resolution. He has handled a variety of business disputes\, discrimination and harassment claims\, non-competition and trade secret litigation\, tort litigation\, and other disputes arising from business operations and transactions. Dan has tried cases to judges and juries in Ohio courts\, advocated before Ohio courts of appeal and administrative agencies\, and represented clients in mediations and arbitrations. Most recently before joining the firm\, Dan served as in-house counsel to a local high-tech R&D company. He has also provided training to young lawyers and addressed local business organizations on topics of interest related to business disputes. \nRegistration\nRegistration Deadline May 8\, 2023\nSpace is limited; attendees must register. DESCRIPTION:Presented by the Federal Bar Association’s Diversity and Inclusion Committee \nMore than a year after the United States withdrew from Afghanistan\, about 88\,500 Afghans have resettled across this country.  Refugees require support on many different levels—evacuation\, immigration assistance\, and resettlement.  Among the many who have resettled here are lawyers and judges from Afghanistan whose human rights and rule of law work – or whose very existence as a symbol of women’s equality – put their lives at risk.  These professionals face a daunting task rebuilding their lives and livelihoods in a foreign place.  What role does our legal community have in supporting this transition?  Why should lawyers and judges get involved\, and what can we do to help?  Through this one-hour presentation\, you will learn why this work matters\, meet an Afghan refugee-lawyer now employed as a paralegal\, and hear about a project started by the South Asian Bar Association of San Diego.  Attendees will leave with a clearer sense of the refugee experience and what they personally can do to effect change. \n\nPresenters\nModerator: Alejandro Del Carmen\, Ph.D.\, Tarleton State University (a member of the Texas A&M University System)  \nAlejandro (Alex) del Carmen migrated to the United States as a refugee from war-torn Nicaragua at the age of 12.  He received a Ph.D. in Criminology from the College of Criminology at the Florida State University.
