DESCRIPTION:Ever since the Civil War\, the federal False Claims Act (FCA) has been a powerful weapon against fraudulent claims on federal funds. In the age of COVID-19\, with trillions in government aid sluicing into the U.S. economy\, the FCA is on the front lines yet again. This webinar provides a much-requested update to the two-part series on coronavirus stimulus fraud that the FBA’s Qui Tam Section presented in early May. Part III of “Fighting Fraud in a Pandemic” will cover major FCA-related developments from the past three months\, with a special focus on emerging priorities at the Department of Justice; on the mechanics of stimulus fraud schemes that have drawn most prosecutorial attention; on the specific enforcement tools now being favored by DOJ (including the return of some oldies); and on antifraud initiatives beyond the DOJ. The same distinguished panel\, drawn from the leadership of the FBA’s Qui Tam Section\, will return. Scott Oswald – Chair\, FBA Qui Tam Section (moderator) \nScott Oswald is an accomplished trial lawyer who has brought more than 40 trials to verdict. His cases have recovered more than $300 million in judgments and settlements. A fellow of the prestigious College of Labor and Employment Lawyers\, he received his law degree from Howard University and honed his skills at Trial Lawyers College\, founded by the legendary Gerry Spence. Mr. Oswald litigates employment and whistleblower actions nationwide. Among his results: \n\nFirst jury verdict under new whistleblower protections in the National Defense Authorization Act of 2013|\nFirst Sarbanes-Oxley Act liability verdict to withstand appeal\nFirst jury verdict under 2009 anti-retaliation provisions of False Claims Act\nFirst Dodd-Frank Act retaliation lawsuit to reach discovery in federal court\n\nMr. Oswald is chair of the Federal Bar Association’s Qui Tam Section and immediate past chair of the FBA’s Professional Ethics Committee. Lawdragon ranks him as one of the top 500 plaintiff-side employment lawyers in the country. \nDeidre Lamppin Colson\, Assistant U.S. Attorney for the Southern District of Alabama \nFor the past 12 years\, Deidre L. Colson has served as an Assistant U.S. Attorney for the Southern District of Alabama\, primarily prosecuting Health Care Fraud pursuant to the False Claims Act\, Stark Law\, Anti-Kickback Statute\, and the Controlled Substance Act.  Since 2013\, she has held the position of Civil Health Care Fraud Coordinator\, has held the position of Electronic Discovery Coordinator for 6 years\, and was recently appointed as the Religious Liberty Litigation Coordinator in response to the Attorney General’s October 6\, 2017\, Memorandum.  AUSA Colson has also served in the Appellate Division conducting En Banc oral argument before the Eleventh Circuit\, and has supervised the Southern District of Alabama’s Financial Litigation Unit\, which is responsible for enforcing the collection of criminal and civil debts owed to the United States or to victims of federal crimes pursuant to the Mandatory Victim Restitution Act. \nMs. Colson is a 1997 Magna Cum Laude graduate of Louisiana State University\, with a dual degree in History and Political Science.  Thereafter\, she received her Juris Doctorate degree from George Mason University School of Law located in Arlington\, Virginia.  After graduation\, she returned to the Mississippi Gulf Coast\, and served as a federal law clerk from 1993-1995\, to the Honorable David C. Bramlette\, III\, U.S. District Court\, Southern District of Mississippi\, Southern Division.   Before joining the U.S. Attorney’s Office\, Ms. Colson served as a trial attorney with an emphasis on insurance defense and medical malpractice for ten years with two private firms — Bryan\, Nelson\, et al.\, Pascagoula\, MS and Brown\, Buchanan & Sessoms\, Biloxi\, MS. \nSince 2008\, AUSA Colson has investigated and prosecuted various types of affirmative health care fraud cases and qui tam complaints involving skilled nursing facilities\, hospice and home health agencies\, compounding pharmacy cases\, pill mill schemes\, diversion\, illegal prescribing of controlled substances\, and fraudulent billing of medically unnecessary or un-provided medical services\, which resulted in convictions\, civil judgments\, and multi-million dollar settlements.  AUSA Colson actively works with the Southern District of Alabama’s Criminal Division parallel prosecutions\, and as HCF Coordinator spearheads Alabama’s Annual Health Care Fraud Working Group Meetings\, which are strategic and information sharing endeavors between federal\, state and local litigators and law enforcement. \nMegan Jeschke\, Partner at Holland & Knight \nMegan Jeschke is a partner at Holland & Knight and a member of the firm’s White Collar Defense and Investigations\, Compliance Services\, and Government Contracts teams. She is a litigator with an emphasis on civil and criminal enforcement matters in the government contracts\, healthcare\, and pharmaceutical industries. She represents companies facing criminal\, civil\, or administrative actions brought by the U.S. Department of Justice (DOJ) or agency Offices of Inspectors General (OIG)\, to include qui tam actions brought by relators under the civil False Claims Act (FCA)\, in the areas of procurement fraud\, healthcare fraud\, public corruption and procurement integrity\, and whistleblower reprisal. She has argued successfully before the Court of Appeals for the Ninth Circuit\, brought to verdict several criminal jury trials\, negotiated favorable settlements\, helped clients avoid suspension or debarment\, successfully argued for dismissal and declination\, and regularly conducts internal investigations\, large and small. She helps clients navigate suspension\, debarment and exclusion proceedings\, as well as provides advice on self-reporting protocols and mandatory disclosure rules. She also conducts compliance program effectiveness reviews and advises on compliance program protocols.  Ms. Jeschke holds an active security clearance and is experienced in conducting classified internal investigations and handling criminal cases involving the Classified Information Procedures Act (CIPA). Ms. Jeschke is a frequent lecturer on the FCA and on best practices in internal investigations. She has assisted in teaching the White Collar Investigations\, Enforcement and Business Risk Mitigation class at the University of Virginia School of Law. In addition\, Ms. Jeschke is a co-editor of the Corporate Compliance Answer Book\, and serves as the vice president of the Federal Bar Association’s Qui Tam Section. \nRachel V. Rose –Principal at Rachael V. Rose\, Attorney at Law\, PLLC \nMs. Rose has a unique background. DESCRIPTION:Please join the LGBT Law Section of the Federal Bar Association (FBA) for a webinar to discuss the Administration’s recent decisions on health care access and protections for transgender people.  Guests will discuss several different examples including 1) the Trump Administration’s rollback of transgender healthcare protections put in place by the Obama Administration in Section 1557 of the Affordable Care Act (ACA)\, which “prohibits discrimination based on race\, color\, national origin\, sex\, age or disability in certain health programs and activities” 2) efforts in state legislatures across the country to criminalize gender-affirming care for trans youth 3) exclusions for gender affirming care in state Medicaid programs and 4) barriers to healthcare for transgender prisoners. \nThis panel will feature two leading attorneys who are well-versed in the area of transgender health protections\, Shannon Minter\, Legal Director of the National Center for Lesbian Rights (NCLR)\, and Carl Charles\, a Staff Attorney in the New York office of Lambda Legal\, who will address how these actions affect transgender youth and adults\, the legal challenges and advocacy responses\, and what is to come in this area. \nPresented by the LGBT Law Section \nRegistration for this event is now closed. \n\nAbout the Presenters:\nBrandon King\, Associate\, Baker & McKenzie LLP; FBA LGBT Law Section Chair (Moderator) \nBrandon King is an associate in Baker McKenzie’s Tax Practice Group in Washington\, DC. He focuses on tax controversy and tax planning. Brandon regularly advises clients on various aspects of tax law\, including international tax planning for multinational corporations and tax dispute resolution. Prior to joining the Firm\, Brandon was a law clerk for the Honorable Albert G. Lauber at the United States Tax Court. He also served as a Presidential Personnel Associate in the Obama administration\, where he was the tax advisor on the vetting team for presidential nominations. He received his BA in Political Science from University of Cincinnati\, followed by his JD at Indiana University’s Maurer School of Law and LLM at Georgetown University Law Center. \nCarl Charles\, Staff Attorney\, Lambda Legal \nCarl Charles is a Staff Attorney in the New York Office of Lambda Legal\, the oldest and largest organization dedicated to advancing the civil rights of lesbians\, gay men\, bisexuals\, transgender people and individuals living with HIV\, where he previously served as a law fellow in the Transgender Rights Project. During his time at Lambda Legal\, Carl has been involved in litigating a number of cases expanding and solidifying federal civil rights protections for transgender people. Most recently\, he is counsel in Karnoski v. Trump\, a federal lawsuit challenging the constitutionality of the Trump administration’s ban on military service by transgender people\, counsel in Conforti v. St. Joseph’s Healthcare\, a federal lawsuit filed in response to a New Jersey Catholic Hospital’s discriminatory denial of transition-related health care for a transgender man\, and counsel in the recently filed Eller v. Prince George’s County School District\, a federal lawsuit on behalf of a teacher who endured years of abuse\, harassment and retaliation at the hands of school administrators\, fellow teachers\, staff\, parents and students because she is a transgender woman. Prior to joining Lambda Legal\, Carl served as a Staff Attorney with the LGBTQ Rights Project at A Better Balance and the New York City Commission on Human Rights Law Enforcement Bureau. Carl has written about his own experiences as a transgender man\, as well as legal issues facing transgender people for publications including The Advocate\, Conde Nast’s them.\, and the former LGBTQ Digital News platform Into. Carl is a graduate of the University of Denver Sturm College of Law where he was co-president of OUTLaw and vice president of the Student Bar Association. He received his bachelor’s degree in English Education from the University of Northern Colorado. \nShannon Minter\, Legal Director\, National Center for Lesbian Rights (NCLR) \nShannon Minter is the Legal Director of the National Center for Lesbian Rights (NCLR)\, one of the nation’s leading advocacy organizations for lesbian\, gay\, bisexual\, and transgender people. Minter was lead counsel for same-sex couples in the landmark California marriage equality case which held that same-sex couples have the fundamental right to marry and that laws that discriminate based on sexual orientation are inherently discriminatory and subject to the highest level of constitutional scrutiny. Minter was also NCLR’s lead attorney in Christian Legal Society v. Martinez\, a U.S. Supreme Court decision upholding student group policies prohibiting discrimination based on sexual orientation and gender identity\, and rejecting the argument that such policies violated a student group’s rights to freedom of speech\, religion\, and association.  NCLR represented Hastings Outlaw\, an LGBTQ student group who intervened to help defend the nondiscrimination policy. In 2009\, Minter was named a California Lawyer of the Year by California Lawyer. He received the Dan Bradley Award from the National Gay and Lesbian Bar Association for outstanding work in marriage cases in 2008. Minter was one of 18 people to receive the Ford Foundation’s “Leadership for a Changing World” award in 2005. Shannon has also received the Anderson Prize Foundation’s Creating Change Award by the National Gay and Lesbian Task Force and the Distinguished National Service Award from GAYLAW\, Cornell Law School’s Exemplary Public Service Award\, the Unity Award from Bay Area Lawyers for Individual Freedom\, the Advocacy Award from the San Francisco Bar Association\, and the Justice Award from Equality California. Minter serves on the boards of Faith in America and the Transgender Law & Policy Institute. He has previously served on the American Bar Association Commission on Sexual Orientation and Gender Identity. Minter received his J.D. from Cornell Law School in 1993. Panelists Mark Giuffre\, Robert Hass\, and Debra Kirby will join moderator Sharonda Williams for this one hour CLE offered on Zoom at 1:30pm CST. \nPolice reform is not a linear process\, but rather an intersection of multiple efforts. Our expert panel of thought leaders has addressed police reform across a range of interventions including court oversight\, collaborative reform and external independent review and investigation. DESCRIPTION:In the wake of the police accountability problems that are confronting America\, it is even more vital that we are educated on issues surrounding law enforcement’s liability.  The third installment of this program will shed light on police and municipal liability arising from encounters with people who have a disability.  The panelists will discuss how Section 1983 has been applied in these encounters and law enforcement compliance with and best practices under the Americans With Disabilities Act. \nThe panelists will be Bill Goren\, the first president of the National Association of Attorneys With Disabilities and a national expert on Americans With Disabilities Act compliance\, Julie Chovanes\, a transgender woman who owns her own firm focusing on civil rights impact litigation\, Sergeant Cheryl Dorsey\, who became a social justice advocacy consultant after serving in the Los Angeles Police Department for more than 20 years\, and Jeff Rothman\, a New York City attorney specializing in representing plaintiffs in police and law enforcement misconduct cases\, including cases arising from arrests during Occupy Wall Street and Black Lives Matter protests. \nPrevious installments of this webinar series addressed both the prosecution and defense points of view. Part One shared insights on how law enforcement is trained\, special considerations that arise during their prosecution\, and solutions for the problems we face. Part Two featured a panel of defense attorneys with expertise in representing officers. \nThe programs will be moderated by Kiera Murphy and Ann Motl\, who are both attorneys involved with Federal Bar Association diversity and inclusion efforts. Tara Norgard\, Chair of the National Diversity & Inclusion Committee\, also provided vital support in developing the programs. \nPresented by the Diversity & Inclusion Standing Committee \nEndorsed by: \n\nCivil Rights Law Section\nMinnesota Chapter\n\n\nAbout the Presenters\nJulie Chovanes\, Attorney\, Chovanes Law\nJulie Chovanes graduated from Villanova University\, Villanova\, PA with four degrees including law.  She founded Chovanes Law after she left her partnership in the largest law firm in the world\, DLA Piper\, in order to better serve her clients.  Julie practices civil rights law and advocacy and has practiced in commercial areas\, ranging from business law and litigation to patent law.  She has changed the law to force recognition of the rights of trans people\, including practicing at the intersection of trans rights and the Americans With Disabilities Act.  Julie is also one of the few trans women to have her own firm and engage in impact litigation matters for trans and other people.   \nSgt. Cheryl Dorsey\, Los Angeles Police Department (ret.)\nCheryl Dorsey is a Los Angeles native and joined the LAPD in 1980. During her career\, she worked exclusively in patrol and specialized units in all four Bureaus within the City of Los Angeles; South\, Central\, West and Valley. In addition to various patrol division assignments\, Sgt. Dorsey was assigned to the infamous gang unit in Operations South Bureau; known as Community Resources Against Street Hoodlums (C.R.A.S.H.) under the command of Police Chief Daryl F. Gates. Sgt Dorsey also chronicled her LAPD career and social justice advocacy in an autobiography; “Black and Blue\, Creation of A Social Advocate”. \nWilliam D. Goren\, Attorney\, William D. Goren JD LLM LLC\nWilliam D. Goren has 30 years of experience dealing with the ADA as an Attorney. His law practice and consulting practice as well as his blog\, Understanding the ADA (an ABA 100 blog from 2014-2018). There was no ABA 2019)\, focus on understanding the ADA so that the client understands what it means to comply with that law. In particular\, he provides consulting (which includes but is not limited to: training and serving as an ADA compliance expert witness; consulting expert; or consultant on ADA and related laws on matters in litigation)\, representation (providing counseling or co-counseling services)\, those involving compliance with the Americans with Disabilities Act\, Rehabilitation Act of 1973\, and related laws. He is also a trained mediator\, a FINRA arbitrator\, and an arbitrator on the CPR employment law panel. Finally\, he is the author of Understanding the ADA\, now in its 4th edition (ABA 2013)\, and numerous other articles on the rights of persons with disabilities. Mr. Goren has an A.B. in Political Science from Vassar College\, a J.D. from University of San Diego School of Law\, and an LL.M. in Health Law from DePaul University College of Law. Interesting fact: he trained his miniature poodle to be a hearing dog for when he is in his virtual office.  \nJeffrey A. Rothman\, Attorney at Law\, Solo Practitioner\nJeffrey A. Rothman is a solo practitioner in New York City\, concentrating in the area of civil rights litigation\, mostly involving police and other law enforcement misconduct.  He is a 2001 graduate of the University of Pennsylvania Law School. Mr. Rothman was one of the attorneys who represented arrestees in the civil rights litigation stemming from the mass arrests during the 2004 Republican National Convention demonstrations in New York City.  He has also represented a number of arrestees from other political demonstrations\, including those associated with the Occupy Wall Street movement and the Black Lives Matter movement\, other political activists\, and numerous others whose rights have been violated by law enforcement or other branches of the government\, or by private entities acting in conjunction with the government\, in myriad circumstances.  Mr. Rothman has also litigated extensively on behalf of prisoners and detainees\, concerning abuses they suffered while incarcerated and concerning their wrongful imprisonment in jail\, prison\, or in immigration detention. \nModerated By:\nAnn Motl\, Associate\, Maslon LLP\nAnn Motl is a registered patent attorney with the U.S. Patent and Trademark Office and represents clients in complex intellectual property litigation. Her substantial experience includes all phases of pre-trial civil litigation and motion practice in the federal courts. Committed to advancing the profession through leadership and pro bono service\, Ann is actively involved in the Minnesota Chapter of the Federal Bar Association where she currently serves as co-chair of the Digital Communications Committee. She has represented a pro bono client in a Social Security disability appeal while working with the Minnesota Chapter’s Pro Se Project\, and has also represented pro bono clients in housing and habeas matters while working with Volunteer Lawyers Network and Mid-Minnesota Legal Aid. \nKiera K.
