SUMMARY:Webinar: How to Support Asylum Seeker and Asylee Clients During the Current Crisis
DESCRIPTION:Panelists Anam Rahman\, Ben Levey\, and Courtney Madsen\, will review the myriad of challenges asylum seekers and asylees currently face\, from the Trump Administration’s drastic changes to asylum in the United States\, to the mass layoffs that occurred due to the COVID-19 pandemic. Panelists will offer solutions where possible\, providing guidance on submitting comments on the Trump administration’s most recent proposed Asylum rule\, sharing best practices for helping clients access social services and support during these difficult times\, and discussing how to help clients navigate the uncertainty we are all facing. \nRegistration for this event has passed. \n\nAbout the Presenters\nBen Levey (Asylee Outreach Specialist\, HIAS) manages the Maryland Asylee Outreach Project\, an effort to help asylees in Maryland access the benefits and services to which they are entitled. The Asylee Outreach Project is funded by the Maryland Office for Refugees and Asylees. Under the auspices of the project\, Ben designed asyleeoutreach.org\, a multi-language website aimed at helping asylees\, attorneys\, and other advocates learn more about the benefits available to asylees. Ben also serves as the current Chair for RCUSA’s Asylum Services Working Group\, working closely with colleagues nationwide to help facilitate the integration of asylum seekers and asylees. Prior to joining HIAS\, Ben completed a teaching fellowship through Princeton in Asia. Ben graduated Phi Beta Kappa from Northwestern University and was born and raised in Milwaukee\, Wisconsin. He is committed to working toward collective liberation\, and he speaks Spanish and is conversant in Thai. \nCourtney Madsen started working in refugee resettlement in 2007. She has worked both in local resettlement offices and in the national program offices to assist refugee and asylees from around the world who have come to the United States seeking safety in a new community. She has a MA in International Studies – Middle East from the University of Washington in Seattle\, and currently serves as the office director for the Church World Service Jersey City resettlement office. \n  \nAnam Rahman is a partner at the law firm Calderón Seguin PLC located in Fairfax\, Virginia. Her immigration practice covers a broad array of matters including nonimmigrant and immigrant visas\, family-sponsored petitions\, waivers of inadmissibility\, asylum\, humanitarian relief\, and all forms of relief from removal. Anam specializes in asylum and removal defense\, including direct representation of detained individuals\, and regularly appears before the Arlington and Baltimore Immigration Courts. She also represents clients in seeking affirmative forms of relief as well as appellate and federal work before the Board of Immigration Appeals\, Administrative Appeals Office\, U.S. District Court for the Eastern District of Virginia\, and U.S. Court of Appeals for the Fourth Circuit. Additionally\, Anam is an Adjunct Professor at Georgetown Law School\, teaching the Women and Immigration Fieldwork Practicum\, and a Board Member of AsylumWorks. Henry Law (Moderator) \nGabriel (Gabe) Soto grew up in Seguin\, Texas and graduated from Villanova University with a BA in 1997. Gabriel is licensed by the Texas and Illinois Bar. He also enjoys fishing\, running\, and outdoors activities with his two children. \nDaniel Lacy\, Command Labor Attorney\, United States Military Entrance Processing Command \nDaniel (Dan) Lacy grew up in Westmont\, Illinois and graduated from Valparaiso University in 2006. He graduated from The John Marshall Law School in Chicago with his J.D. in 2010 and his LL.M. (Information Technology and Privacy Law) in 2011.  Daniel was named Assistant Director of Academic Achievement at The John Marshall Law School.  In that role\, he oversaw bar preparation courses for 3L students as well as teaching Professional Responsibility and Bar Essay Writing.  In 2012\, Dan joined the Army Reserve Judge Advocate General Corps as a Second Lieutenant.  In 2015\, Dan became a labor and employment law attorney for the United States Military Entrance Processing Command (USMEPCOM) in North Chicago\, IL. USMEPCOM is responsible for the processing and enlistment of all applicants into the Uniformed Services.  In this role\, he has responsibility for all labor and employment legal actions taken against or by the Command.  He handles on average over 40 Merit Systems Protection Board actions\, 30 Equal Employment Opportunity Commission discrimination suits\, and multiple Federal Labor Relations Authority actions.  He is responsible for over 3\,000 civilian employees at 66 sites nationwide (including Puerto Rico) for a joint command with direct reporting to the Office of the Secretary of Defense.  Dan is one of two ethics counselors for the Command and reviews contracts for fee-based providers totaling over $200\,000\,000 a year.  He is also a Captain and acting Brigade Judge Advocate for the 420th Engineer Brigade\, Bryan Texas. He currently lives in Westmont\, Illinois with his wife Beth and two dogs\, Maverick & Dasha. \nNeil Groberg\, Mediator and Attorney\, Groberg Mediation \nNeil Groberg owns Groberg Mediation located in Burlington\, Vermont. He provides mediation\, arbitration and facilitation services online and in person as well as teaching\, training\, and independent harassment investigations in Vermont\, Connecticut\, New York\, throughout New England and beyond. Neil spent many years as in-house counsel focusing on labor and employment issues (and serving as the alternative work scheduling facilitator for the State of Connecticut and one of its major unions). Neil also currently teaches health care law to Bachelor of Science and Masters of Health Care Administration students at Champlain College and has also taught Employment Law and Business Law to college and grad students. During his military career\, John served as a Staff Judge Advocate\, prosecutor\, defense counsel\, appellate counsel\, and Military Judge. John is originally from Fremont\, Nebraska and is a graduate of Creighton University and the Creighton University School of Law. \nWilliam S.W. Chang\, Deputy General Counsel\, U.S. Department of Health and Human Services \nWill Chang is Deputy General Counsel of the U.S. Department of Health and Human Services.  In that role\, Will advises HHS’ senior leadership on high-priority public-health issues\, regulatory reforms\, litigations\, internal and external investigations\, and fraud-and-abuse matters.  Will’s portfolio includes several operating and staff divisions\, including the Centers for Disease Control and Prevention\, National Institutes of Health\, Health Resources and Services Administration\, and Office of the Assistant Secretary for Health. Polly began her career at the Washington Metropolitan Area Transit Authority (WMATA) where she progressed through the ranks. Bidwell\, Senior Vice President\, Security for Airports Council International – North America (ACI-NA) \nChristopher Bidwell was named Senior Vice President\, Security for Airports Council International – North America (ACI-NA) in January 2019. In this position\, he is responsible for leading the association’s efforts on aviation security and oversight of ACI-NA’s regulatory activities. Bidwell serves as a subject matter expert\, providing guidance on security policy\, monitoring domestic and international aviation security developments as well as regulatory actions and programs affecting security at North American airports. Bidwell represents industry aviation security interests as a member of several Department of Homeland Security (DHS) and Transportation Security Administration (TSA) committees and working groups. He chairs the DHS Aviation Sector Coordinating Council (ASCC) and serves as the vice chair of the TSA Aviation Security Advisory Committee (ASAC)\, providing recommendations to further enhance aviation security. \nThomas Bush\, Deputy Executive Assistant Administrator for Operations Support\, Transportation Security Administration \nThomas Bush was named the Deputy Executive Assistant Administrator for Operations Support in March 2020. He is currently leading the Business Resumption Task Force\, which is charged with the planning and coordination of TSA’s return to full operations\, as well as the future state of operations\, following the COVID-19 pandemic. He comes to Operations Support from the Intelligence and Analysis program office where he served as the Assistant Administrator since November 2015. He was previously the Deputy Assistant Commissioner for the Office of Intelligence with U.S. Customs and Border Protection. Prior to his role as CBP\, Bush served a two-year assignment as the Senior Advisor to the Secretary of Homeland Security on Vetting and Intelligence systems. Bush began his career in 1991 as a program analyst for the Department of Defense Strategic Defense Initiative and entered the U.S. Customs Service in 1994. It was not always so. \nOn January 25\, 1995\, Boston Police Officers beat a black man to within an inch of his life. They were chasing a murder suspect\, and in the dark\, attacked one of their own\, who was dressed in plain clothes. Upon discovering their error\, they ran away. No officer was indicted. In 1998\, the victim prevailed against individual officers in a civil action tried before the Honorable William J. Young. The City of Boston then settled for seven figures shortly before empanelment of a separate trial to determine its independent liability. Author Dick Lehr\, who was with the Boston Globe Spotlight team at the time\, published a gripping account of the full story in 2009: “The Fence” (Harper Collins). She is a litigator with an emphasis on civil and criminal enforcement matters in the government contracts\, healthcare\, and pharmaceutical industries. Caffrey III\, Assistant U.S. Attorney\, U.S. Attorney’s Office for the District of New Jersey \nAndrew Caffrey is an Assistant U.S. Attorney in the Health Care Fraud Unit based in Newark\, New Jersey. He brings affirmative civil enforcement actions involving fraud and abuse in the health care industry\, including illegal kickbacks\, the sale of misbranded drugs\, and fraudulent billing schemes. He is also the civil Health Care Fraud Coordinator for his office\, with responsibilities for monitoring his office’s docket of whistleblower litigation\, training new AUSAs\, and serving as a liaison with Main Justice and other U.S. Attorney’s Offices. Before joining the U.S. Attorney’s Office in New Jersey\, Mr. Caffrey had been in private practice in Boston for nearly ten years\, representing clients in white collar defense as well as in a wide range of civil litigation. He also taught a January term course for a number of years at Harvard Law School. \nDan Kessler\, Professor of Political Economy\, Stanford University \nDaniel Kessler is a professor at Stanford Graduate School of Business\, a senior fellow at Stanford’s Hoover Institution\, a professor at Stanford Law School\, and a Research Associate at the National Bureau of Economic Research. His research interests include empirical studies in antitrust law\, law and economics\, and the economics of health care. He holds a PhD in economics from M.I.T. and a law degree from Stanford. DESCRIPTION:Please join the LGBT Law Section of the Federal Bar Association (FBA) for a webinar to discuss the Administration’s recent decisions on health care access and protections for transgender people.  Guests will discuss several different examples including 1) the Trump Administration’s rollback of transgender healthcare protections put in place by the Obama Administration in Section 1557 of the Affordable Care Act (ACA)\, which “prohibits discrimination based on race\, color\, national origin\, sex\, age or disability in certain health programs and activities” 2) efforts in state legislatures across the country to criminalize gender-affirming care for trans youth 3) exclusions for gender affirming care in state Medicaid programs and 4) barriers to healthcare for transgender prisoners. \nThis panel will feature two leading attorneys who are well-versed in the area of transgender health protections\, Shannon Minter\, Legal Director of the National Center for Lesbian Rights (NCLR)\, and Carl Charles\, a Staff Attorney in the New York office of Lambda Legal\, who will address how these actions affect transgender youth and adults\, the legal challenges and advocacy responses\, and what is to come in this area. \nPresented by the LGBT Law Section \nRegistration for this event is now closed. \n\nAbout the Presenters:\nBrandon King\, Associate\, Baker & McKenzie LLP; FBA LGBT Law Section Chair (Moderator) \nBrandon King is an associate in Baker McKenzie’s Tax Practice Group in Washington\, DC. He focuses on tax controversy and tax planning. Brandon regularly advises clients on various aspects of tax law\, including international tax planning for multinational corporations and tax dispute resolution. Prior to joining the Firm\, Brandon was a law clerk for the Honorable Albert G. Lauber at the United States Tax Court. He also served as a Presidential Personnel Associate in the Obama administration\, where he was the tax advisor on the vetting team for presidential nominations. He received his BA in Political Science from University of Cincinnati\, followed by his JD at Indiana University’s Maurer School of Law and LLM at Georgetown University Law Center. \nCarl Charles\, Staff Attorney\, Lambda Legal \nCarl Charles is a Staff Attorney in the New York Office of Lambda Legal\, the oldest and largest organization dedicated to advancing the civil rights of lesbians\, gay men\, bisexuals\, transgender people and individuals living with HIV\, where he previously served as a law fellow in the Transgender Rights Project. During his time at Lambda Legal\, Carl has been involved in litigating a number of cases expanding and solidifying federal civil rights protections for transgender people. Most recently\, he is counsel in Karnoski v. Trump\, a federal lawsuit challenging the constitutionality of the Trump administration’s ban on military service by transgender people\, counsel in Conforti v. St. Joseph’s Healthcare\, a federal lawsuit filed in response to a New Jersey Catholic Hospital’s discriminatory denial of transition-related health care for a transgender man\, and counsel in the recently filed Eller v. Prince George’s County School District\, a federal lawsuit on behalf of a teacher who endured years of abuse\, harassment and retaliation at the hands of school administrators\, fellow teachers\, staff\, parents and students because she is a transgender woman. Prior to joining Lambda Legal\, Carl served as a Staff Attorney with the LGBTQ Rights Project at A Better Balance and the New York City Commission on Human Rights Law Enforcement Bureau. Carl has written about his own experiences as a transgender man\, as well as legal issues facing transgender people for publications including The Advocate\, Conde Nast’s them.\, and the former LGBTQ Digital News platform Into. Carl is a graduate of the University of Denver Sturm College of Law where he was co-president of OUTLaw and vice president of the Student Bar Association. He received his bachelor’s degree in English Education from the University of Northern Colorado. \nShannon Minter\, Legal Director\, National Center for Lesbian Rights (NCLR) \nShannon Minter is the Legal Director of the National Center for Lesbian Rights (NCLR)\, one of the nation’s leading advocacy organizations for lesbian\, gay\, bisexual\, and transgender people. Minter was lead counsel for same-sex couples in the landmark California marriage equality case which held that same-sex couples have the fundamental right to marry and that laws that discriminate based on sexual orientation are inherently discriminatory and subject to the highest level of constitutional scrutiny. Minter was also NCLR’s lead attorney in Christian Legal Society v. Martinez\, a U.S. Supreme Court decision upholding student group policies prohibiting discrimination based on sexual orientation and gender identity\, and rejecting the argument that such policies violated a student group’s rights to freedom of speech\, religion\, and association.  NCLR represented Hastings Outlaw\, an LGBTQ student group who intervened to help defend the nondiscrimination policy. In 2009\, Minter was named a California Lawyer of the Year by California Lawyer. He received the Dan Bradley Award from the National Gay and Lesbian Bar Association for outstanding work in marriage cases in 2008. Minter was one of 18 people to receive the Ford Foundation’s “Leadership for a Changing World” award in 2005. Shannon has also received the Anderson Prize Foundation’s Creating Change Award by the National Gay and Lesbian Task Force and the Distinguished National Service Award from GAYLAW\, Cornell Law School’s Exemplary Public Service Award\, the Unity Award from Bay Area Lawyers for Individual Freedom\, the Advocacy Award from the San Francisco Bar Association\, and the Justice Award from Equality California. Minter serves on the boards of Faith in America and the Transgender Law & Policy Institute. He has previously served on the American Bar Association Commission on Sexual Orientation and Gender Identity. Minter received his J.D. from Cornell Law School in 1993.
