DESCRIPTION:In 1976 and 1998 Congress extended the terms of copyright.  Congress intended for authors to receive the full economic benefit of the extended copyright terms by granting authors and their heirs inalienable rights to recapture copyrights.  These recaptured copyrights\, vesting free of all prior grants\, could then be re-licensed on economic terms favorable to authors.  To protect authors’ families from disinheritances\, late-life lovers or squabbles among over-reaching heirs\, Congress preempted state inheritance law and created statutory heirs. \nCongress’ statutory scheme benefitting authors and their families has been threatened by recent decisions of the Second and Ninth Circuits that have generated a recent cert petition to the Supreme Court in Steinbeck v. DESCRIPTION:In his presentation\, A Judge’s Perspective on the Science and Art of Legal Writing\, Judge Bacharach will illustrate principles from his recently published book (ABA Press)\, entitled Legal Writing–A Judge’s Perspective on the Lessons from Science and Rhetoric. Judge Bacharach’s presentation draws on lessons from the field of psycholinguistics\, which involves the study of how the human brain processes and stores language. For example\, psycholinguistics have studied how quickly or slowly we read particular types of passages\, how the human brain filters written language\, and how the brain stores certain information for recall and not other information. But the presentation is not an academic foray into science. \nJudge Bacharach’s presentation uses these scientific principles to show how attorneys\, judges\, and law students can improve the clarity and memorability of their legal writing. The book illustrates these lessons with examples from well-known advocates and orators\, showing how we can apply the same principles to our own legal writing. \n\nAbout the Presenter\n \nHon. Robert Bacharach\, U.S. Court of Appeals for the Tenth Circuit \nJudge Bacharach was appointed in March 2013 as a United States Circuit Judge for the Tenth Circuit Court of Appeals. He graduated with High Honors from the University of Oklahoma with a B.A. in History and obtained his Juris Doctorate from Washington University School of Law in St. Louis\, where he graduated Order of the Coif. In law school\, he also served as the Developments Editor of the Washington University Law Quarterly. \nUpon graduation from law school\, Judge Bacharach clerked for Judge William J. Holloway\, Jr.\, who was then the Chief Judge of the Tenth Circuit Court of Appeals. After completing this clerkship\, Judge Bachaarach practiced civil litigation at Crowe & Dunlevy in Oklahoma City. McCarthy\, Magistrate Judge\, Southern District of New York \nJudge McCarthy was sworn in as a United States Magistrate Judge for the Southern District of New York on April 14\, 2014. Brieant United States Courthouse in White Plains. \nFrom January 2011 until her appointment\, Judge McCarthy was Executive Vice President & General Counsel of the New York Power Authority\, where she served as NYPA’s chief legal officer and supervised a staff of 30\, including the authority’s Corporate Secretary and Chief Ethics & Compliance Officer. DESCRIPTION:Panelists Anam Rahman\, Ben Levey\, and Courtney Madsen\, will review the myriad of challenges asylum seekers and asylees currently face\, from the Trump Administration’s drastic changes to asylum in the United States\, to the mass layoffs that occurred due to the COVID-19 pandemic. Panelists will offer solutions where possible\, providing guidance on submitting comments on the Trump administration’s most recent proposed Asylum rule\, sharing best practices for helping clients access social services and support during these difficult times\, and discussing how to help clients navigate the uncertainty we are all facing. \nRegistration for this event has passed. \n\nAbout the Presenters\nBen Levey (Asylee Outreach Specialist\, HIAS) manages the Maryland Asylee Outreach Project\, an effort to help asylees in Maryland access the benefits and services to which they are entitled. The Asylee Outreach Project is funded by the Maryland Office for Refugees and Asylees. Under the auspices of the project\, Ben designed asyleeoutreach.org\, a multi-language website aimed at helping asylees\, attorneys\, and other advocates learn more about the benefits available to asylees. Ben also serves as the current Chair for RCUSA’s Asylum Services Working Group\, working closely with colleagues nationwide to help facilitate the integration of asylum seekers and asylees. Prior to joining HIAS\, Ben completed a teaching fellowship through Princeton in Asia. Ben graduated Phi Beta Kappa from Northwestern University and was born and raised in Milwaukee\, Wisconsin. He is committed to working toward collective liberation\, and he speaks Spanish and is conversant in Thai. \nCourtney Madsen started working in refugee resettlement in 2007. She has worked both in local resettlement offices and in the national program offices to assist refugee and asylees from around the world who have come to the United States seeking safety in a new community. She has a MA in International Studies – Middle East from the University of Washington in Seattle\, and currently serves as the office director for the Church World Service Jersey City resettlement office. \n  \nAnam Rahman is a partner at the law firm Calderón Seguin PLC located in Fairfax\, Virginia. Her immigration practice covers a broad array of matters including nonimmigrant and immigrant visas\, family-sponsored petitions\, waivers of inadmissibility\, asylum\, humanitarian relief\, and all forms of relief from removal. Anam specializes in asylum and removal defense\, including direct representation of detained individuals\, and regularly appears before the Arlington and Baltimore Immigration Courts. She also represents clients in seeking affirmative forms of relief as well as appellate and federal work before the Board of Immigration Appeals\, Administrative Appeals Office\, U.S. District Court for the Eastern District of Virginia\, and U.S. Court of Appeals for the Fourth Circuit. Additionally\, Anam is an Adjunct Professor at Georgetown Law School\, teaching the Women and Immigration Fieldwork Practicum\, and a Board Member of AsylumWorks. To strengthen and improve public transportation\, Ms. Hanson coordinates with stakeholders to develop transit security\, risk and emergency management standards and policies. Hanson performs peer reviews and assists with safety audits and serves as an advocate for transportation security as well as a source matter expert on transit security\, risk and emergency management issues and concerns. Previously Ms. Hanson was the Chief of Police for AMTRAK where she led a national police department responsible for protecting over 30 million passengers and 20\,000 employees. Prior to Amtrak\, Polly was a career SES 1811 serving as the Director of the Office of Law Enforcement and Security for the Department of the Interior. At the Metropolitan Police Department in Washington D.C.\, Polly was the Executive Director\, Strategic Services Bureau where as a civilian Assistant Chief she oversaw the development of policy and procedures\, tactical crime analysis and research\, strategic planning\, applicant and promotional testing. Polly began her career at the Washington Metropolitan Area Transit Authority (WMATA) where she progressed through the ranks. As the Chief of the Metro Transit Police\, Polly led a tristate police department comprised of 1\,500 square miles and oversaw a budget of $50 million\, with 553 personnel and led the response to the terrorist attacks in Madrid and London\, help create public awareness campaigns and was an original member of the Peer Advisory Group (PAG) for the TSA Administrator. Polly received her Masters degree in Applied Behavioral Science from Johns Hopkins and her Bachelors degree in Communications from Temple University.  In addition\, Polly continued her education by attending the F.B.I. He is currently leading the Business Resumption Task Force\, which is charged with the planning and coordination of TSA’s return to full operations\, as well as the future state of operations\, following the COVID-19 pandemic. He comes to Operations Support from the Intelligence and Analysis program office where he served as the Assistant Administrator since November 2015. He was previously the Deputy Assistant Commissioner for the Office of Intelligence with U.S. Customs and Border Protection. Prior to his role as CBP\, Bush served a two-year assignment as the Senior Advisor to the Secretary of Homeland Security on Vetting and Intelligence systems. Bush began his career in 1991 as a program analyst for the Department of Defense Strategic Defense Initiative and entered the U.S. Customs Service in 1994. During his tenure\, Bush served as a program manager for the Office of Field Operations\, the Director of Analytical Development for the Office of Strategic Trade\, and Director of Targeting and Analysis Systems in the Office of Information and Technology. Addressing police violence is now at the forefront of the national conversation. Boston has not had major publicized incidents in recent days. It was not always so. \nOn January 25\, 1995\, Boston Police Officers beat a black man to within an inch of his life. They were chasing a murder suspect\, and in the dark\, attacked one of their own\, who was dressed in plain clothes. Upon discovering their error\, they ran away. No officer was indicted. In 1998\, the victim prevailed against individual officers in a civil action tried before the Honorable William J. Young. Colson has served as an Assistant U.S. Attorney for the Southern District of Alabama\, primarily prosecuting Health Care Fraud pursuant to the False Claims Act\, Stark Law\, Anti-Kickback Statute\, and the Controlled Substance Act.  Since 2013\, she has held the position of Civil Health Care Fraud Coordinator\, has held the position of Electronic Discovery Coordinator for 6 years\, and was recently appointed as the Religious Liberty Litigation Coordinator in response to the Attorney General’s October 6\, 2017\, Memorandum.  AUSA Colson has also served in the Appellate Division conducting En Banc oral argument before the Eleventh Circuit\, and has supervised the Southern District of Alabama’s Financial Litigation Unit\, which is responsible for enforcing the collection of criminal and civil debts owed to the United States or to victims of federal crimes pursuant to the Mandatory Victim Restitution Act. \nMs. Colson is a 1997 Magna Cum Laude graduate of Louisiana State University\, with a dual degree in History and Political Science.  Thereafter\, she received her Juris Doctorate degree from George Mason University School of Law located in Arlington\, Virginia.  After graduation\, she returned to the Mississippi Gulf Coast\, and served as a federal law clerk from 1993-1995\, to the Honorable David C. Bramlette\, III\, U.S. District Court\, Southern District of Mississippi\, Southern Division.   Before joining the U.S. Attorney’s Office\, Ms. Colson served as a trial attorney with an emphasis on insurance defense and medical malpractice for ten years with two private firms — Bryan\, Nelson\, et al.\, Pascagoula\, MS and Brown\, Buchanan & Sessoms\, Biloxi\, MS. \nSince 2008\, AUSA Colson has investigated and prosecuted various types of affirmative health care fraud cases and qui tam complaints involving skilled nursing facilities\, hospice and home health agencies\, compounding pharmacy cases\, pill mill schemes\, diversion\, illegal prescribing of controlled substances\, and fraudulent billing of medically unnecessary or un-provided medical services\, which resulted in convictions\, civil judgments\, and multi-million dollar settlements.  AUSA Colson actively works with the Southern District of Alabama’s Criminal Division parallel prosecutions\, and as HCF Coordinator spearheads Alabama’s Annual Health Care Fraud Working Group Meetings\, which are strategic and information sharing endeavors between federal\, state and local litigators and law enforcement. \nMegan Jeschke\, Partner at Holland & Knight \nMegan Jeschke is a partner at Holland & Knight and a member of the firm’s White Collar Defense and Investigations\, Compliance Services\, and Government Contracts teams. She is a litigator with an emphasis on civil and criminal enforcement matters in the government contracts\, healthcare\, and pharmaceutical industries. She represents companies facing criminal\, civil\, or administrative actions brought by the U.S. Department of Justice (DOJ) or agency Offices of Inspectors General (OIG)\, to include qui tam actions brought by relators under the civil False Claims Act (FCA)\, in the areas of procurement fraud\, healthcare fraud\, public corruption and procurement integrity\, and whistleblower reprisal. She has argued successfully before the Court of Appeals for the Ninth Circuit\, brought to verdict several criminal jury trials\, negotiated favorable settlements\, helped clients avoid suspension or debarment\, successfully argued for dismissal and declination\, and regularly conducts internal investigations\, large and small. She helps clients navigate suspension\, debarment and exclusion proceedings\, as well as provides advice on self-reporting protocols and mandatory disclosure rules. She also conducts compliance program effectiveness reviews and advises on compliance program protocols.  Ms. Jeschke holds an active security clearance and is experienced in conducting classified internal investigations and handling criminal cases involving the Classified Information Procedures Act (CIPA). Ms. Jeschke is a frequent lecturer on the FCA and on best practices in internal investigations.
