Now\, amid another national crisis\, the venerable statute will again be deployed in the fight against COVID-19 fraud. Originally aimed at profiteers who sold worthless goods to the Union Army\, the FCA has long been a tool against fraudulent claims on federal taxpayer money. With $2 trillion starting to flow into the U.S. economy under the CARES Act\, much of it based solely on the self-representation of recipients\, the U.S. Department of Justice will rely on the FCA to pursue an inevitable wave of stimulus fraud. This two-part webinar will sketch the new FCA landscape for attorneys on all sides of the issue\, from whistleblower lawyers and AUSAs to defense attorneys and in-house counsel. The first session will focus on healthcare fraud in a new and changing environment of CMS rule revisions and regulatory waivers\, Stark Act waivers\, hard-to-police treatments including telemedicine\, and unethical practices such as fraudulent COVID-19 testing and treatments\, kickbacks\, identity theft\, stockpiling and price gouging. The second session will examine grant fraud\, the SBA Paycheck Protection Program (PPP)\, and procurement fraud—and also will focus on the DOJ’s COVID-19 fraud and enforcement structures in light of this pandemic. DESCRIPTION:Times of peril have required adaptation and flexibility in administering constitutional protections and guarantees\, especially with the onset of social-distancing and remote adjudication.  Even the Supreme Court is adjusting its time-honored traditions to conduct telephonic hearings\, and federal courts around the country are carrying on business as usual\, or attempting to maintain the status quo as much as possible\, despite unparalleled technological\, logistical\, and security-based challenges.  Nowhere across the country have we seen a more malleable federal district court than the United States District Court for the District of Puerto Rico.  Already faced with systemic challenges brought on by natural disasters throughout the past three years\, including Hurricane Maria\, several earthquakes\, and numerous changes to its executive\, the district has responded to persist in complying with its Article III obligations in times of crisis.  Chief Judge Gustavo Gelpi will share his insights on effective adjudication (both in substance as well as administration)\, interesting stories\, and responses to any questions from the audience about how our federal judges handle crises.  Join us for a look into what’s going in inside the federal judiciary during this critical period. \n\nAbout the Presenters\n \nChief Judge Gustavo Gelpi\, United States District Court for the District of Puerto Rico \nChief Judge Gelpi was born in San Juan\, Puerto Rico.  He is a graduate of Brandeis University and Suffolk University Law School.  He commenced his career as law clerk to US District Judge Juan M. Perez-Giménez. This was followed by several years as an assistant federal defender\, doing both trial and appellate work\, plus a detail at the US Sentencing Commission.  He then switched tracks by joining the Puerto Rico Department of Justice and ultimately being appointed Puerto Rico’s Solicitor General\, his favorite job as an attorney. After a brief stint in private corporate practice\, he was appointed US Magistrate Judge\, position he held for five years.  In 2006 President Bush\, following Senate confirmation appointed him as an Article III US District Judge.  In 2018\, he became Chief Judge for the District of Puerto Rico. Judge Gelpi has been a FBA member for 30 years.  He is past Puerto Rico Chapter President\, and past FBA national president. SUMMARY:Webinar: USERRA: What Matters in Protecting our Service Members' Employment Rights
DESCRIPTION:The presentation provides an overview of USERRA\, which encourages service in the uniformed services by eliminating or minimizing the disadvantages to civilian careers and employment which can result from such service; seeks to minimize disruption to the lives of persons performing such service\, as well as to their employers\, their fellow employees\, and their communities\, by providing for the prompt reemployment of such persons upon their completion of such service; and prohibits discrimination against persons because of their service in the uniformed service. USERRA also prohibits retaliation against both persons seeking protections under the Act\, and any other persons assisting such persons seeking protections\, even if they lack status in the uniformed services. \nThe presentation is designed to provide familiarization and help develop an understanding of USERRA for decision-makers considering USERRA-related questions\, and for professionals providing USERRA advice and counsel to employers. The presentation may also be helpful for attorneys providing advice and counsel to veterans and uniformed service members as employees. The presentation will also describe the process for the filing of a USERRA complaint\, VETS’ role in the investigation of such complaints\, and the potential referral of such complaints to the Department of Justice or the Office of Special Counsel. \nVeterans are integral to shaping the modern workforce. Since September 11\, 2001\, more than 1M National Guard and Reserve uniformed service members have mobilized in support of the Global War on Terror\, and more than 964\,000 have returned\, with nearly 38\,000 remaining on active duty. In July 2019\, the veteran unemployment rate was 3.4 percent\, which is lower than the seasonally adjusted non-veteran unemployment rate of 3.6 percent. Utilizing the seasonally adjusted unemployment rate\, this is the 11th consecutive month where the veteran unemployment rate was lower than the non-veteran unemployment rate. There are more veterans in the workforce now than there have been in years. \nHiring and retaining veterans makes good business sense. They have strong personal integrity; they triumph over adversity\, work independently\, and have strong leadership qualities. They appreciate the value of teamwork\, and will refer other veterans\, which is critically important to shaping the modern workforce. Hiring and retaining veterans provide employers the opportunity to bring in like-minded veterans while reducing the time it takes to fill positions. According to SHRM’s 2017 Talent Acquisition survey\, survey tools used to source candidates ranks employee referrals at 90%\, and\, according to the 2016 SHRM survey\, it takes an average of 42 days to fill a position at the average cost-per-hire of $4\,129.00. Moreover\, according to a January 2017 article in The Huffington Post entitled\, “How Much Does Employee Turnover Really Cost\,” “the cost of losing an employee can range from tens of thousands of dollars to 1.5-2x the employee’s annual salary.” \nCompliance with USERRA makes good business sense as well. Since September 11\, 2001\, there has been an increase in USERRA complaints filed\, averaging more than 1\,200 complaints annually\, as wells as a tremendous increase in USERRA inquiries. Herrick is the Managing Partner of the San Diego\, Calif.\, Office of Tully Rinckey PLLC Partner and the primary Consult Attorney for matters relating to federal sector labor and employment law throughout the country. With almost 40 years of experience in all facets of litigation\, Steve provides counsel to clients across a broad spectrum of employment-related matters. He practices before federal and state courts\, the Merit Systems Protection Board (MSPB) and the Equal Employment Opportunity Commission (EEOC)\, as well as representing clients in arbitration\, mediation and agency proceedings. He also represents client in private employment law matters in California and the District of Columbia\, having previously done so in New York as well. Steve’s commitment to representing service members\, veterans and the federal workforce came following his son’s deployment to Iraq. Steve joined Tully Rinckey PLLC in March 2006\, first managing the firm’s corporate\, commercial and municipal litigation practice. He then moved to Washington\, D.C. where he opened the firm’s office in 2008 and transitioned into the area of employment law. In 2014\, he passed the California Bar\, moved to San Diego and opened the firm’s office there.
