She blends this wealth of experience with her remarkable dispute resolution skills\, crafted through years of additional specialized training and advanced education. \nJo is a Florida Supreme Court qualified arbitrator\, certified circuit civil and county mediator\, Member of the Chartered Institute of Arbitrators\, and a public arbitrator for FINRA. She also leads panels on topics such as ADR\, employment law\, and maritime-related themes. \nAva J Borrasso\, Ava J Borrasso\, P.A.  \nAva Borrasso FCIArb has served as arbitrator and counsel in numerous arbitrations. She sits as sole\, panel and emergency arbitrator in international and domestic arbitrations in disputes involving international distribution and trade agreements\, financial services\, business torts\, construction and sport. She is a panel member of the ICDR and the AAA complex and commercial panels\, and registered with the ICC. \nWith over 30 years of experience\, she has acted as lead counsel in complex commercial disputes before the ICDR\, AAA\, and ICC\, as well as before state and federal courts. She is admitted to practice in Florida (1994) and Illinois (1990 inactive). \nShe is a Fellow of the Chartered Institute of Arbitrators and member of the Executive Committee and Board of Directors of its North America Branch. She also sits on the Editorial Board of the ABA’s Dispute Resolution Magazine. \nHer work has been recognized by Who’s Who Legal (arbitration)\, Legal500 Latin America (international arbitration)\, Best Lawyers in America (international arbitration – commercial and commercial litigation)\, Best Law Firms (commercial litigation)\, and Legal Elite and Super Lawyers (international). \nHon. Suzanne H. Segal (Ret.)\, Signature Resolution \nAfter 18 years as a United States Magistrate Judge with the Central District of California\, including four years as the Chief Magistrate Judge\, Hon. Suzanne H. Segal (Ret.) joins Signature Resolution as a mediator\, arbitrator and Special Master/Discovery Referee. During her tenure on the federal bench\, Judge Segal presided over numerous trials\, evidentiary hearings\, motions and discovery conferences involving diverse subject matter. Judge Segal served as the settlement judge in hundreds of cases\, settling business and insurance disputes\, patent\, trademark and copyright actions\, and employment\, civil rights\, and tort cases. Judge Segal handled a wide range of motions and settlements arising out of class actions\, particularly in the wage and hour context. Judge Segal has broad experience in securities litigation\, including matters brought by private investors and the SEC. In addition\, Judge Segal has extensive experience in matters involving the False Claims\nAct and related actions involving the healthcare industry. Judge Segal has served as a Special Master or Discovery Referee in cases involving the False Claims Act\, mass tort and insurance claims\, patent litigation\, and product liability claims. Before her appointment to the bench\, Judge Segal served as an Assistant United States Attorney in the Civil Division of the Los Angeles U.S. Attorney’s Office for 12 years. As an AUSA\, Judge Segal handled a variety of cases\, including contract\, employment\, civil rights\, Medicare reimbursement and tort claims. She also brought consumer and civil rights actions on behalf of the Department of Justice. From 1999 to 2002\, she served as the Chief of Civil Appeals for the U.S. Attorney’s Office. Anh has been an active member of the FBA since the start of her legal career in 2001. Her involvement with the FBA began with the Minnesota Chapter\, where she was a member of the Executive Committee and served in a number of leadership roles before serving as the Circuit Vice President for the Eighth Circuit. \nAnh served as the Eighth Circuit CVP for two terms and received the Outstanding Service Award in 2011 for her work. She served on the FBA Board of Directors from 2013 to 2016 and was appointed by then-President Judge Newman in January 2017 to fill a vacancy on the Board from January through September 2017. Anh served on the Sections and Divisions Council. She is also a past chair of the Professional Ethics Committee\, where she assisted with the development of a Standards of Professional Ethics and Conduct Policy\, which was adopted by the Board and sets the standards of conduct expected of our leadership. The panel will explore topics\, including how judges decide cases\, what personal experiences influence their rulings\, and how they approach and educate themselves regarding implicit bias\, as well as reforms aimed to promote impartiality and accountability in the judicial branch. \nThis CLE is free for all interested participants\, but is only pre approved for CLE credit in Louisiana. \n\nAbout the Presenters\nJudge Guidry is a two-time LSU graduate\, as well as a graduate of the National Judicial College\, who has an unparalleled perspective on the judicial process and judicial decision-making after seeing it from every from virtually every vantagepoint. Board of Education and Why It Matters to Your Practice Today \n\nMichael Rafferty – Harris Shelton\n\nIn its opinion in Brown v. Board of Education\, the Supreme Court chose to omit a discussion\nof the facts of the case and focus instead on the effects of racial segregation in public\nschools. In so doing\, the Court missed an opportunity to thoroughly describe the poor\nconditions of the “colored” schools and paint the full picture of how omnipresent segregation\nwas not only in public schools\, but also in society in general. In this session\, we will revisit the\nunderlying facts of the consolidated cases and contemporaneous accounts of other aspects of\ndaily life in the state-mandated segregated South at that time and examine how today’s\npractitioners can help put the finishing touches on the end of the Jim Crow era by considering\nwhether the segregationist mentality might still exist and be hidden in current laws. SUMMARY:Webinar: Conflict of Interest Restrictions After Government Employment
DESCRIPTION:Many federal government employees who retire\, establish a consulting practice\, or take up employment in the private sector\, using their skills and experience to support the business needs of their clients and employers. There are restrictions\, however\, on the ability of these former government professionals to approach the U.S. government\, particularly their former agencies\, on behalf of clients or employers. There are additional restrictions\, where the principal is a foreign entity. The key federal statute and regulations governing these restrictions are 18 U.S.C. § 207 (Restrictions on former officers\, employees\, and elected officials of the executive and legislative branches) and 5 C.F.R. § 2641 (Post-employment conflict of interest restrictions). \nThis presentation will examine the general provisions of the statute and regulations\, discuss the prohibitions they stipulate\, and the applicable exceptions and waivers. The presentation will offer a special focus on the restrictions relating to foreign entities\, and the relationship of these restrictions to the Foreign Agents Registration Act of 1938 (FARA). The presentation will also offer an overview of key federal agency components and other resources relevant to the compliance with\, and enforcement of the statute and its implementing regulations. \nPresented by the Senior Lawyers Division \n\nAbout the Presenters\n \nArmen Kharazian is the owner of a small law practice in the District of Columbia specializing in white-collar criminal defense (Foreign Corrupt Practices Act and anti-money laundering statutes)\, export control and sanctions\, Foreign Agents Registration Act (FARA) and Lobbying Disclosure Act\, 18 U.S.C. § 207 (Restrictions on former officers\, employees\, and elected officials of the executive and legislative branches)\, and corporate formation. Prior to establishing his law practice\, Armen served as a Law Fellow at the U.S. Department of Energy’s Office of the General Counsel\, where he worked on U.S. Atomic Energy Act-related nuclear contamination litigation\, and an Honors Law Clerk at the U.S. Environmental Protection Agency\, where he worked on regional enforcement programs related to the Comprehensive Environmental Response\, Compensation\, and Liability Act (CERCLA). SUMMARY:Webinar: A Call to Action: Stepping Up to Lead and Effectuate Change in a Time of Crisis
DESCRIPTION:This CLE presents a unique training opportunity led by Dr. Artika Tyner\, author of the award-winning book\, The Lawyer as Leader: How to Plant People and Grow Justice\, for newer and younger attorneys to support their efforts and participation in the FBA Younger Lawyer Division’s Annual StepUp Pro Bono Challenge. In FY2020\, then-YLD Chair Adine S. Momoh led a Call to Action following George Floyd’s tragic death and the civil unrest across Minnesota\, the country and world. The YLD issued a statement and provided resources to help younger attorneys respond. The YLD then initiated a national pro bono challenge\, the StepUp Pro Bono Challenge\, and encouraged younger attorneys to step up and perform pro bono specifically addressing issues of systemic racism\, socio-economic injustice\, and access to justice. The YLD Board has since adopted it as an annual program.  In the training\, Dr. Tyner will explore her book and discuss tangible ways lawyers can use their legal skills to advocate for change in marginalized communities. Participants will learn how they can use their skills\, position\, and authority to create equal access to justice. Tyner is a passionate educator\, author\, sought after speaker\, and advocate for justice. At the University of St. Thomas School of Law\, Dr. Tyner serves as the founding director of the Center on Race\, Leadership and Social Justice. She is committed to training students to serve as social engineers who create new inroads to justice and freedom. \nTyner received her B.A. from Hamline University (Major: English; Certificate: Conflict Studies). Due to her passion for advocating for social justice and educational policy reform\, she decided to pursue graduate studies at the University of St. Thomas. She began her journey with law school since she recognized that the law is a language of power and therefore she sought to become well versed in the law. \nSubsequently\, Tyner earned a Master of Public Policy and Leadership in order to gain tools for effecting social change through policy reform efforts. Later\, inspired by the legacy of W.E.B. Dubois\, she obtained a Doctorate in Leadership. Her doctoral studies provided her with key tools for serving in her community and promoting social justice. \nDr. Tyner is committed to empowering others to lead within their respective spheres of influence. She provides leadership development and career coaching for young professionals. She has also developed leadership educational materials for K-12 students\, college/graduate students\, faith communities and nonprofits. Additionally\, Dr. Tyner teaches leadership coursework on ethics\, critical reflection\, and organizational development. Her research focuses on diversity/inclusion\, community development\, and civil rights. DESCRIPTION:**Program hosted in (ET) time zone** \nHosted by the FBA’s Qui Tam Section\, often in cooperation with local FBA chapters\, “The False Claims Act Today” is a discussion series that examines the details of real-life FCA practice in specific jurisdictions. Sessions typically focus on a single federal district and feature an experienced local panel that includes an Assistant U.S. Attorney for the district; a federal judge; a relator-side attorney; and a defense attorney. \nWe hope to resume in-person sessions of “The FCA Today” in 2022\, but for now we are conducting them online via the Zoom platform. For this session on the Western District of North Carolina\, attendees can expect a brief overview of the FCA process. \nThis webinar does not carry CLE credit. Scott Oswald – Chair\, FBA Qui Tam Section (moderator) \nScott Oswald is an accomplished trial lawyer who has brought more than 40 trials to verdict. His cases have recovered more than $300 million in judgments and settlements. A fellow of the prestigious College of Labor and Employment Lawyers\, he received his law degree from Howard University and honed his skills at Trial Lawyers College\, founded by the legendary Gerry Spence. Mr. Oswald litigates employment and whistleblower actions nationwide. Among his results: \n\nFirst jury verdict under new whistleblower protections in the National Defense Authorization Act of 2013|\nFirst Sarbanes-Oxley Act liability verdict to withstand appeal\nFirst jury verdict under 2009 anti-retaliation provisions of False Claims Act\nFirst Dodd-Frank Act retaliation lawsuit to reach discovery in federal court\n\nMr. Oswald is chair of the Federal Bar Association’s Qui Tam Section and immediate past chair of the FBA’s Professional Ethics Committee. Lawdragon ranks him as one of the top 500 plaintiff-side employment lawyers in the country. \nKatherine Armstrong\, Affirmative Civil Enforcement Coordinator\, U.S. Attorney’s Office for the Western District of North Carolina  \nKatherine Armstrong joined the United States Attorney’s Office for the Western District of North Carolina in July of 2016 as an Assistant United States Attorney (AUSA) in the office’s Civil Division. Ms. Armstrong was appointed as Affirmative Civil Enforcement (ACE) Coordinator in January of 2020 and is primarily responsible for handling ACE litigation and civil fraud investigations under the False Claims Act\, 31 U.S.C. §§ 3729-3733\, civil enforcement investigations and actions under the Controlled Substances Act\, 21 § U.S.C. 801 et seq. Additionally\, Ms. Armstrong deals with enforcement of other federal statutes that provide for the recovery of monetary damages by\, or injunctive relief on behalf of the United States. \nMs. Armstrong also serves as the Civil Rights Coordinator and has experience in the enforcement of federal statutes prohibiting discrimination in the provision of housing\, and based on disability\, among others.  Before joining the federal government\, Ms. Armstrong practiced at a Charlotte law firm specializing in civil litigation\, primarily in the areas of commercial and business litigation and insurance defense. During her time tenure there\, she represented clients in the courts of Mecklenburg and surrounding counties\, and the federal district courts of North Carolina.  Ms. Armstrong obtained her J.D. from the University of Kentucky College of Law and her undergraduate degree from the University of North Carolina at Chapel Hill. \nMark T. Calloway\, Partner\, Alston & Bird LLP \nMark T. Calloway is a partner with Alston & Bird LLP.  He concentrates his practice in the areas of white-collar criminal defense with an emphasis on health care matters\, internal corporate investigations\, and the defense of False Claims Act matters around the country. Mr. Calloway served for seven years as the United States Attorney for the Western District of North Carolina (February 1994 to March 2001). During his tenure with the Department of Justice\, Mr. Calloway also served as Director of the Executive Office for United States Attorneys in Washington\, D.C.\, and as Chair of the Attorney General’s Advisory Committee of United States Attorneys and was a member of the Attorney General’s White Collar Crime Council. \nAs Director of the Executive Office of the United States Attorneys in Washington\, D.C.\, Mr. Calloway had responsibility for support and oversight of all 94 United States Attorney’s Offices and a key role in management and policy implementation for the Department of Justice.  In January 2001\, Attorney General Reno awarded Mr. Calloway the Edmund J. Randolph Award for outstanding service to the Department of Justice. \nHon. Robert J. Conrad Jr.\, U.S. District Judge\, Western District of North Carolina  \nRobert (“Bob”) J. Conrad\, Jr. serves as a District Judge for the Western District of North Carolina. Judge Conrad was confirmed in 2005 and he was Chief Judge from 2006-2013. He served as the Fourth Circuit’s district court representative on the United States Judicial Conference from 2014-2020. Judge Conrad was appointed by Chief Justice John Roberts to the seven-judge Executive Committee of the Judicial Conference.  He chaired the Conference of District Judge Representatives in 2019-2020. In addition to his full caseload and governance role\, he has supervised the construction of a $165 million courthouse. \nJames F. Wyatt III\, Partner\, Wyatt & Blake\, L.L.P. \nJames F. Wyatt\, III is recognized as one of North Carolina’s leading trial lawyers. He is a member of the International Academy of Trial Lawyers\, the American College of Trial Lawyers\, and the Best Lawyers in America\, has a Band 1 Ranking with Chambers and Partners\, and has been named on numerous occasions as the best white-collar defense and civil trial lawyer in both Charlotte and the State of North Carolina. Mr. Wyatt was recently (2020 & 2021) selected by Super Lawyers as the Number One Lawyer in North Carolina\, regardless of specialty or field. \nIn addition to his representation of individuals and businesses in white-collar and criminal defense matters\, Mr. Wyatt has represented numerous parties in qui tam lawsuits over the past 20 years.
