Through her advocacy\, Aisha aims to dismantle social injustices affecting marginalized communities\, with a particular focus on the intersection of people with disabilities and their disproportionate interactions with law enforcement. At DRC\, Aisha has worked on a range of litigation relating to housing\, houselessness\, and higher education. \nMost recently\, Aisha was an adjunct clinical lecturer with the Veterans Justice Clinic at UCLA’s School of Law for the 2022-2023 school year. Aisha supervised law students as they engaged in written and oral advocacy on behalf of housing insecure veterans\, and organized a site visit for Soledad Garcia Munoz\, the Special Rapporteur on Economic\, Social\, Cultural and Environmental Rights at the Inter-American Commission for Human Rights\, to assess the houselessness crisis in Los Angeles. \nPrior to joining Disability Rights California\, Aisha was a staff attorney at Manhattan Legal Services\, where she represented tenants and tenant associations in issues relating to violations of the Fair Housing and Rehabilitation Acts\, warranty of habitability and rent stabilization laws. \nIn October 2020\, Aisha was appointed to the San Bernardino Superior Court’s Elimination of Bias Committee\, where she continues to work closely with judicial officers\, court personnel\, and attorneys from the public and private sectors to eliminate bias in the justice system and ensure court processes are accessible and equitable to all. \nAisha received her B.A. from California State University\, Fullerton\, and her J.D. from New York Law School. She is licensed to practice in California and New York. \nEric Foley\, Staff Attorney in the New Orleans Office of the Roderick & Solange MacArthur Justice Center \nEric Foley is an attorney at the Roderick & Solange MacArthur Justice Center\, where his docket includes challenges to bail systems\, police misconduct\, and violations of protesters’ rights across Louisiana. Prior to joining the MacArthur Justice Center in 2015\, Foley worked for S.E. Louisiana Legal Services in their housing and homeless advocacy divisions and was a judicial clerk in the U.S. District Court for the District of Puerto Rico. \n  \nKyle Kaiser\, Senior Trial Counsel\, Litigation Division\, Utah Attorney General’s Office \nKyle Kaiser is an Assistant Attorney General and Senior Trial Counsel in the Litigation Division of the Utah Attorney General’s Office. He has been with the office since July 2011. Kyle’s practice focuses on defending claims of constitutional or civil rights violations brought against the State of Utah\, its agents\, agencies\, and subdivisions\, and Utah colleges and school districts. Kyle is also appointed as a judge pro tempore for the Salt Lake City Justice Court\, presiding over civil small claims matters. Before working for the Utah AG’s Office\, Kyle was employed as Staff Attorney for Justice Dale Wainwright of the Supreme Court of Texas\, where he not only assisted Justice Wainwright in researching and preparing opinions and analyzing petitions for review\, but was in charge of the Court’s annual hot pepper eating competition. Before that\, Kyle was a litigation and intellectual property associate with the law firm of Winthrop & Weinstine\, P.A. in Minneapolis\, Minnesota\, and served as a law clerk for Richard Dorr\, United States District Judge for the Western District of Missouri\, in Springfield. \nKyle received his J.D.\, with high distinction\, from the University of Iowa College of Law in 2003\, where he was Senior Managing Editor of the Iowa Law Review\, was awarded the Hancher-Finkbine Medallion\, and was inducted into Order of the Coif. M. Margaret McKeown\n \nJudge Margaret McKeown has served almost twenty-five years as a judge on the U.S. Court of Appeals for the Ninth Circuit. She is a member of the American Academy of Arts and Sciences\, an affiliated scholar at the Center for the American West at Stanford University\, and jurist-in-residence at the University of San Diego School of Law. As a former White House Fellow\, she served as special assistant at the White House and as special assistant to the Secretary of the Interior. A Wyoming native\, she serves on the board of Teton Science Schools and was a member of the first American expedition to Mt. Shishapangma in Tibet. \nJudge McKeown recently published Citizen Justice: The Environmental Legacy of William O. Douglas—Public Advocate a Conservation Champion (Potomac Press\, 2022). \nJudge McKeown graduated from Georgetown University Law Center and holds an honorary doctorate from Georgetown University. Before her appointment\, she was the first woman partner at Perkins Coie in Seattle and Washington\, D.C. \nJudge McKeown is a member of the US Judicial Conference Committee on Judicial Conduct and Disability. She chairs the Ninth Circuit Workplace Environment Committee and is a member of the National Workplace Conduct Working Group. She is on the Council of the American Law Institute\, the Judicial Advisory Board of the American Society of International Law\, and the editorial board of Litigation magazine. She served as Chair of the ABA Commission on the 19th Amendment\, past President of the Federal Judges Association\, and former chair of the US Judicial Conference Codes of Conduct Committee (ethics). \nJudge McKeown is on the board of the World Justice Project and is Vice Chair of the ABA Rule of Law Initiative and a current special advisor. She has lectured throughout the world on international law\, intellectual property\, human rights\, ethics\, and constitutional law and has participated in numerous rule of law initiatives with judges and lawyers. \nJudge McKeown received the ABA Margaret Brent Women Lawyers of Achievement award\, the ABA John Marshall Award\, the Inns of Court Ninth Circuit Professionalism Award\, the Washington Women Lawyers President’s Award\, and the Girl Scouts Cool Woman Award\, among others. \nModerator\n \n\nHon. Gustavo A. Gelpi\n \nJudge Gelpí was appointed to the United States Court of Appeals for the First Circuit in October 2021. He received his undergraduate degree from Brandeis University in 1987 and his law degree from Suffolk University Law School in 1991. From 1991 to 1993\, Judge Gelpí served as law clerk to Judge Juan M. Pérez-Giménez. From 1993 to 1996\, he served as an Assistant Federal Public Defender. From 1997 to 2000\, Judge Gelpí worked as an Assistant Attorney General\, served as Solicitor General of Puerto Rico\, and worked in private practice. Judge Gelpí was appointed as a Magistrate Judge in the District of Puerto Rico in 2001. In 2006\, President George W. Bush appointed him to the United States District Court for the District of Puerto Rico\, where he served as Chief Judge from 2018 to 2021. Judge Gelpi has been a FBA member for over 30 years. SUMMARY:Section on Taxation: New Guidance - Temporary Relief from Recent Regulations on Foreign Tax Creditability
DESCRIPTION:This panel will discuss IRS Notice 2023-55 and its impact on U.S. multinational entities. IRS Notice 2023-55 provides temporary relief for taxpayers determining whether a foreign tax is eligible for a foreign tax credit under sections 901 and 903. Section 901 allows a credit for foreign income\, war profits\, and excess profits taxes; section 903 allows a credit for taxes paid in lieu of a generally imposed foreign income\, war profits\, or excess profits tax. 2022 regulations revised the rules for determining whether a foreign levy is a creditable foreign income tax under sections 901 and 903. The temporary relief offered through IRS Notice 2023-55 allows taxpayers to apply certain portions to of the prior regulations under section 901 rather than the 2022 regulations\, and also turns off portions of the new regulations under section 903. DESCRIPTION:Although the United States government recovers billions of dollars per year under the federal False Claims Act (FCA)\, the vast majority of that recovery is the result of voluntary settlements\, and very few FCA cases proceed to trial\, let alone verdict. Panelist will discuss their experiences preparing for and trying these cases and provide tips to other FCA attorneys on how to prepare for an FCA trial\, including tips for conducting effective discovery\, recurring issues subject to motions practice\, and preparing effective arguments for a judge and jury. \n  \nPresented by the Health Law Section \n\nPresenters\nBrittany Cambre \nBrittany represents individuals and companies in complex civil litigation\, internal investigations\, and white collar criminal defense. She has represented clients in various complex business litigation matters involving antitrust\, RICO\, and the False Claims Act. She also counsels clients in a wide array of issues including commercial business disputes and business torts. \nBefore joining Chilivis\, Cochran\, Larkins & Bever\, Brittany was an associate with Eversheds Sutherland (US)’s Litigation Practice Group\, focusing her practice on complex business litigation\, government investigations\, and class action defense. \nBrittany graduated in 2013 from the University of Georgia School of law\, she served as the Editor in Chief of the Georgia Journal of International and Comparative Law\, as an Intern for Superior Court judges of Barrow and Jackson counties\, and as a member of the Appellate Litigation Clinic. \nScott Grubman \nScott is a former Assistant United States Attorney (AUSA) and Department of Justice Trial Attorney who represents businesses and individuals across a wide variety of industries in connection with government and internal investigations\, False Claims Act litigation\, and white collar criminal defense. \nAlthough Scott represents clients across industries\, a substantial portion of his practice involves representing healthcare providers of all types and sizes in connection with high-stakes government investigations – both criminal and civil – by agencies such as the U.S. Department of Justice\, HHS-OIG\, the FBI\, and state Medicaid Fraud Control Units.  Scott also has extensive experience representing healthcare providers in connection with administrative proceedings\, payor audits\, and general healthcare regulatory matters\, particularly those related to the False Claims Act (including qui tam whistleblower actions)\, Stark Law\, and Anti-Kickback Statute.  He has represented healthcare clients ranging from multi-hospital health systems to individual physicians\, ancillary providers\, and every type and size in between.  He served as lead trial counsel in Georgia’s first-ever False Claims Act trial\, which resulted in a favorable settlement after 4 days of testimony. \nIn addition to his healthcare clients\, Scott also regularly represents clients who are being investigated for\, or who have been charged with\, white collar crimes\, including fraud\, embezzlement\, theft\, and public corruption.  He has first-chaired numerous criminal and civil jury trials in both federal and state courts\, and has handled criminal and civil appeals.  Scott is skilled and experienced in handling high-profile investigations as his matters have garnered substantial attention by the international\, national\, and local news media. Brandao\nSam Brandao is a Clinical Assistant Professor of Law with experience enforcing civil rights including fair housing\, rights protected by the Fourth Amendment\, and disability rights. He joined the Tulane Civil Rights and Federal Practice Clinic in 2016 after completing a two-year Skadden Fellowship\, during which he served as a staff attorney at Southeast Louisiana Legal Services in New Orleans. At SLLS\, he litigated housing discrimination cases and advocated for policy changes on behalf of people with disabilities. Brandao clerked for United States District Judge Eldon E. Fallon of the Eastern District of Louisiana and for Circuit Judge Jacques L. Wiener\, Jr. of the United States Court of Appeals for the Fifth Circuit. Jen has extensive experience in the medical devices\, pharmaceutical\, electronic components and automotive industries\, with a particular knowledge of industries in Japan. She is a member of the firm’s Business Litigation Group. \nAn experienced commercial litigator\, Jen defends corporations and individuals against alleged antitrust and anti-corruption claims\, both civil and criminal. Her recent cases\, which include cartel matters\, safety audits and agency inquiries\, reflect her skills with government investigations and compliance issues. Jen has represented clients in international cartel investigations and merger investigations. With the experience that more than 20 years of practice\, 40 federal trials\, and 10 years of federal prosecutorial service brings\, many of Ferdose’s most successful client engagements have not led to public charges and therefore remain confidential. \n\nFerdose is business-minded. She brings a federal prosecutor’s perspective to our clients’ challenges to provide effective defense and compliance counseling designed to mitigate risk through practical application of fiscally efficient strategies. He is heavily involved with the Federal Bar Association (FBA) as the Student Representative of the Sixth Circuit on the Board of the Law Student Division and student Liaison to the Judiciary Division of the FBA. Brendan also works closely with the Northern District of Ohio FBA Chapter through his position as President of the Akron Law School FBA Chapter. In his time as a Board Member of the Law Student Division\, Brendan has focused on efforts to increase law student inclusion for national FBA events and conventions\, expand events and information for students on the Judicial Clerkship process\, and increase law student membership\, engagement\, and collaboration within the FBA. Feel free to reach out to Brendan\, as he is always interested in working with others\, and loves to discuss issues surrounding law\, politics\, and Ohio sports. \nHonorable Beth Bloom\nBeth Bloom has served as a United States District Judge in the Southern District of Florida since 2014. She was appointed by President Barack Obama and unanimously confirmed by the United States Senate on June 24\, 2014 (her birthday). Judge Bloom currently serves as Vice-Chair of the Judiciary Division Board of the Federal Bar Association\, previously serving as Chairperson of the Article III Trial Judges Committee. She was elected and serves as the Eleventh Circuit Representative to the Board of Directors of the Federal Judges Association and is a Board Member of the South Florida Chapter of the Federal Bar Association. She Chairs the Southern District of Florida’s Local Rules Committee and is an active member of the Southern District’s Ad Hoc Committee on Rules and Procedure. Judge Bloom is a frequent lecturer for the Florida Bar\, local bar associations\, law schools\, and FBA chapters. She has presented at the 2018 New Judges College and the 2017 District Judges Conference. She served on the faculty of the Florida Judicial College for 19 years\, teaching newly elected and appointed judges; the faculty of the National Judicial College\, the College of Advanced Judicial Studies\, the Florida Conference of County Court Judges\, and is an adjunct faculty member of the Litigation Skills Program at the University of Miami School of Law. In 2015\, Judge Bloom established the Southern District of Florida’s Summer Intern Ethics and Orientation Program and oversees its annual Law Day and Constitution Day Programs. Judge Bloom oversees the SDFL’s Judicial Intern Program and\, since the pandemic\, has partnered with other districts throughout the country to provide remote learning opportunities for law students. She created the Judicial Intern Academy in 2021 to expand federal judicial internships to students and pairs former federal judicial law clerks with summer interns to enhance the students’ research and writing skills\, now a national program through the Federal Bar Association. Judge Bloom received her Bachelor of Science degree in public relations from the University of Florida in 1984 and her Juris Doctor degree (cum laude) from the University of Miami School of Law. She practiced commercial litigation with the law firm of Floyd Pearson Richman Greer Weil Zack & Brumbaugh from 1988-1994 and served as a Traffic Court Magistrate from 1993-1994 before her election to the state court bench. \n \nHonorable Iain Johnston \nIain D. Johnston is a District Judge for the Northern District of Illinois\, Western Division.  He handles dispositive matters for civil and all felony criminal matters in the Division.  From 2013 through 2020\, he was the U.S. Magistrate Judge for the same court\, where he handled all pretrial matters for all civil and all criminal cases.  He graduated with honors from both The John Marshall Law School (1990) and Rockford College (1987).  Following law school\, he clerked for Judge Philip G. Additionally\, she will provide examples of racially motivated massacres of Black communities across eras from Rosewood\, FL\, Tulsa\, OK\, Wilmington\, NC\, Charleston\, SC\, and Buffalo\, NY\, in an interdisciplinary focus that includes historical\, legal\, racial\, and intersectional analysis. SUMMARY:Webinar: Bostock and The First Amendment: The Rights of LGBTQ+ Employees in the Religious Workplace
DESCRIPTION:In 2020\, the Supreme Court in Bostock v. Clayton County determined that discrimination against gay and transgender employees is discrimination on the basis of sex—leaving open the question whether\, and how\, this issue might be addressed in a case involving religious employers. In this session\, two civil-rights attorneys—both counsel for the plaintiff in Doe v. Catholic Relief Services\, a recent case in the District of Maryland—and counsel from Americans United for Separation of Church and State will provide an overview of the federal law protecting the rights of LGBTQ+ employees\, the defenses being raised by religious employers and the progress they are making in the courts\, and insight into the way some state courts are addressing these same issues. \nPresented by the Federal Bar Association’s LGBTQ+ Law Section and Civil Rights Law Section.   \n\nAbout the Presenters\n\nLauren DiMartino\, Associate\, Brown\, Goldstein & Levy LLP\nLauren A. DiMartino is an associate at Brown\, Goldstein & Levy\, LLP (“BGL”). Lauren represents clients across various areas of civil rights law\, including fair housing\, education and disability rights\, police misconduct\, and workplace discrimination. Much of Lauren’s legal experience has centered on education equity\, constitutional law\, anti-discrimination\, and government misconduct\, utilizing civil rights legislation like the Fair Housing Act and Title VII to assist individuals impacted by discriminatory conduct and to challenge systems perpetuating segregation. Prior to joining BGL\, Lauren was in Nashville clerking for Judge Martha Craig Daughtry on the Sixth Circuit Court of Appeals. She was previously the Legal Fellow at the University of Colorado School of Law’s Byron White Center for the Study of American Constitutional Law. Lauren graduated from the City University of New York School of Law\, a public-interest program\, with a concentration in Social Justice\, Equality\, and Civil Rights. She has been published in the Georgetown Journal on Poverty Law & Policy\, CUNY Law Review\, FBA Civil Rights Insider\, and Forbes Civic Nation. Prior to becoming an attorney\, Lauren worked in marketing before transitioning to work in New York City community colleges because of her commitment to racial and economic justice. She worked as an academic counselor and the Assistant Director of ASAP\, an accelerated education program aimed at removing systemic barriers to obtaining a degree. She was inspired by her students to attend law school as a tool to better advocate for marginalized communities. She remains active in higher education work and is on the Advisory Boards of the Urban Studies Program at Guttman Community College (CUNY) and of Baltimore Youth Arts. \n\nBradley Girard\, Litigation Counsel\, Americans United for Separation of Church and State\nBradley Girard is the Litigation Counsel for Americans United for Separation of Church and State (“AU”). Bradley returned to AU after serving as the Steven Gey Constitutional Litigation Fellow from 2015-17. He graduated cum laude from Georgetown Law in 2014. After law school he clerked for the Honorable Neal E. Kravitz on the D.C. Superior Court and on the United States Court of Appeals for the Sixth Circuit for the Honorable Martha Craig Daughtrey. Immediately before returning to AU\, Bradley was the clinical teaching fellow at Georgetown Law’s Appellate Courts Immersion Clinic\, where he taught students public-interest impact litigation in the federal courts of appeals and the U.S Supreme Court.
