SUMMARY:Alaska Chapter: Supreme Court Roundup
DESCRIPTION:Please join the Alaska Lawyers Chapter and the Federal Bar Association (Alaska Chapter) for its first annual Supreme Court Roundup to discuss the blockbuster cases—and other interesting cases—from the Supreme Court’s past term. We are pleased to be joined by Kannon Shanmugam\, widely recognized as one of the top Supreme Court litigators in the country\, having argued 36 cases before the Court. Among other interesting cases from last term\, Kannon will explore the Supreme Court’s affirmative action decision in Students for Fair Admissions v. Harvard\, the voting rights decision in Allen v. Milligan\, the student-loan forgiveness case in Biden v. Nebraska\, and the religious liberty case in 303 Creative v. Elenis. \n\nPresenter\nKannon Shanmugam\nPartner\, Paul\, Weiss\, Rifkind\, Wharton & Garrison LLP \nChair of the Supreme Court and Appellate Litigation Practice and managing partner of the Washington office\, Kannon Shanmugam is widely recognized as one of the nation’s top appellate lawyers. Kannon has argued 36 cases before the Supreme Court\, including 28 cases in private practice. He has also argued over 100 appeals in courts across the country\, including arguments in all thirteen federal courts of appeals and in numerous state courts. One study found that\, over a five-year period\, Kannon had the highest rate of successful petitions for review of any Supreme Court practitioner. He was lead counsel in the successful constitutional challenge to the structure of the Consumer Financial Protection Bureau\, described by the Wall Street Journal as the “constitutional case of the year.” This year alone\, he successfully overturned the certification of a $13 billion securities class action arising out of the 2008 financial crisis (ATRS v. Goldman Sachs); he successfully defended the settlement of what is believed to be the largest private antitrust settlement in history (Fikes Wholesale v. HSBC Bank USA); and he successfully overturned a $570 million damages award in a high-profile trade-secrets case (Syntel v. TriZetto). Prior to private practice\, Kannon served as an Assistant to the Solicitor General at the U.S. Department of Justice. He also served as a law clerk to Supreme Court Justice Antonin Scalia and to Judge J. SUMMARY:Webinar: Supreme Court’s Recent Trademark Cases
DESCRIPTION:The FBA’s Intellectual Property Law Section is hosting this CLE program regarding two of the Supreme Court’s Lanham Act decisions from the 2022 Term: \nThe U.S. Supreme Court’s Bad Spaniels Case\nOn June 8\, 2023\, the U.S. Supreme Court issued its long-awaited opinion in Jack Daniel’s Properties\, Inc. v. VIP Products LLC\, holding that parody trademarks do not receive special First Amendment protection when they function as trademarks.  This talk will review the decision and its possible implications for future parody trademarks\, as well as guidance gleaned from the concurring opinions regarding the use of brands in creative works and the use of surveys in litigation. \nAbitron Case Regarding Extraterritorial Application of the Lanham Act\nThis part of the program will discuss Abitron Austria GmbH v. Hetronic International\, Inc.\, issued June 29\, 2023\, in which the Supreme Court\, for the first time in seventy years\, has decided a case involving the extraterritorial application of the Lanham Act. In so doing\, it has resolved a circuit split on the applicability of the Lanham Act actions involving foreign conduct.  In Abitron\, the Court concluded that the Lanham Act applies only to domestic conduct and does not apply extraterritorially to purely foreign sales that never reached the United States or confused U.S. consumers. Abitron is an important case because of the Court’s restrained view on the extent to which a U.S. company may seek damages for exterritorial trademark infringement.  The talk will review the Court’s reasoning and speculate on the practical ramifications of the decision. \nPresented on behalf of the Intellectual Property Law Section.  \n\nAbout the Presenters\nModerator: Oliver A. Ruiz\, Chair of the FBA’s Intellectual Property Law Section\nOliver A. Ruiz is a Partner with Malloy & Malloy\, P.L.\, Florida’s Oldest IP Law Boutique. He is Board Certified by the Florida Bar in Intellectual Property Law and represents clients in intellectual property disputes and litigation matters\, as well as\, in transactional matters\, such as applications for trademark registrations. He regularly represents clients in IP litigation in federal courts and in U.S. Trademark Trial and Appeal Board proceedings. Erikson is a partner in the Boston office of the law firm Husch Blackwell LLP. Mr. Erikson advises Fortune 500 companies\, startups\, and individual authors on trademark\, copyright\, and right of publicity matters. He leverages his knowledge of the food and beverage business\, from manufacturing to distribution to retail sales and foodservice\, to help clients such as packaged food companies and others protect their brands and creative works. He also regularly advises clients on practical considerations in branding strategy and social media promotions and on the legalities surrounding sweepstakes and contests. Before joining the firm\, Daan researched copyright law and policy at the Fordham IP Institute\, where he interfaced with judges\, practitioners\, academics and government leaders from around the world\, including heads of agencies such as the U.S. Copyright Office\, European Commission\, U.S. Patent and Trademark Office (USPTO)\, U.S. Trade Representative and the World Intellectual Property Organization (WIPO). During law school\, Daan served as a judicial extern to the Honorable Richard Fruin of Los Angeles Superior Court and interned in HBO’s Santa Monica\, California\, office. \nProf. Marshall A. Leaffer\, Distinguished Scholar in Intellectual Property\nMarshall Leaffer is Professor of Law at Indiana University\, Maurer School of Law. At Indiana since 1997\, Leaffer teaches Copyright Law\, Trademark Law\, Intellectual Property Survey\, and International Intellectual Property. He is the author of three books and numerous articles\, including the best-selling treatise\, Understanding Copyright Law\, now in its 7th edition. Leaffer is also the author of Copyright Law: Cases and Materials\, 10th edition and International Treaties on Intellectual Property\, 2d edition. His current research focuses on the interplay of intellectual property law in a global marketplace. Before becoming a full-time teacher\, he practiced trademark law with American Home Products Corp. and the firm of Haseltine Lake & Waters in New York. Leaffer is a popular speaker in both the United States and Europe on all areas of intellectual property law and has been honored as both a scholar and lecturer. SUMMARY:Webinar: Remedies\, Court Access\, and Beyond: Life after Cummings
DESCRIPTION:This webinar will discuss the remedies options available for persons with disabilities post Cummings under a variety of different laws and how attorneys are navigating the post Cummings landscape. More specifically\, the webinar will zero in on Cummings v. Premier Rehab Keller\, Perez v. Sturgis Public Schools\, and Health and Hospital Corporation of Marion County v. Talevski. By the end of the session\, attendees will gain an understanding of three critical Supreme Court cases affecting persons with disabilities. They will also gain an understanding of the possible remedies persons with disabilities may utilize after facing disability discrimination in non-employment situations. \nPresented on behalf of the Civil Rights Law Section. \n\nPresenters\nWilliam D. Goren\, Esq.\, J.D.\, LL.M.\nWilliam D. Goren\, Esq.\, of William D. Goren\, J.D.\, LL.M. LLC in Decatur\, GA\, has been dealing with the ADA as an Attorney since 1990. His law and consulting practice\, https://www.understandingtheada.com/\, as well as his blog\, Understanding the ADA\, (a member of the ABA Top 100 for five consecutive years\, 2014-2018- there was no ABA 100 in 2019-2022)\, all focus on understanding the ADA so that the client understands what it means to comply with that law and related laws. In particular\, he provides consulting\, counseling\, representation\, and training services involving compliance with the Americans with Disabilities Act\, Rehabilitation Act of 1973\, and related laws- such as the Air Carrier Access Act and the Fair Housing Act\, among others. Mr. Goren also brings a deep\, personal understanding of what it means to have a disability\, equipping him with exceptional insight on how the ADA actually works. He is deaf with a congenital bilateral hearing loss of 70–90+ decibels\, but functions entirely in the hearing world thanks to hearing aids\, Bluetooth technology\, automatic speech recognition\, and lip-reading. For reasons independent of his deafness\, he also uses voice dictation technology to access his computer. He is also a frequent presenter\, a trained mediator\, a FINRA arbitrator (Chairperson eligible)\, and an arbitrator on the CPR employment panel. Finally\, he is the author of Understanding the ADA\, now in its 4th edition (ABA 2013)\, and numerous other articles on the rights of persons with disabilities. He is a member of various committees of the American Bar Association\, including: Legal Technology Resource Center Board (2017-2023); ABA Law Practice Section Client Development and Marketing Committee; ABA Law Practice Section Ethics and Professionalism Committee and the ABA’s Law Practice Section DEI committee. He is also a member of various committees of the Federal Bar Association\, including: the Federal Bar Association (FBA) Diversity and Inclusion committee; the FBA’s Civil Rights section and its Governing Board; FBA’s Civil Rights Amicus committee; and the Chair of the FBA’s Disability Best Practices Committee\, which in its first year formulated an accessibility manual for the FBA and its chapters. He is also a member of the Deaf and Hard of Hearing Bar Association Advocacy Committee and its Amicus committee. He has an A.B. from Vassar College\, a J.D. from University of San Diego School of Law\, and was one of the first in the entire country to receive the LL.M. in health law\, in his case from DePaul University College of Law. Interesting fact: He trained his miniature poodle to be a hearing dog while he practices virtually. \nAndrew Rozynski\, Esq.\nAndrew Rozynski is a distinguished partner at Eisenberg & Baum\, LLP. He harnesses his extensive experience as a civil rights attorney to passionately advocate for his client’s rights. His successful advocacy efforts have set legal precedents that have a positive ripple effect on numerous lives nationwide. In addition to his litigation work\, he is the co-director of the Eisenberg & Baum Law Center for Deaf and Hard of Hearing and also leads the firm’s appellate practice. Equipped with the dual skill sets of being both a formidable trial court litigator and an accomplished appellate lawyer\, Mr. Rozynski stands out in the legal field. Mr. Rozynski is unique in his willingness to tackle problems other lawyers shy away from and uses creativity to find winning strategies that aren’t readily apparent. He has a well-earned reputation for successfully litigating cases of first impression. Mr. Rozynski also has a strong national presence\, with admissions to over 40 Federal District and Appellate Courts spanning across more than 25 states. She is licensed to practice in California and New York. \nEric Foley\, Staff Attorney in the New Orleans Office of the Roderick & Solange MacArthur Justice Center \nEric Foley is an attorney at the Roderick & Solange MacArthur Justice Center\, where his docket includes challenges to bail systems\, police misconduct\, and violations of protesters’ rights across Louisiana. Prior to joining the MacArthur Justice Center in 2015\, Foley worked for S.E. SUMMARY:Section on Taxation: New Guidance - Temporary Relief from Recent Regulations on Foreign Tax Creditability
DESCRIPTION:This panel will discuss IRS Notice 2023-55 and its impact on U.S. multinational entities. IRS Notice 2023-55 provides temporary relief for taxpayers determining whether a foreign tax is eligible for a foreign tax credit under sections 901 and 903. Section 901 allows a credit for foreign income\, war profits\, and excess profits taxes; section 903 allows a credit for taxes paid in lieu of a generally imposed foreign income\, war profits\, or excess profits tax. 2022 regulations revised the rules for determining whether a foreign levy is a creditable foreign income tax under sections 901 and 903. The temporary relief offered through IRS Notice 2023-55 allows taxpayers to apply certain portions to of the prior regulations under section 901 rather than the 2022 regulations\, and also turns off portions of the new regulations under section 903. DESCRIPTION:Although the United States government recovers billions of dollars per year under the federal False Claims Act (FCA)\, the vast majority of that recovery is the result of voluntary settlements\, and very few FCA cases proceed to trial\, let alone verdict. Panelist will discuss their experiences preparing for and trying these cases and provide tips to other FCA attorneys on how to prepare for an FCA trial\, including tips for conducting effective discovery\, recurring issues subject to motions practice\, and preparing effective arguments for a judge and jury. \n  \nPresented by the Health Law Section \n\nPresenters\nBrittany Cambre \nBrittany represents individuals and companies in complex civil litigation\, internal investigations\, and white collar criminal defense. She has represented clients in various complex business litigation matters involving antitrust\, RICO\, and the False Claims Act. She also counsels clients in a wide array of issues including commercial business disputes and business torts. \nBefore joining Chilivis\, Cochran\, Larkins & Bever\, Brittany was an associate with Eversheds Sutherland (US)’s Litigation Practice Group\, focusing her practice on complex business litigation\, government investigations\, and class action defense. \nBrittany graduated in 2013 from the University of Georgia School of law\, she served as the Editor in Chief of the Georgia Journal of International and Comparative Law\, as an Intern for Superior Court judges of Barrow and Jackson counties\, and as a member of the Appellate Litigation Clinic. \nScott Grubman \nScott is a former Assistant United States Attorney (AUSA) and Department of Justice Trial Attorney who represents businesses and individuals across a wide variety of industries in connection with government and internal investigations\, False Claims Act litigation\, and white collar criminal defense. \nAlthough Scott represents clients across industries\, a substantial portion of his practice involves representing healthcare providers of all types and sizes in connection with high-stakes government investigations – both criminal and civil – by agencies such as the U.S. Department of Justice\, HHS-OIG\, the FBI\, and state Medicaid Fraud Control Units.  Scott also has extensive experience representing healthcare providers in connection with administrative proceedings\, payor audits\, and general healthcare regulatory matters\, particularly those related to the False Claims Act (including qui tam whistleblower actions)\, Stark Law\, and Anti-Kickback Statute.  He has represented healthcare clients ranging from multi-hospital health systems to individual physicians\, ancillary providers\, and every type and size in between.  He served as lead trial counsel in Georgia’s first-ever False Claims Act trial\, which resulted in a favorable settlement after 4 days of testimony. \nIn addition to his healthcare clients\, Scott also regularly represents clients who are being investigated for\, or who have been charged with\, white collar crimes\, including fraud\, embezzlement\, theft\, and public corruption.  He has first-chaired numerous criminal and civil jury trials in both federal and state courts\, and has handled criminal and civil appeals.  Scott is skilled and experienced in handling high-profile investigations as his matters have garnered substantial attention by the international\, national\, and local news media. He has also represented individuals in connection with Congressional investigations\, including the representation of a key witness before the Select Committee to Investigate the January 6th Attack on the United States Capitol (the “January 6 Committee”).  Scott has a reputation for passionately defending his clients both inside and outside of the courtroom. \nAfter graduating from law school with highest honors and then clerking for two federal judges (both U.S. District and U.S. Circuit Courts)\, Scott was accepted into the Attorney General Honor’s Program\, first serving as a Trial Attorney for the U.S. Department of Justice in Washington\, D.C.\, and then as an AUSA in Savannah\, Georgia\, where he investigated and prosecuted healthcare and other white collar fraud cases\, and was a member of his district’s Healthcare Fraud Task Force.  He also represented the United States as lead counsel in dozens of cases in both federal District Court and before the Eleventh Circuit\, including felony criminal investigations and prosecutions\, criminal and civil appeals\, habeas\, constitutional claims\, and asset forfeiture.  He was awarded a Special Commendation by the DOJ\, and was recognized by HHS-OIG for his government service. \nScott has published dozens of articles on healthcare fraud and white collar crime topics in nationally-recognized journals and publications\, and regularly presents at healthcare and white collar crime conferences and seminars nationwide. He  serves as an Adjunct Professor of Law at both Emory University and Georgia State University law schools\, where he teaches courses on white collar crime and healthcare fraud and abuse.  Scott has helped to train lawyers on trial advocacy skills both domestically and internationally\, including serving on the faculty of a week-long NITA trial advocacy training program in Lagos\, Nigeria.  He also serves in leadership positions in state and national organizations\, including the American Health Law Association (AHLA)\, the Federal Bar Association\, the American Bar Association\, and the State Bar of Georgia.  He has been quoted by both national and local news organizations on issues related to healthcare fraud and abuse and white collar crime\, including the New York Times\, Washington Post\, Wall Street Journal\, Bloomberg\, MSNBC\, and the Atlanta Journal Constitution. \nLauren Warner \nLauren A. He is heavily involved with the Federal Bar Association (FBA) as the Student Representative of the Sixth Circuit on the Board of the Law Student Division and student Liaison to the Judiciary Division of the FBA. Brendan also works closely with the Northern District of Ohio FBA Chapter through his position as President of the Akron Law School FBA Chapter. She was appointed by President Barack Obama and unanimously confirmed by the United States Senate on June 24\, 2014 (her birthday). Judge Bloom currently serves as Vice-Chair of the Judiciary Division Board of the Federal Bar Association\, previously serving as Chairperson of the Article III Trial Judges Committee. She was elected and serves as the Eleventh Circuit Representative to the Board of Directors of the Federal Judges Association and is a Board Member of the South Florida Chapter of the Federal Bar Association. She Chairs the Southern District of Florida’s Local Rules Committee and is an active member of the Southern District’s Ad Hoc Committee on Rules and Procedure. Judge Bloom is a frequent lecturer for the Florida Bar\, local bar associations\, law schools\, and FBA chapters. She has presented at the 2018 New Judges College and the 2017 District Judges Conference. She served on the faculty of the Florida Judicial College for 19 years\, teaching newly elected and appointed judges; the faculty of the National Judicial College\, the College of Advanced Judicial Studies\, the Florida Conference of County Court Judges\, and is an adjunct faculty member of the Litigation Skills Program at the University of Miami School of Law. In 2015\, Judge Bloom established the Southern District of Florida’s Summer Intern Ethics and Orientation Program and oversees its annual Law Day and Constitution Day Programs. Judge Bloom oversees the SDFL’s Judicial Intern Program and\, since the pandemic\, has partnered with other districts throughout the country to provide remote learning opportunities for law students. She created the Judicial Intern Academy in 2021 to expand federal judicial internships to students and pairs former federal judicial law clerks with summer interns to enhance the students’ research and writing skills\, now a national program through the Federal Bar Association. Judge Bloom received her Bachelor of Science degree in public relations from the University of Florida in 1984 and her Juris Doctor degree (cum laude) from the University of Miami School of Law. She practiced commercial litigation with the law firm of Floyd Pearson Richman Greer Weil Zack & Brumbaugh from 1988-1994 and served as a Traffic Court Magistrate from 1993-1994 before her election to the state court bench. \n \nHonorable Iain Johnston \nIain D. Johnston is a District Judge for the Northern District of Illinois\, Western Division.  He handles dispositive matters for civil and all felony criminal matters in the Division.  From 2013 through 2020\, he was the U.S. Magistrate Judge for the same court\, where he handled all pretrial matters for all civil and all criminal cases.  He graduated with honors from both The John Marshall Law School (1990) and Rockford College (1987).  Following law school\, he clerked for Judge Philip G.
