DESCRIPTION:In this program\, Judge Bob Bacharach of the Tenth Circuit Court of Appeals will discuss ways to enhance the clarity of your legal writing. He will be drawing on his book\, “Legal Writing: A Judge’s Perspective on the Science and Rhetoric of the Written Word\,” which uses techniques of communication based on famous examples of oratory and data gathered by psycholinguists. \nPresented by the Civil Rights Law Section\, Labor & Employment Law Section\, the Federal Judicial Law Clerk Committee\, and the Kansas and Western District of Missouri Chapter. \n\nAbout the Presenters\nModerator: Blake A. Shuart\, Attorney\, Hutton & Hutton Law Firm\nMr. Shuart is a trial lawyer with a wide range of litigation experience handling all types of difficult and complex tort cases in various state and federal courts across the United States. He has significant experience in every stage of the process: from initial case workup and strategy to identifying and consulting with elite experts; from pre-suit negotiations and settlement demands to mediations and complex negotiations; depositions of fact witnesses\, corporate representatives\, and experts; briefing and arguing dispositive motions; contested hearings; and trials and appeals in the state and federal courts. He has successfully handled hundreds of serious cases as lead counsel\, has tried many cases to verdict as lead\, solo\, or second-chair counsel\, and has briefed and argued cases in the appellate courts several times. His experience spans virtually every type of tort claim arising out of catastrophic injury or death. Mr. Shuart is involved in numerous professional organizations; publishes and lectures extensively on topics relevant to his practice; has received several honors from his peers; and has been appointed by the local courts many times to help oversee litigation\, serve as an expert witness or sit as a Pro Tem Judge. Shuart and his colleagues at Hutton & Hutton have appeared as lead counsel in some of the most publicized and well-known catastrophic injury or death cases in the community over the past several years\, and he frequently receives referrals from other attorneys in the community across all specialties of practice. \nHon. Bob Bacharach\, Judge of the Tenth Circuit Court of Appeals\nJudge Bacharach was appointed in February 2013 as a United States Circuit Judge for the Tenth Circuit Court of Appeals. He graduated with High Honors from the University of Oklahoma with  B.A. in History and the Tom Lottinville Award for the Best Essay submitted in the History Department. He obtained his Juris Doctorate from Washington University School of Law in St. Louis in 1985\, where he graduated order of the coif and was awarded the Breckenridge Scholarship for the second highest grade average in his senior year of law school. In law school at Washington University\, he also served as the Developments Editor of the Washington University Law Quarterly (now named the Washington University Law Review) and was awarded the Mary Collier Hitchcock Prize for writing for the best Note (student article) in the law review. Upon graduation from law school\, Judge Bacharach clerked from 1985 to 1987 for Judge William J. Holloway\, Jr.\, who was then the Chief Judge of the Tenth Circuit Court of Appeals. After completing this clerkship\, Judge Bacharach practiced civil litigation at Crowe & Dunlevy in Oklahoma City\, Oklahoma from 1987 to 1999. He then served as a U.S. Magistrate Judge in the Western District of Oklahoma until 2013\, when he was appointed to the Tenth Circuit Court of Appeals. Judge Bacharach authored the recently published book on legal writing\, Legal Writing: A Judge’s Perspective on the Science and Rhetoric of the Written Word\, published by ABA Press. He has also authored “Section 1983 and the Availability of a Federal Forum: A Reappraisal of the Police Brutality Cases\,” 16 Memphis State University Law Review 353 (1986); “Section 1983 and an Administrative Exhaustion Requirement\,” 40 Oklahoma Law Review 407 (1987); “Motions in Limine in Oklahoma State and Federal Courts\,” 24 Oklahoma City University Law Review 113 (1999); “Dirks v. SEC=s Footnote Fourteen: Horizontal and Vertical Reach\,” 62 Washington University Law Quarterly 477 (1984); and “Post-Trial Juror Interviews by the Press: The Fifth Circuit= Approach\,” 62 Washington University Law Quarterly 783 (1985). In addition\, he and Professor Lyn Entzeroth (now Dean of Tulsa University School of Law) coauthored “Judicial Advocacy in Pro Se Litigation: A Return to Neutrality\,” 42 Indiana Law Review 19 (2009). The panel will provide perspectives on what it means to be a LGBTQ+ legal practitioner and will also discuss their involvement with and in the LGBTQ+ community. Panelists will provide perspectives from an array of practices areas\, including public interest\, civil litigation\, tax law\, and more. \n  \nPresented by the LGBTQ+ Law Section \n\nAbout the Presenters\nAnthony May\, Associate\, Brown\, Goldstein & Levy LLP (Moderator)\nAnthony May is an associate at Brown\, Goldstein & Levy\, LLP. He has represented clients in a variety of complex litigation matters including assisting employees with disabilities in obtaining accessible technology and accommodations in the workplace\, representing individuals who have been wrongfully convicted\, commercial litigation disputes\, and fighting workplace discrimination based on sexual orientation. Prior to joining the firm\, Anthony was the Francis D. Murnaghan\, Jr. Appellate Advocacy Fellow at The Public Justice Center\, where he represented indigent clients\, authored amicus briefs\, and argued in the United States Court of Appeals for the Fourth Circuit and Maryland appellate courts on various anti-poverty and civil rights cases. He clerked on the Appellate Court of Maryland (formerly known as the Maryland Court of Special Appeals) for the Honorable Deborah Sweet Eyler (Ret.). While attending law school\, Anthony worked as a law clerk at Brown Goldstein & Levy\, was the Executive Symposium Editor of the Journal of Race\, Religion\, Gender & Class\, a semi-finalist in the ABA Labor & Employment Law Trial Competition\, and a Legal Writing Fellow. Anthony is a graduate of the University of Akron and the University of Maryland Francis King Carey School of Law. \nMario Choi\, Partner\, Donahue Fitzgerald LLP \nMario Choi is a Partner at Donahue Fitzgerald LLP\, where he advises and represents clients in complex commercial litigation and other matters. Prior to Donahue Fitzgerald\, Mario was an attorney at a plaintiff class action firm. He began his legal career in New York\, first serving as a law clerk in the Commercial Division of the New York Supreme Court\, New York County\, and then as an associate at a mid-size law firm. Mario is active in the community\, serving as a Judge Pro Tem for the San Francisco Superior Court\, a lecturer at Berkeley Law\, and as a director on the boards of several non-profit and legal organizations. \n  \nKevin Griffiths\, Managing Partner\, Scanlan Griffiths + Aldridge \nKevin is one of the founders of Scanlan Griffiths + Aldridge\, a boutique civil-litigation firm Boise\, Idaho. He currently serves as the managing partner. He is a civil litigator with a practice focused on medical malpractice and professional liability defense\, insurance coverage and bad faith litigation\, products liability\, and complex commercial litigation. He is an active member of the FBA and currently serves as Treasurer of the LBGTQ+ Section. \nPrior to entering private practice\, he served as a law clerk to the Hon. Jim Jones of the Idaho Supreme Court. Kevin has also served as a visiting lecturer on a variety of topics for the University of Idaho College of Law\, including insurance law and civil discovery practice. Kevin earned his J.D. from the University of Idaho College of Law and has a B.A. in History from the College of Idaho. \nJacob Puhl\, Tax Policy Manager\, AMET & The Americas\, Meta \nJacob is a Manager of Tax Policy at Meta\, formerly Facebook. He leads Tax Policy for the Middle East\, Africa\, and the US States. Based in Washington\, DC\, he serves as a liaison between policymakers\, business lines\, and tax functions to remove friction and anticipate challenges. His portfolio spans the globe\, with a focus on promoting workable and consistent tax policy. \nBefore Meta\, Jacob was a Manager at Deloitte’s Washington National Tax practice focusing primarily on US Federal tax policy. DESCRIPTION:**Program hosted in (ET) time zone** \nThis September\, the Qui Tam Section will present a two-part series on developments relating to pandemic relief fraud. \nOn Sept. 20\, 2023\, this first panel will examine DOJ’s response to date involving borrower liability as well as the possibility of DOJ action against financial institutions and fintechs that processed pandemic-relief loans. Last December\, a congressional investigation outlined potential misconduct by fintechs whose loans had a significantly higher rate of fraud. DESCRIPTION:Please join the Alaska Lawyers Chapter and the Federal Bar Association (Alaska Chapter) for its first annual Supreme Court Roundup to discuss the blockbuster cases—and other interesting cases—from the Supreme Court’s past term. We are pleased to be joined by Kannon Shanmugam\, widely recognized as one of the top Supreme Court litigators in the country\, having argued 36 cases before the Court. Among other interesting cases from last term\, Kannon will explore the Supreme Court’s affirmative action decision in Students for Fair Admissions v. Harvard\, the voting rights decision in Allen v. Milligan\, the student-loan forgiveness case in Biden v. Nebraska\, and the religious liberty case in 303 Creative v. Elenis. \n\nPresenter\nKannon Shanmugam\nPartner\, Paul\, Weiss\, Rifkind\, Wharton & Garrison LLP \nChair of the Supreme Court and Appellate Litigation Practice and managing partner of the Washington office\, Kannon Shanmugam is widely recognized as one of the nation’s top appellate lawyers. Kannon has argued 36 cases before the Supreme Court\, including 28 cases in private practice. He has also argued over 100 appeals in courts across the country\, including arguments in all thirteen federal courts of appeals and in numerous state courts. One study found that\, over a five-year period\, Kannon had the highest rate of successful petitions for review of any Supreme Court practitioner. He was lead counsel in the successful constitutional challenge to the structure of the Consumer Financial Protection Bureau\, described by the Wall Street Journal as the “constitutional case of the year.” This year alone\, he successfully overturned the certification of a $13 billion securities class action arising out of the 2008 financial crisis (ATRS v. Goldman Sachs); he successfully defended the settlement of what is believed to be the largest private antitrust settlement in history (Fikes Wholesale v. HSBC Bank USA); and he successfully overturned a $570 million damages award in a high-profile trade-secrets case (Syntel v. TriZetto). Prior to private practice\, Kannon served as an Assistant to the Solicitor General at the U.S. Department of Justice. He also served as a law clerk to Supreme Court Justice Antonin Scalia and to Judge J. DESCRIPTION:The FBA’s Intellectual Property Law Section is hosting this CLE program regarding two of the Supreme Court’s Lanham Act decisions from the 2022 Term: \nThe U.S. Supreme Court’s Bad Spaniels Case\nOn June 8\, 2023\, the U.S. Supreme Court issued its long-awaited opinion in Jack Daniel’s Properties\, Inc. v. VIP Products LLC\, holding that parody trademarks do not receive special First Amendment protection when they function as trademarks.  This talk will review the decision and its possible implications for future parody trademarks\, as well as guidance gleaned from the concurring opinions regarding the use of brands in creative works and the use of surveys in litigation. \nAbitron Case Regarding Extraterritorial Application of the Lanham Act\nThis part of the program will discuss Abitron Austria GmbH v. Hetronic International\, Inc.\, issued June 29\, 2023\, in which the Supreme Court\, for the first time in seventy years\, has decided a case involving the extraterritorial application of the Lanham Act. In so doing\, it has resolved a circuit split on the applicability of the Lanham Act actions involving foreign conduct.  In Abitron\, the Court concluded that the Lanham Act applies only to domestic conduct and does not apply extraterritorially to purely foreign sales that never reached the United States or confused U.S. consumers. He is the author of three books and numerous articles\, including the best-selling treatise\, Understanding Copyright Law\, now in its 7th edition. SUMMARY:Webinar: Remedies\, Court Access\, and Beyond: Life after Cummings
DESCRIPTION:This webinar will discuss the remedies options available for persons with disabilities post Cummings under a variety of different laws and how attorneys are navigating the post Cummings landscape. More specifically\, the webinar will zero in on Cummings v. Premier Rehab Keller\, Perez v. Sturgis Public Schools\, and Health and Hospital Corporation of Marion County v. Talevski. By the end of the session\, attendees will gain an understanding of three critical Supreme Court cases affecting persons with disabilities. They will also gain an understanding of the possible remedies persons with disabilities may utilize after facing disability discrimination in non-employment situations. \nPresented on behalf of the Civil Rights Law Section. \n\nPresenters\nWilliam D. Goren\, Esq.\, J.D.\, LL.M.\nWilliam D. Goren\, Esq.\, of William D. Goren\, J.D.\, LL.M. LLC in Decatur\, GA\, has been dealing with the ADA as an Attorney since 1990. His law and consulting practice\, https://www.understandingtheada.com/\, as well as his blog\, Understanding the ADA\, (a member of the ABA Top 100 for five consecutive years\, 2014-2018- there was no ABA 100 in 2019-2022)\, all focus on understanding the ADA so that the client understands what it means to comply with that law and related laws. In particular\, he provides consulting\, counseling\, representation\, and training services involving compliance with the Americans with Disabilities Act\, Rehabilitation Act of 1973\, and related laws- such as the Air Carrier Access Act and the Fair Housing Act\, among others. Mr. Goren also brings a deep\, personal understanding of what it means to have a disability\, equipping him with exceptional insight on how the ADA actually works. He is deaf with a congenital bilateral hearing loss of 70–90+ decibels\, but functions entirely in the hearing world thanks to hearing aids\, Bluetooth technology\, automatic speech recognition\, and lip-reading. For reasons independent of his deafness\, he also uses voice dictation technology to access his computer. He is also a frequent presenter\, a trained mediator\, a FINRA arbitrator (Chairperson eligible)\, and an arbitrator on the CPR employment panel. Finally\, he is the author of Understanding the ADA\, now in its 4th edition (ABA 2013)\, and numerous other articles on the rights of persons with disabilities. He is a member of various committees of the American Bar Association\, including: Legal Technology Resource Center Board (2017-2023); ABA Law Practice Section Client Development and Marketing Committee; ABA Law Practice Section Ethics and Professionalism Committee and the ABA’s Law Practice Section DEI committee. He is also a member of various committees of the Federal Bar Association\, including: the Federal Bar Association (FBA) Diversity and Inclusion committee; the FBA’s Civil Rights section and its Governing Board; FBA’s Civil Rights Amicus committee; and the Chair of the FBA’s Disability Best Practices Committee\, which in its first year formulated an accessibility manual for the FBA and its chapters. He is also a member of the Deaf and Hard of Hearing Bar Association Advocacy Committee and its Amicus committee. He has an A.B. from Vassar College\, a J.D. from University of San Diego School of Law\, and was one of the first in the entire country to receive the LL.M. in health law\, in his case from DePaul University College of Law. Interesting fact: He trained his miniature poodle to be a hearing dog while he practices virtually. \nAndrew Rozynski\, Esq.\nAndrew Rozynski is a distinguished partner at Eisenberg & Baum\, LLP. He harnesses his extensive experience as a civil rights attorney to passionately advocate for his client’s rights. His successful advocacy efforts have set legal precedents that have a positive ripple effect on numerous lives nationwide. In addition to his litigation work\, he is the co-director of the Eisenberg & Baum Law Center for Deaf and Hard of Hearing and also leads the firm’s appellate practice. Equipped with the dual skill sets of being both a formidable trial court litigator and an accomplished appellate lawyer\, Mr. Rozynski stands out in the legal field. Mr. Rozynski is unique in his willingness to tackle problems other lawyers shy away from and uses creativity to find winning strategies that aren’t readily apparent. He has a well-earned reputation for successfully litigating cases of first impression. Mr. Rozynski also has a strong national presence\, with admissions to over 40 Federal District and Appellate Courts spanning across more than 25 states. Aisha supervised law students as they engaged in written and oral advocacy on behalf of housing insecure veterans\, and organized a site visit for Soledad Garcia Munoz\, the Special Rapporteur on Economic\, Social\, Cultural and Environmental Rights at the Inter-American Commission for Human Rights\, to assess the houselessness crisis in Los Angeles. \nPrior to joining Disability Rights California\, Aisha was a staff attorney at Manhattan Legal Services\, where she represented tenants and tenant associations in issues relating to violations of the Fair Housing and Rehabilitation Acts\, warranty of habitability and rent stabilization laws. \nIn October 2020\, Aisha was appointed to the San Bernardino Superior Court’s Elimination of Bias Committee\, where she continues to work closely with judicial officers\, court personnel\, and attorneys from the public and private sectors to eliminate bias in the justice system and ensure court processes are accessible and equitable to all. \nAisha received her B.A. from California State University\, Fullerton\, and her J.D. from New York Law School. She is licensed to practice in California and New York. \nEric Foley\, Staff Attorney in the New Orleans Office of the Roderick & Solange MacArthur Justice Center \nEric Foley is an attorney at the Roderick & Solange MacArthur Justice Center\, where his docket includes challenges to bail systems\, police misconduct\, and violations of protesters’ rights across Louisiana. Prior to joining the MacArthur Justice Center in 2015\, Foley worked for S.E. M. Margaret McKeown\n \nJudge Margaret McKeown has served almost twenty-five years as a judge on the U.S. Court of Appeals for the Ninth Circuit. She is a member of the American Academy of Arts and Sciences\, an affiliated scholar at the Center for the American West at Stanford University\, and jurist-in-residence at the University of San Diego School of Law. As a former White House Fellow\, she served as special assistant at the White House and as special assistant to the Secretary of the Interior. A Wyoming native\, she serves on the board of Teton Science Schools and was a member of the first American expedition to Mt. Shishapangma in Tibet. \nJudge McKeown recently published Citizen Justice: The Environmental Legacy of William O. Douglas—Public Advocate a Conservation Champion (Potomac Press\, 2022). \nJudge McKeown graduated from Georgetown University Law Center and holds an honorary doctorate from Georgetown University. Before her appointment\, she was the first woman partner at Perkins Coie in Seattle and Washington\, D.C. \nJudge McKeown is a member of the US Judicial Conference Committee on Judicial Conduct and Disability. She chairs the Ninth Circuit Workplace Environment Committee and is a member of the National Workplace Conduct Working Group. She is on the Council of the American Law Institute\, the Judicial Advisory Board of the American Society of International Law\, and the editorial board of Litigation magazine. She served as Chair of the ABA Commission on the 19th Amendment\, past President of the Federal Judges Association\, and former chair of the US Judicial Conference Codes of Conduct Committee (ethics). \nJudge McKeown is on the board of the World Justice Project and is Vice Chair of the ABA Rule of Law Initiative and a current special advisor. She has lectured throughout the world on international law\, intellectual property\, human rights\, ethics\, and constitutional law and has participated in numerous rule of law initiatives with judges and lawyers. \nJudge McKeown received the ABA Margaret Brent Women Lawyers of Achievement award\, the ABA John Marshall Award\, the Inns of Court Ninth Circuit Professionalism Award\, the Washington Women Lawyers President’s Award\, and the Girl Scouts Cool Woman Award\, among others. \nModerator\n \n\nHon. Gustavo A. Gelpi\n \nJudge Gelpí was appointed to the United States Court of Appeals for the First Circuit in October 2021. He received his undergraduate degree from Brandeis University in 1987 and his law degree from Suffolk University Law School in 1991. From 1991 to 1993\, Judge Gelpí served as law clerk to Judge Juan M. Pérez-Giménez. From 1993 to 1996\, he served as an Assistant Federal Public Defender. From 1997 to 2000\, Judge Gelpí worked as an Assistant Attorney General\, served as Solicitor General of Puerto Rico\, and worked in private practice. Judge Gelpí was appointed as a Magistrate Judge in the District of Puerto Rico in 2001. In 2006\, President George W. Bush appointed him to the United States District Court for the District of Puerto Rico\, where he served as Chief Judge from 2018 to 2021. Judge Gelpi has been a FBA member for over 30 years. SUMMARY:Section on Taxation: New Guidance - Temporary Relief from Recent Regulations on Foreign Tax Creditability
DESCRIPTION:This panel will discuss IRS Notice 2023-55 and its impact on U.S. multinational entities. IRS Notice 2023-55 provides temporary relief for taxpayers determining whether a foreign tax is eligible for a foreign tax credit under sections 901 and 903. Section 901 allows a credit for foreign income\, war profits\, and excess profits taxes; section 903 allows a credit for taxes paid in lieu of a generally imposed foreign income\, war profits\, or excess profits tax. 2022 regulations revised the rules for determining whether a foreign levy is a creditable foreign income tax under sections 901 and 903. The temporary relief offered through IRS Notice 2023-55 allows taxpayers to apply certain portions to of the prior regulations under section 901 rather than the 2022 regulations\, and also turns off portions of the new regulations under section 903.
