SUMMARY:Webinar: False Claims Act Litigation in Healthcare
DESCRIPTION:This webinar will give both an overview of False Claims Act (FCA) enforcement in the health care arena\, as well as a summary of recent developments and trends in government enforcement actions against health care fraud.  As health care attorneys are well aware\, the health care system in the United States is the most heavily regulated industry other than nuclear energy\, and the penalties for violating the regulations can be draconian – even when it is the result of honest mistakes.  This webinar will highlight ways that health care attorneys can prevent their clients from being the subject of a government investigation and how to protect them if they are investigated.  The subject matter is appropriate for health care regulatory and transactional attorneys\, as well as for litigators – and both younger attorneys and experienced attorneys are welcome. \nPresented by the Health Law Section \n\nAbout the Presenter\nG. Norman Acker III\, Of Counsel\, K&L Gates\nNorman Acker is of counsel in the firm’s Research Triangle Park office. Norman brings more than three decades of experience as an Assistant United States Attorney to help guide clients facing government False Claims Act investigations or other allegations of fraud or abuse of government programs. He is a member of the Health Care and FDA practice. Prior to joining the firm\, Norman served as acting U.S. attorney\, the chief federal law enforcement officer in the Eastern District of North Carolina. That office is responsible for prosecuting all federal crimes in the district\, including drug crimes\, violent crimes\, white collar fraud\, terrorism\, and public corruption. The U.S. Attorney’s Office (USAO) also represents the United States in civil court\, handling a wide variety of civil litigation. He previously served as an assistant U.S. attorney for more than 30 years\, focusing his practice on the investigation and civil prosecution of health care fraud and other fraud against the government. In this capacity\, he worked closely with the Health and Human Services Office of Inspector General (HHS-OIG)\, the North Carolina Medicaid Investigations Division (NC-MID)\, the Department of Defense Criminal Investigation Service (DCIS)\, the Drug Enforcement Administration (DEA)\, the FBI\, and other law enforcement agencies. For 17 years\, he served as the Deputy Chief of the Civil Division\, where he both handled his own case load of civil fraud and health care fraud cases\, and supervisedas well as supervising all of the civil fraud\, health care fraud\, and False Claims Act cases for the Eastern District of North Carolina. He has received numerous awards and commendations from federal and state agencies in recognition of his collection of more than $100 million in connection with False Claims Act litigation. He served briefly as the civil chief\, supervising all civil litigation for the USAO\, before becoming the first assistant\, supervising all civil\, criminal\, and appellate litigation in the office. SUMMARY:Immigration Law Section: Updates in Asylum Law
DESCRIPTION:This webinar\, hosted by the Immigration Law Section’s Newer Lawyers Division\, features experts in the field of asylum to discuss changes that have occurred in recent years involving this area of law. Asylum law has seen massive changes\, and then reversions of some of these changes\, in ways that impact thousands of individuals seeking asylum\, and the panelists invited have been at the forefront of some of the litigation surrounding these changes. Topics to be discuss include changes in the law surrounding Particular Social Groups and work authorization for asylum seekers\, as well as the current “state of play” for asylum in United States. \nPresented by: Immigration Law Section \nRegistration is Closed \n\nPresenters\nBradley Jenkins\, Senior Litigation Counsel\, Asylum Seeker Advocacy Project \nBradley Jenkins is Senior Litigation Counsel at the Asylum Seeker Advocacy Project (ASAP). Bradley represents asylum seekers in ASAP’s strategic litigation. \nPrior to joining ASAP\, Bradley worked for the Catholic Legal Immigration Network\, Inc. (CLINIC). At CLINIC\, Bradley managed the BIA Pro Bono Project and litigated significant cases before federal courts\, the Board of Immigration Appeals\, and the Attorney General. \nBradley has been counsel is several significant cases advancing the rights of asylum seekers including: \n\nMatter of L-E-A-\, 28 I&N Dec. 304 (A.G. 2021)\, vacating an Attorney General decision that blocked people from asylum if their family was threatened;\nMatter of E-R-A-L-\, 27 I&N Dec. 767 (BIA 2020)\, vacated by Albizures-Lopez v. Barr\, No. 20-70640\, 2020 WL 7406164 (9th Cir. Dec. 10\, 2020)\, vacating a Board of Immigration Appeals decision suggesting that “typical families” and landowners could not be protected by the asylum laws;\nLM.-M. v. Cuccinelli\, 442 F. Supp. 3d 1 (D.D.C. 2020)\, declaring harmful anti-asylum policies to be void because the official who made the policies was unlawfully appointed; and\nMatter of Deang\, 27 I&N Dec. 57 (BIA 2017)\, setting a precedent that certain receiving stolen property offenses are not aggravated felonies that bar applicants from obtaining asylum or withholding of removal.\n\nBradley is a graduate of the University of Notre Dame and Harvard Law School. He is a member of the Maryland bar. \nNeela Chakravartula\, Managing Attorney\, Center for Gender and Refugee Studies \nNeela Chakravartula is a Managing Attorney at the Center for Gender and Refugee Studies (CGRS).  Neela provides legal technical assistance and training to advocates\, and engages in litigation to protect the rights of asylum seekers. Neela additionally oversees the Center ‘s Experts Witness Database which connects advocates with expert witnesses in fear-of-return claims for relief. \nNeela came to CGRS after working for four years as a staff attorney at the United States Court of Appeals for the Ninth Circuit\, where she researched and reviewed cases raising claims for asylum and related forms of relief. Neela also worked in New York City for three years\, representing clients in a variety of civil matters. SUMMARY:Webinar: The PACT Act and its Implications for Representing Veterans in VA Disability Cases
DESCRIPTION:Signed into law in August 2022\, the PACT Act was created to help provide generations of veterans and their families with the care and benefits they need and deserve.  The PACT Act expanded VA health care and benefits to veterans exposed to burn pits\, herbicides\, and other toxic substances.  This webinar will highlight the PACT Act’s provisions and the effects of those legal changes on the pursuit of VA disability benefits. \nPresented by the Veterans and Military Law Section \n\nAbout the Presenters\nMaura Jean Black\, Esq.\, Managing Attorney\, Chisholm Chisholm & Kilpatrick LTD\nMaura is a managing attorney at Chisholm Chisholm & Kilpatrick LTD in Providence\, Rhode Island\, where she specializes in representing disabled veterans and their families before the U.S. Court of Appeals for Veterans Claims\, the Board of Veterans’ Appeals\, and the Department of Veterans Affairs.  Throughout her career\, she has represented hundreds of veterans and their dependents in their pursuit of VA benefits.  She has presented and organized numerous continuing legal education events that have focused on service-connected VA benefits and appeals\, VA’s appeals reform legislation\, and petitions for writs of mandamus at the U.S. Court of Appeals for Veterans Claims.  In the spring of 2022\, Maura served as a panelist during an Appeals Modernization Act presentation at the Fifteenth Judicial Conference of the U.S. Court of Appeals for Veterans Claims. Maura is an active member of the Federal Bar Association.  From 2017 to 2022\, she served in leadership positions in the FBA’s Veterans and Military Law Section.  She is currently the deputy chair of the Sections and Divisions Council. Prior to joining Chisholm Chisholm & Kilpatrick in 2016\, Maura gained experience as an associate attorney in a civil litigation firm\, a judicial law clerk in the Rhode Island Superior Court\, and an intern with both the Rhode Island Public Defender’s office and Rhode Island Legal Services.  She is a member of the Massachusetts and Rhode Island state bars and is admitted to practice before the U.S. District Court for the District of Rhode Island and the U.S. Court of Appeals for Veterans Claims.  Maura spends her free time cooking\, fitness training\, spending time with her friends and family\, and enjoying Rhode Island’s East Bay Bike Path. \nNicholas A. M. Briggs\, Accredited VA Claims Agent\, Chisholm Chisholm & Kilpatrick LTD\nNicholas joined Chisholm Chisholm and Kilpatrick in June 2015 as a Veterans Claims Advocate.  As of February 2018\, Nicholas is an Accredited VA Claims Agent.  Nicholas’s practice focuses on representing disabled veterans and their families before the VA and the Board of Veterans’ Appeals.  He is also admitted to practice before the U.S. Court of Appeals for Veterans Claims as a non-attorney practitioner. Nicholas graduated from Brown University in 2014 with a B.A. in Political Science in the subfield of International and Comparative Politics.  During college\, Nicholas completed internships with the Worcester County Committee for Public Counsel Services\, the Office of Congressman James P. She is the first African American woman to be appointed as a federal court judge in the state of Louisiana’s over 200 year history. She was elevated to Chief Judge on May 25\, 2018. She is the first African American to ever serve as Chief Judge in the Eastern District of Louisiana. \nIn November 2020\, Chief Judge Jolivette Brown was appointed by Chief Justice John Roberts to serve on the Judicial Conference of the United States Standing Committee on Financial Disclosure. She is currently a member of the Executive Committee of the ABA National Conference of Federal Trial Judges and the Executive Committee of the Federal Judges Association. She also serves as the chair of membership for the Federal Judges Association. Brown for over 31 years\, and they have two adult children. \n  \nHon. J. Michelle Childs\, United States Court of Appeals for the District of Columbia Circuit \nJudge J. Michelle Childs was appointed to the United States Court of Appeals for the District of Columbia Circuit in July 2022. She holds her undergraduate degree in Management from the University of South Florida Honors College\, a law degree from the University of South Carolina School of Law\, a Masters in Personnel and Employment Relations from the University of South Carolina’s Darla Moore School of Business\, a Masters of Judicial Studies from Duke University School of Law\, and an Honorary Doctorate Degree in Public Service from the University of South Carolina. \nFrom 1992 to 2000\, Judge Childs worked at Nexsen Pruet\, ultimately serving as partner. From 2000 to 2002\, Judge Childs was appointed to serve as the Deputy Director for the South Carolina Department of Labor\, Licensing\, and Regulation’s Division of Labor. From 2002 to 2006\, Judge Childs received another appointment to serve as a commissioner on the South Carolina Workers’ Compensation Commission. In 2006\, the South Carolina General Assembly elected her as a state circuit court judge. Clarke (Ret.)\, Circuit Court\, Prince George’s County\, Maryland; President\, National Association of Women Judges \nJudge Toni E. Clarke (Ret) served as Associate Judge of the Circuit Court for Prince George’s County Maryland\, Seventh Judicial Circuit from February 6\, 1998\, until taking senior status on September 1\, 2018. During her tenure Judge Clarke presided over many types of cases including\, but not limited to\, Civil\, Criminal\, Foreclosure\, Family and Juvenile. Judge Clarke is currently a Neutral and Arbitrator with The McCammon Group\, serving Maryland\, the District of Columbia and Virginia. \nJudge Clarke received her J.D. from the University of Maryland School of Law (now University of Maryland Frances Carey Law School)\, Class of 1986\, and her B.S. from The Pennsylvania State University\, Class of 1979\, where she played on the Women’s Varsity Basketball team. Prior to her appointment\, Judge Clarke practiced law in both the public and private sector. Clients benefit from her perspective as a former federal prosecutor\, as well as her extensive investigative and trial skills. She also advised on the development and implementation of legal policies and procedures\, and coordinated legal strategy with numerous city\, county and federal agencies and legal organizations. Since 2012\, Renai has served as an adjunct professor at Northwestern Pritzker School of Law\, teaching “Introduction to Trial Advocacy.” She has also taught “International Criminal Law in U.S. Courts” and the “Civil Government Practicum.” Her teaching experience also includes traveling to Tanzania to conduct an intensive training on trial advocacy techniques and anti-corruption practices for local magistrate judges and lawyers. \nAndrea Campbell\, Assistant United States Attorney\, Narcotics and Money Laundering Section\, United States Attorney’s Office for the Northern District of Illinois\nAs a litigator with over 10 years of experience\, Andrea Campbell has shown a commitment to public service. DESCRIPTION:Join us for Black History Month as we explore Extraordinary Stories You Might Have Missed! \nDuring WWII\, Black sailors stationed at Port Chicago\, CA\, were required to load munitions on ships with inadequate training and under supervision that stressed speed over safety. On July 17\, 1944\, cataclysmic explosions instantly killed 320 men (2⁄3 of them African American) and injured hundreds more. Unsafe conditions inspired hundreds of Black servicemen to refuse to load munitions\, an act known as the Port Chicago Mutiny. Fifty men—called the “Port Chicago 50″—received convictions from that Mutiny Trial that changed their lives.
