SUMMARY:Webinar: Decoding Website Accessibility: What Every Attorney Needs to Know
DESCRIPTION:**Program hosted in (ET) Time Zone** \nDigital accessibility has become a rising area of litigation\, affecting businesses across nearly every industry. Attorneys are now on the front lines of advising clients\, responding to claims\, and interpreting complex technical evidence tied to website accessibility. During this session\, attendees will engage with two nationally recognized consulting experts as they break down what makes a website truly “accessible” under ADA Title III and explain how the Web Content Accessibility Guidelines (WCAG) are applied in practice. The presenters will highlight common compliance pitfalls\, explain the different layers of guidance in WCAG (including its structure of principles\, guidelines\, and testable Success Criteria\, as well as WCAG versions and levels)\, share real-world examples that illustrate common issues\, and explain the role that consulting experts play in disputes involving website accessibility.\n \nRegister Now!\nPresented by FBA’s Civil Rights Law Section \n\nPresenters\n \n Michael Silverman\, Digital Accessibility Strategist \nMichael Silverman is a digital accessibility strategist\, consultant\, advisor and expert\, highly experienced in website/product accessibility and compliance with ADA Title III and Web Content Accessibility Guidelines (WCAG). SUMMARY:Webinar: Litigating Website Accessibility Cases - An Overview and the View from the Plaintiff and Defense Perspectives
DESCRIPTION:**Program hosted in (ET) Time Zone** \nOne of the hot areas of ADA jurisprudence is website accessibility litigation. This program will discuss the applicable laws and “rules\,” found in such litigation. It will also discuss litigation concerns in website accessibility cases from both the plaintiff and defense perspective. \nRegister Now!\nPresented by FBA’s Civil Rights Law Section \n\nPresenters\n  William D Goren\, Esq.\, Attorney and Consultant (co-moderator) \nWilliam D. Goren\, Esq.\, of William D. Goren\, J.D.\, LL.M. LLC in Decatur\, GA\, has been dealing with the ADA as an Attorney since 1990. His law and consulting practice\, https://www.understandingtheada.com/\, as well as his blog\, Understanding the ADA\,  all focus on understanding the ADA so that the client understands what it means to comply with that law and related laws. In particular\, he provides consulting\, counseling\, representation\, and training services involving compliance with the Americans with Disabilities Act\, Rehabilitation Act of 1973\, and related laws- such as the Air Carrier Access Act and the Fair Housing Act-\, among others. \nMr. Goren also brings a deep\, personal understanding of what it means to have a disability\, equipping him with exceptional insight on how the ADA actually works. He is deaf with a congenital bilateral hearing loss of 70–120+ decibels\, but functions entirely in the hearing world thanks to hearing aids\, Bluetooth technology\, automatic speech recognition\, and lip-reading. For reasons independent of his deafness\, he also uses voice dictation technology to access his computer. He is also a frequent presenter\, a trained mediator\, a FINRA arbitrator (Chairperson eligible)\, and an arbitrator on the CPR employment panel. Finally\, he is the author of Understanding the ADA\, now in its 4th edition (ABA 2013)\, and numerous other articles on the rights of persons with disabilities. He is and has been a member of various committees of the American Bar Association\, including: Legal Technology Resource Center Board (2017-2023); ABA Law Practice Section Client Development and Marketing Committee; ABA Law Practice Section Ethics and Professionalism Committee and the ABA’s Law Practice Section DEI committee. He is also a member of various committees of the Federal Bar Association\, including: the Federal Bar Association (FBA) Committee for the Advancement in the Legal Profession (Diversity and Inclusion)\, committee; the FBA’s Civil Rights section and its Governing Board; FBA’s Civil Rights Amicus committee; and since 2022\, the Chair of the FBA’s Disability Best Practices Working Group. \nIn the first year of the Disability Best Practices Working Group\, it formulated an accessibility manual for the FBA and its chapters\, and is currently working on a resource guide for attorneys when they are faced with situations involving persons with disabilities. He is also a member of the Deaf and Hard of Hearing Bar Association and the Sports Lawyers Association. He has an A.B. from Vassar College\, a J.D. from University of San Diego School of Law\, and was one of the first in the entire country to receive the LL.M. in Health Law\, in his case from DePaul University College of Law. He is AV rated by Martindale Hubble and is a Thomson Reuters Superlawyer. Richard’s practice covers a wide range of business disputes\, with a particular focus on the disability rights provisions of the Fair Housing Act and the Americans with Disabilities Act. He has served as an adjunct professor teaching Disability Law at the Dedman School of Law at Southern Methodist University and has served on the Examination Committee for Civil Trial Certification for the Texas Board of Legal Specialization and as an adjunct professor of trial advocacy at Texas Wesleyan School of Law. Richard is the author of Accessibility Defense (accessdefense.com)\, a blog for businesses concerned with avoiding and defending lawsuits brought under the Americans with Disabilities Act and Fair Housing Act. Richard frequently writes\, speaks and presents webinars on the ADA\, FHA\, and professional responsibility issues among other topics. He has been interviewed by The Economist\, Forbes and other publications on issues related to ADA and FHA litigation. \n \nJessie Weber\, Partner\, Brown\, Goldstein and Levy\, LLP – Plaintiff (co-moderator) \nJessie Weber is Managing Partner at Brown\, Goldstein & Levy\, LLP (“BGL”)\, where she works on a range of civil litigation matters nationwide\, with a focus on disability rights\, fair housing\, workplace justice\, and appellate litigation. SUMMARY:Webinar: Why Your Office Should Prioritize Wellness and How to Do So
DESCRIPTION:**Program hosted in (ET) Time Zone** \nThis program examines how legal organizations can move beyond awareness campaigns and wellness pledges toward sustainable operational practices that support lawyer well-being\, professionalism\, competence\, and organizational health. Drawing from ABA lawyer well-being initiatives\, the ABA Well-Being Pledge framework\, current lawyer mental-health research\, and implementation strategies emerging across the legal profession\, the session focuses on practical leadership\, culture\, and systems-level approaches to reducing stigma and improving sustainable performance. \nParticipants will explore the organizational barriers that often prevent implementation\, including stigma\, confidentiality concerns\, workload norms\, presenteeism\, leadership ambivalence\, and measurement challenges. The discussion introduces a practical “Pledge to Practice” implementation model that legal organizations can adapt across law firms\, courts\, government agencies\, legal departments\, bar associations\, and law schools. \nThe program also examines how legal organizations can measure progress using leading indicators\, lagging indicators\, and qualitative culture signals without reducing well-being solely to productivity metrics. Particular attention is given to transformational leadership behaviors\, psychological safety\, early help-seeking\, sustainable performance\, retention\, and professional identity formation. \nThis session is designed as a practical\, discussion-oriented CLE that equips attendees with actionable strategies they can begin implementing within 30 to 90 days. \nPresented by the FBA’s Professional Development Committee. \nRegister Now!\n\nPresenters\nModerator: Adam Stolz is a trial attorney at Homer Bonner Jacobs Ortiz & Dimond — and a staunch advocate for mental health awareness. Adam previously served as a federal clerk for Judge Paul C. Huck. He graduated with high honors from the University of Miami School of Law\, where he served on the Executive Board of the University of Miami Law Review and as a member of the Moot Court Board. Adam continues to give back to Miami Law as a mentor to many students and a coach for the Moot Court team. He is also deeply passionate about mental health advocacy and serves as Vice Chairman of the Board for the National Alliance on Mental Illness (NAMI): Miami-Dade County chapter\, which provides free mental health support\, online groups\, resources and education to the community. He has also served on Boards of behavioral healthcare nonprofits focused on integrated care for addiction and mental illness. \nTy Kelly is the founder and co-chair of BakerWell\, Baker Donelson’s firmwide wellness initiative dedicated to supporting the mental\, physical\, and emotional health of every employee. In this role\, she leads programs that foster resilience\, balance\, and well-being across the organization\, ensuring that wellness is embedded into the culture of one of the nation’s largest law firms. As a member of Baker Donelson’s Board of Directors\, Ty champions initiatives that prioritize wellness alongside peak performance. In her white collar and complex civil litigation law practice\, she solves hard problems and is recognized for her instinct\, judgment\, and ability to communicate complex issues with clarity — qualities that now serve her well in advancing innovative approaches to workplace wellness. In May 2025\, she authored Failing to Invest in Wellness Is Planning to Fail Where It Matters Most\, published by the American Bar Association\, which provides a roadmap for law firms to build sustainable wellness programs that support both people and performance and was recently featured in SuperLawyers. With more than 20 years of experience in high-stakes litigation and government investigations work\, Ty brings a deep understanding of the pressures faced by legal professionals in increasingly demanding environments. Ty spent the first half of her career as a federal prosecutor with the Department of Justice and has spent the last decade in private practice. She is also a Fellow in the American College of Trial Lawyers. Ty also keenly understands the pressures of building and maintaining a law practice while balancing life. At home\, she loves spending time with her husband\, three children\, and two cockapoos. \nDr. James Keshavarz is the Chief Wellness Officer at Gibson Dunn. He holds a Doctor of Psychology (PsyD)\, an MBA in Health Care Management\, and an MS in Exercise Science and Health Promotion. Guided by the values of integrity\, kindness\, and empathy\, his work is built on the belief that well-being is not solely an individual responsibility but a shared one\, shaped by communities\, organizations\, and systems that can either protect or undermine mental health. James serves as Chair of the American Bar Association’s Well-Being Pledge Committee and sits on the Board of Directors for the Institute for Well-Being in Law. He is also a member of the ABA’s Commission on Lawyers Assistance Programs Committee and previously chaired the Institute’s Awards Committee. Earlier in his career\, James practiced as a Kinesiologist specializing in injury prevention and performance enhancement and taught as an adjunct professor of Kinesiology and Health Sciences at Glendale Community College\, where he received the Distinguished Professor Award in 2019. As a member of the United States Air Force Reserves\, James has been recognized as Airman of the Year (2018) for his resilience initiatives within the 452nd Air Mobility Wing and awarded the Air Force Humanitarian Medal (2022) for his COVID-19 response efforts. His additional military honors include the Air Force Commendation Medal\, the Air Force Achievement Medal (twice)\, the Global War on Terrorism Medal\, and the Nuclear Deterrence Operations Service Medal. SUMMARY:Webinar: How Employee AI Use Destroys Trade Secret Protection: DTSA Plaintiff and Defense Practice After Trinidad
DESCRIPTION:**Program hosted in (ET) Time Zone** \nEvery time an employee pastes proprietary information into ChatGPT\, that keystroke can extinguish the secrecy a DTSA claim depends on — and courts have started saying so. Trinidad v. OpenAI\, Snyder v. Beam Technologies\, and United States v. Heppner are converging into a doctrine that treats uncontrolled AI access as a failure of reasonable measures\, reframing voluntary disclosure and terms-of-service consent as secrecy-destroying events rather than background facts. Any litigator handling trade secret matters — and any counsel advising employers who deployed consumer-grade AI without use policies — is already exposed\, often operating on pleading templates drafted before these decisions existed. This program maps how voluntary AI disclosure defeats trade secret status at the pleading stage and summary judgment\, distinguishes consumer from enterprise tiers in the reasonable-measures inquiry\, and supplies the discovery targets\, motion-practice frameworks\, and “improper means” theories both sides need. You will leave able to plead trade secret identity with the specificity courts now demand\, attack secrecy through ToS and policy gaps\, and litigate either side with current doctrine. \nPresented by the FBA’s Professional Development Committee and Intellectual Property Law Section\n \nRegister Now!\n\nPresenters\nBenjamin Fink\, President & Founding Shareholder\, Berman Fink Van Horn P.C\nBenjamin I. Clients and peers alike regard him as a leading voice in his field\, reflected in his sustained recognition by the profession’s most respected ranking organizations. \nPeter Toren\, Intellectual Property Litigator and Advisor\, Peter J. Toren\nPeter J. SUMMARY:Webinar: Judicial Intern Academy: Navigating Admiralty and Maritime Jurisdiction
DESCRIPTION:**Program hosted in (ET) Time Zone** \nJoin Michelle Otero Valdés\, FBA National Director and Immediate Past Chair of the FBA Admiralty Law Section\, Carlos Llinás Negret\, Current Chair of the FBA Admiralty Law Section and Adam B. Cooke\, Membership Chair of the FBA Admiralty Law Section\, for an overview of admiralty and maritime jurisdiction—an issue that can confound the most experienced lawyers from both sides of the aisle. \nThis program will explore the history\, the distinction between “admiralty” and “maritime” and subject matter jurisdiction\, where Article III of the Constitution extends the federal judicial power to “all Cases of admiralty and maritime Jurisdiction.” By giving the Federal Judiciary jurisdiction over admiralty cases—and authorizing Congress to regulate that jurisdiction—the U.S. Constitution’s Framers sought to ensure that federal courts would resolve cases that might implicate the Nation’s foreign policy. The Supreme Court has explained that Article III’s grant of admiralty jurisdiction to the federal courts contemplates a system of maritime law coextensive with\, and operating uniformly in\, the whole country in order to promote the great interests of navigation and commerce and maintain the United States’ “diplomatic relations.” Gain valuable insight into admiralty and maritime jurisdiction that defines the general maritime law of the United States. \nRegister Now!\nPresented by the Federal Bar Association’s Admiralty Law Section \n\nPresenters\n\nMichelle Otero Valdés  \nMs. Valdés has been engaged exclusively in the practice of maritime\, admiralty and marine insurance law for over twenty-five (25) years and is experienced in all facets of civil litigation\, including\, but not limited to\, collisions\, allisions\, groundings\, emergency casualty response\, maritime attachments and arrests\, marine pollution claims under OPA90 and CLC Conventions\, defense of maritime death and injury claims\, passenger and crew claims\, marine casualty investigations\, P&I and FDD matters\, H&M claims\, subrogation claims\, claims coverage evaluation\, salvage and SCOPIC matters\, cargo claims and recoveries\, charter party disputes\, Marpol and environmental matters\, general liability defense\, freight forwarders/NVOCC liability claims\, and the negotiation and drafting of maritime-related contracts\, including marine loan documents\, purchase and sale agreements\, charter parties\, marina contracts\, ship vendor contracts\, yacht purchase/sale agreements\, chartering\, and registration of domestic and foreign vessels\, shipbuilding contracts\, crew agreements\, corporate non-compete/non-disclosure agreements and a host of other international commercial transactions and agreements focused in and around the maritime industry. \nMs. Valdés has been counsel in several high-profile cases and\, as a previous Account Executive of Thomas Miller Inc. SUMMARY:Qui Tam Section: [VIRTUAL] Forensic Accounting Across the FCA Lifecycle
DESCRIPTION:**Program hosted in (ET) Time Zone**\n\n\n\nSuccess in a False Claims Act matter—whether you define that as a government\, relator\, or defense verdict—can turn on whether complex financial data can be transformed into clear\, credible proof—and whether you can do so early enough to drive sound strategic decisions. From initial relator disclosures through DOJ intervention decisions\, litigation\, and resolution\, forensic accounting can play a critical role in shaping FCA cases. This program examines how forensic accountants support FCA matters across the full lifecycle of a qui tam case. The panel will discuss how financial analysis helps test insider allegations\, identify and map alleged schemes\, frame damages at an early stage\, distinguish suspicious activity from actionable conduct\, and translate large\, commingled\, or high volume datasets into defensible evidence. The discussion will highlight how forensic accounting can inform decision making for relators and their counsel\, support efficient government investigation and intervention analysis\, and enable defendants to assess exposure\, challenge assumptions\, and value cases earlier and more realistically. Panelists will address best practices and common pitfalls at each stage\, from prefiling to trial\, using real-world FCA contexts such as healthcare billing\, government contracting\, grant programs\, alleged kickbacks\, and cases driven by systemic rather than isolated alleged misconduct. The program will conclude with practical takeaways for each stakeholder group on how early financial discipline and rigorous methodology can strengthen outcomes\, reduce risk\, and improve resolution strategies in FCA litigation. \nRegister Today!\nPresented by the FBA Qui Tam Section \n\nPresenters\nMODERATOR \n \nJulie K. SUMMARY:Qui Tam Section: [VIRTUAL] Ethical & Practical Insights from Former FCA Prosecutors in Private Practice
DESCRIPTION:**Program hosted in (ET) Time Zone**\n\n\n\nJoin the FBA’s Qui Tam Section for a timely and practical discussion with a panel of former government attorneys who have since moved to the private sector. The panelists—all attorneys who recently went in-house or joined the relator’s or defense bar—will share insights from their times in government service (and since then) that will be useful to lawyers who have recently left DOJ or a USAO\, as well as to practitioners who seek a peek behind the curtain as they advise clients on FCA matters. The conversation will include a discussion of how recent government departees can navigate conflicts\, confidentiality obligations\, matter restrictions\, and client or firm expectations. The discussion also will address the practical opportunities and challenges that come with entering private practice after government service\, including how former DOJ and USAO attorneys are viewed by (and can interact most effectively with) clients\, relators’ counsel\, defense counsel\, and the government. Throughout\, the panelists will share practical strategies for engaging most productively with government counsel given their past experience and will discuss how lawyers without prior government experience have teamed up with former DOJ/USAO attorneys to provide clients with enhanced representation. \nRegister Today!\nPresented by the FBA Qui Tam Section \n\nPresenters\nMODERATOR \n\nAmy D.
