SUMMARY:Webinar: Lincoln\, Napoleon and Hitler Walk Into A Bar: Does the 1907 Hague Convention on Land Warfare Require Signatory Countries To Open Courts To Claims For Restitution of Nazi-Looted Art?
DESCRIPTION:The Hague Conventions\, The Lieber Code and International Law \n**Program hosted in (ET) Time Zone** \nDo statutory bars to Holocaust victim families recovering looted artworks violate the international law of war? Our speaker explores this question. Article 47 of the 1899 and 1907 Hague Conventions on Land Warfare forbids pillage. Article 56 requires “legal proceedings” for seizures of artworks. Following World War II\, using statutes of limitations and acquisitive prescription\, many Hague Convention signatories closed their courts to Nazi-era claims to recover pillaged and seized artworks. Closing courts to “legal proceedings’ violates the Hague Convention\, defeats its goal of taking the profit motive out of wars of aggression\, and rewards concealment and laundering stolen property. In the United States\, Congress passed the Holocaust Victims Redress Act of 1998 (the “HVRA“) to apply the 1907 Hague Convention to claims involving Nazi looted art. The Holocaust Expropriated Art Recovery Act of 2016 (the “HEAR Act”) reopened U.S. courts and extended statutes of limitations by six years for past and future claims to artworks and cultural property lost as a result of Nazi persecution. Our speaker urges that the U.S. approach of re-opening the courts is required by the Hague Convention. Hague Convention compliance could be best achieved by a Directive from the European Parliament requiring re-opening courts to such claims. \nRegister Today!\nPresented by the Federal Bar Association’s Veterans and Military Law Section and International Law Section. \n\nAbout the Presenters\n \nRaymond J. Dowd is a managing partner of the law firm Dunnington Bartholow & Miller LLP in New York City. He acts as problem-solver for businesses\, not-for-profits and individuals confronting potential investigations\, litigation\, arbitration and mediation. He serves as lead counsel in high-stakes litigation in state and federal trial and appellate courts in disputes often centered on foreign law issues. He has obtained multimillion-dollar intellectual property judgments\, recovered Nazi-looted art\, and scored landmark trusts and estates decisions from Surrogate’s Court to the New York Court of Appeals (including removing the butler from the Estate of Doris Duke and representing the Republic of Germany in recovering an ancient Assyrian tablet for Berlin’s Pergamon Museum). \nRay authored Copyright Litigation Handbook in 2006 and updates it annually with decisions focusing on the Federal Rules of Civil Procedure. He has testified as a New York law expert before London’s High Court. He teaches trial advocacy through use of statistics\, data and charts and use of expert witnesses at his alma mater Fordham Law School. In 2019 he received the Roger J. Goebel International Alumni Award. Current scholarship focuses on the 1907 Hague Convention on Land Warfare and its impact on art restitution claims. \nRay’s past volunteer service includes National Arts Club\, Board of Governors and Chair\, Audit Committee\, Federal Bar Association\, General Counsel and Board of Directors\, Southern District of New York President\, Network of Bar Leaders President\, American Foreign Law Association President. Anna has served in that role since 2010\, after previously working as a VLS staff attorney. In 2018\, under the leadership of Anna and her co-director\, Sarah Roxburgh\, VLS received the Massachusetts Lawyers Weekly’s Reginald Heber Smith Award for Excellence in Legal Services. In 2019\, she was named co-Lawyer of the Year by the Frank J. Murray Inn of Court and was also a Massachusetts Lawyers Weekly “Top Women in the Law” honoree. Anna successfully argued Dept. of Revenue v. Grullon\, 485 Mass. 129 (2020)\, protecting the rights of indigent parents from wrongful incarceration in child support proceedings. Anna was also appointed by the Trial Court to the Massachusetts Child Support Guidelines Task Force in 2020 and 2024. \nIn addition to her legal work at VLS\, Anna has led trainings on veterans’ legal issues for the Boston Bar Association\, the Massachusetts Continuing Legal Education\, and various legal services agencies throughout Massachusetts. \nAnna received her B.A. from Boston College and her J.D. from Boston University School of Law. She currently serves on the board of the Mental Health Legal Advisors Committee\, appointed by the Massachusetts Supreme Judicial Court.\n \n  \nKatie Becker – Instructor at the Veterans Legal Clinic\, University of Missouri School of Law \nKatie M. Becker is a staff attorney and instructor at the Veterans Clinic at the University of Missouri School of Law. In this role\, she supervises students\, teaches classes\, and manages an active caseload assisting veterans and their dependents with obtaining benefits they have earned through service to our country\, primarily before the U. S. Department of Veterans Affairs and the Department of Defense.  She also serves as the chair of the amicus advocacy committee of the National Law School Veterans Clinic Consortium. \nBecker previously served as a staff attorney for the Veterans Legal Clinic at the University of Georgia School of Law\, and an associate appellate attorney with Chisholm Chisholm & Kilpatrick in Providence\, RI. She also worked for the Veterans Consortium Pro Bono Program in Washington\, D.C. \nBecker earned her law degree magna cum laude from Syracuse University ​College of Law where she served as an executive editor of the Syracuse Law Review\, was inducted into the Order of the Coif\, and served for four semesters as a student attorney in the school’s Veterans Legal Clinic. \n  \nThomas Roughneen \nThomas Roughneen served as an Assistant Prosecutor in Union and Essex Counties for nine years starting back in 1998.  He opened his own law practice in 2014 to serve the unique interests of military members and Veterans. He served on active duty and with other law firms through the years.  His general practice is in New Brunswick\, New Jersey and he opened a second office in Huntsville\, Alabama. CitizenSoldierLaw accepts military-related matters for troops and veterans from around the world and conducts a wide range of civil and criminal litigation. \nHe enlisted in 1988 and attended Army Basic Training as a Private in the New Jersey Army National Guard.  He received his commission as a Field Artillery Officer and retired as an Army Judge Advocate after service in Iraq conducting civil-military operations in Kirkuk and the Sunni Triangle in Iraq in 2003 and 2004.  He later served as defense counsel to Salim Hamdan\, a Guantanamo Bay detainee\, before mobilizing again as a military prosecutor at Fort Dix\, followed by a tour as a Brigade Judge Advocate in Germany. His last active-duty mobilization was as an adjudicator at the Physical Evaluation Board in Arlington\, Virginia\, where he reviewed Army Soldiers’ claims for disability retirement. \nHe graduated from Johns Hopkins University\, School of Advanced International Studies with a Masters Degree in 2007\, received his Juris Doctorate from Seton Hall University School of Law in 1995 and earned his undergraduate degree from Rutgers College in 1991. He is married to Alice Tzeng\, M.D.\, and is blessed with two daughters and a son. \nFormerly\, he served as Chairman of the Military Law and Veterans Affairs Section when the New Jersey State Bar Association successfully lobbied for the Criminal Diversion Program law. \n  \nJonathan Crisp  \nJonathan Crisp founded and is the sole Owner and Member of Crisp and Associates Military Law in 2007 after serving on active duty in the U.S. Army Judge Advocate General’s Corps JAG for almost seven years.  When he transitioned from active duty\, he immediately joined the Pennsylvania Army National Guard where he served for the next fifteen (15) years and retired in November 2021 as a Lieutenant Colonel. Prior to joining the U.S. Army JAGC Corps\, he served as a county Public Defender in Centre County\, PA \nMr. Crisp has litigated more than 210 jury (panel) trials to verdict and resolved numerous others short of litigation. He has represented clients in and out of uniform all over the United States and around the world\, to include Kuwait\, Iraq\, Bahrain\, Korea\, Germany\, Italy\, Spain\, Japan and Kosovo. \nMr. Crisp began his career as an Assistant Public Defender in Centre County\, Pennsylvania. He left the Centre County Public Defender’s Office to join the U.S. Army Judge Advocate General’s Corps. In the Judge Advocate General’s Corps\, he first served as a Legal Assistance Attorney and then the Chief of Legal Assistance at Patton Barracks in Heidelberg\, Germany. \nMr. Crisp then served as a Defense Counsel in Ansbach\, Germany\, where he represented soldiers at administrative proceedings and courts-martial. He was subsequently selected to be the Senior Defense Counsel in Fort Jackson\, South Carolina.  Two of the more high-profile cases in which Mr. Crisp was involved as a servicemember involved charges of abuse against detainees at Abu Ghraib and a case involving the death of a detainee during an interrogation. \nAfter leaving active duty\, Mr. Crisp co-founded Crisp & Associates\, LLC in 2007.  His efforts in intervening 16 plus years has seen the firm grow from a solo practice operation to a firm of eight (8) attorneys and twelve (12) support staff who serve the needs of service members in all facets of their career and have led to representing civilians in other high-profile cases. Most recently\, he defended an individual who was a member of the Oathkeepers indicted on charges of sedition\, of which she was acquitted. \nMr. Crisp was born and raised in Philadelphia\, PA and has been married for over 24 years to Angela; they have two children\, Ivan and Elsie.  They currently reside in Harrisburg\, PA. \n  \nEmma Peterson  \nEmma joined CCK in 2014 and serves as a Managing Attorney. Her practice focuses on representing disabled veterans and their families before the U.S. Court of Appeals for Veterans Claims\, the Board of Veterans’ Appeals\, and the Department of Veterans Affairs. \nEmma graduated from Connecticut College with a B.A. in Government in 2007 and graduated cum laude from Roger Williams University School of Law Honors Program in 2011. \nWhile in law school\, Emma was a member of the Trial Team\, the Women’s Law Society\, and served as a Rule 9 Student Attorney with the Rhode Island Attorney General’s Office. SUMMARY:Webinar: The PACT Act and its Implications for Representing Veterans in VA Disability Cases
DESCRIPTION:Signed into law in August 2022\, the PACT Act was created to help provide generations of veterans and their families with the care and benefits they need and deserve.  The PACT Act expanded VA health care and benefits to veterans exposed to burn pits\, herbicides\, and other toxic substances.  This webinar will highlight the PACT Act’s provisions and the effects of those legal changes on the pursuit of VA disability benefits. \nPresented by the Veterans and Military Law Section \n\nAbout the Presenters\nMaura Jean Black\, Esq.\, Managing Attorney\, Chisholm Chisholm & Kilpatrick LTD\nMaura is a managing attorney at Chisholm Chisholm & Kilpatrick LTD in Providence\, Rhode Island\, where she specializes in representing disabled veterans and their families before the U.S. Court of Appeals for Veterans Claims\, the Board of Veterans’ Appeals\, and the Department of Veterans Affairs.  Throughout her career\, she has represented hundreds of veterans and their dependents in their pursuit of VA benefits.  She has presented and organized numerous continuing legal education events that have focused on service-connected VA benefits and appeals\, VA’s appeals reform legislation\, and petitions for writs of mandamus at the U.S. Court of Appeals for Veterans Claims.  In the spring of 2022\, Maura served as a panelist during an Appeals Modernization Act presentation at the Fifteenth Judicial Conference of the U.S. Court of Appeals for Veterans Claims. Maura is an active member of the Federal Bar Association.  From 2017 to 2022\, she served in leadership positions in the FBA’s Veterans and Military Law Section.  She is currently the deputy chair of the Sections and Divisions Council. Prior to joining Chisholm Chisholm & Kilpatrick in 2016\, Maura gained experience as an associate attorney in a civil litigation firm\, a judicial law clerk in the Rhode Island Superior Court\, and an intern with both the Rhode Island Public Defender’s office and Rhode Island Legal Services.  She is a member of the Massachusetts and Rhode Island state bars and is admitted to practice before the U.S. District Court for the District of Rhode Island and the U.S. Court of Appeals for Veterans Claims.  Maura spends her free time cooking\, fitness training\, spending time with her friends and family\, and enjoying Rhode Island’s East Bay Bike Path. \nNicholas A. M. District Court to find that courts-martial jurisdiction over retirees is unconstitutional.  Although the Supreme Court declined to hear Larrabee v. Col. Justin M. Marchesi\, United States Army Judge Advocate General’s Corps\nLieutenant Colonel Justin Marchesi serves as the Professor and Chair of the National Security Law Department at the Judge Advocate General’s School in Charlottesville\, Virginia. Supervising a department of nine\, he oversees the development and delivery of diverse curricula covering domestic and international law topics such as jus ad bellum\, jus in bello\, war crimes\, law of air\, space and sea\, constitutional law\, intelligence law\, cyber law\, detention law\, human rights law\, and international legal interoperability in a wide variety of courses\, including an ABA-accredited LL.M. program. Lieutenant Colonel Marchesi began his career as a Distinguished Military Graduate from the University of Southern California in 2003 where he earned a B.A. in International Relations and a commission in the United States Army. He was selected later to participate in the Army Funded Legal Education Program and successfully completed his studies at William & Mary Law School after serving as Editor-in-Chief of the William & Mary Bill of Rights Journal. More recently\, he received an LL.M. in Military Law from the Judge Advocate General’s School in 2013. SUMMARY:Webinar: USERRA: What Matters in Protecting our Service Members' Employment Rights
DESCRIPTION:The presentation provides an overview of USERRA\, which encourages service in the uniformed services by eliminating or minimizing the disadvantages to civilian careers and employment which can result from such service; seeks to minimize disruption to the lives of persons performing such service\, as well as to their employers\, their fellow employees\, and their communities\, by providing for the prompt reemployment of such persons upon their completion of such service; and prohibits discrimination against persons because of their service in the uniformed service. USERRA also prohibits retaliation against both persons seeking protections under the Act\, and any other persons assisting such persons seeking protections\, even if they lack status in the uniformed services. \nThe presentation is designed to provide familiarization and help develop an understanding of USERRA for decision-makers considering USERRA-related questions\, and for professionals providing USERRA advice and counsel to employers. The presentation may also be helpful for attorneys providing advice and counsel to veterans and uniformed service members as employees. The presentation will also describe the process for the filing of a USERRA complaint\, VETS’ role in the investigation of such complaints\, and the potential referral of such complaints to the Department of Justice or the Office of Special Counsel. \nVeterans are integral to shaping the modern workforce. Since September 11\, 2001\, more than 1M National Guard and Reserve uniformed service members have mobilized in support of the Global War on Terror\, and more than 964\,000 have returned\, with nearly 38\,000 remaining on active duty. In July 2019\, the veteran unemployment rate was 3.4 percent\, which is lower than the seasonally adjusted non-veteran unemployment rate of 3.6 percent. Utilizing the seasonally adjusted unemployment rate\, this is the 11th consecutive month where the veteran unemployment rate was lower than the non-veteran unemployment rate. There are more veterans in the workforce now than there have been in years. \nHiring and retaining veterans makes good business sense. They have strong personal integrity; they triumph over adversity\, work independently\, and have strong leadership qualities. They appreciate the value of teamwork\, and will refer other veterans\, which is critically important to shaping the modern workforce. Hiring and retaining veterans provide employers the opportunity to bring in like-minded veterans while reducing the time it takes to fill positions. According to SHRM’s 2017 Talent Acquisition survey\, survey tools used to source candidates ranks employee referrals at 90%\, and\, according to the 2016 SHRM survey\, it takes an average of 42 days to fill a position at the average cost-per-hire of $4\,129.00. Moreover\, according to a January 2017 article in The Huffington Post entitled\, “How Much Does Employee Turnover Really Cost\,” “the cost of losing an employee can range from tens of thousands of dollars to 1.5-2x the employee’s annual salary.” \nCompliance with USERRA makes good business sense as well. Since September 11\, 2001\, there has been an increase in USERRA complaints filed\, averaging more than 1\,200 complaints annually\, as wells as a tremendous increase in USERRA inquiries. Maintaining a clear understanding of responsibilities under USERRA will help employers avoid future complaints and tap into the full potential of this vital and vibrant aspect of the modern workforce. \nRegistration is now closed \n\nAbout the Presenters\nWilliam K. “Kenan” Torrans\, Director\, Compliance and Investigations Division\, Veterans’ Employment and Training Service’s (VETS)\nWilliam K. “Kenan” Torrans presently serves as Director for the Veterans’ Employment and Training Service’s (VETS) Compliance and Investigations Division. He has been employed with VETS since March 2004. A national speaker\, Mr. Torrans has spoken and lectured extensively on USERRA and related issues before a number of professional organizations including the American Bar Association\, many State bar associations and law schools\, the U.S. Army JAG School\, chambers of commerce\, the Society of Professional Benefits Administrators\, the Equal Employment Advisory Counsel\, as well as the national media including 60 Minutes\, National Public Radio (NPR)\, and many others. \nMr. Torrans received his JD from the University of Baltimore School of Law in 1994\, and is licensed to practice in Maryland and in the District of Columbia. Prior to his tenure with VETS\, Mr. Torrans was Counsel to the U.S. Department of Veterans Affairs\, Board of Veterans’ Appeals from 1997 to 2004. He also worked as a contract attorney with the U.S. Department of Justice\, Civil Rights Division\, Disability Rights Section from 1995 to 1997\, enforcing public access provisions of the Americans with Disabilities Act (ADA). \nMr. Torrans’ experience includes multi-district Federal and appellate litigation. Active in civic affairs\, including membership on a number of boards and commissions in the Washington Metro area\, he served as Consumer Affairs Commissioner for the City of Alexandria from 1996 to 2004 with a primary focus on identity theft and related issues. Mr. Torrans is also a contributing member of the Maryland State Bar Association’s Military Law Committee. He currently resides in Northern Virginia and is an Army veteran of Operations Desert Shield/Desert Storm. \nPaul A. Marone\, Senior Compliance Policy Advisor\, Veterans’ Employment and Training Service (VETS)\nPaul A. Marone currently serves as the Senior Compliance Policy Advisor for the U.S. Department of Labor\, Veterans’ Employment and Training Service (VETS). In that role\, he serves as VETS’ national technical advisor for all USERRA field activities and program operations. Previously\, he served as the Senior Investigator in VETS’ Philadelphia Region providing substantive guidance and oversight in the investigation of USERRA and veterans’ preference claims brought by veterans and service members in the Region. Before joining VETS in 2015\, Mr. Marone served as a trial attorney with the Department’s Solicitor’s Office since 2007. He handled a variety of labor and employment matters throughout the Department’s program areas\, including VETS\, MSHA\, OSHA\, Wage Hour\, Labor Relations\, and Whistleblower Protection\, most notably the Chickie’s & Pete’s FLSA tipped employee case\, the A-1 Mortgage FLSA commissioned broker case\, the CETUSA J-1 student visa case\, and the Cumberland Coal MSHA lifeline case. \nMr. Marone previously served on active-duty with the U.S. Army Judge Advocate General’s Corps\, was an associate employment law attorney in a small firm\, and a Special Assistant U.S. Attorney in Maryland\, the latter for nearly ten years. He joined the Department from the City of Philadelphia Law Department\, Civil Rights Unit\, where he served as a Deputy City Solicitor defending the City and its police officers in excessive force\, fatal shootings\, and First Amendment cases in federal and state courts. \nMr. Marone received his B.A. and J.D. degrees from Fordham University in 1988 and 1991\, respectively\, an LL.M. in Trial Advocacy in 2004 from Temple University\, where he was an adjunct professor of trial advocacy from 2006 through 2009\, and a Master of Strategic Studies degree from the U.S. Army War College in 2011. In 2016\, Mr. Marone retired from the U.S Army Reserve as a Colonel\, and most recently commanded the 13th Legal Operations Detachment (Expert). Bobby Luyties is an instructor in the Military Justice Division at the Air Force Judge Advocate General’s School at Maxwell AFB\, Alabama. \nMaj.
