SUMMARY:Webinar: Confidentiality in Mediating Federal Administrative Law Cases

SUMMARY:Indian Law & TTSL Sections: Tribal Transportation Equity Panel
DESCRIPTION:This program\, jointly hosted by the FBA Indian Law and Transportation and Transportation Security Law sections\, is designed to share information with transportation and Tribal law practitioners regarding opportunities to use transportation programs to enhance Tribal sovereignty and address equity challenges in Indian country. Historically\, transportation infrastructure in Tribal communities has been underfunded\, which has resulted in hardships to Tribal communities. In recognition of this underinvestment and its consequences\, the Bipartisan Infrastructure Law (BIL or Infrastructure Investment and Jobs Act) increased investment in Tribal community transportation infrastructure. This program will highlight transportation programs in the BIL specifically designed to support Tribes\, as well as select other programs in the BIL that Tribes are eligible to apply for funding under\, and which may be used to advance equity and Tribal sovereignty. The discussion will also focus on the Tribal Transportation Self-Governance Program\, which was authorized by the FAST Act and provides Tribes with greater control\, flexibility\, and decision-making authority over federal funds used to carry out Tribal transportation programs\, functions\, services and activities in Tribal communities. Reynolds\, Deputy Director for Aviation and Space Policy\, U.S. Senate Committee on Commerce\, Science and Transportation \nMichael Reynolds is a Deputy Policy Director on the staff of the Senate Committee on Commerce\, Science\, and Transportation and is the team lead for aviation for Ranking Member Roger Wicker (R-MS).  Prior to joining the Commerce Committee in 2015 (under then-Chairman Thune) as aviation counsel\, Mr. Reynolds was a stay-at-home parent living with his family in the Netherlands. \nMike previously worked for Booz Allen Hamilton as an Executive Advisor and at DOT as the Deputy Assistant Secretary of Transportation for Aviation and International Affairs from October 2002 until January 2009.  While at DOT\, he served as the Acting Assistant Secretary for more than two years. \nBefore joining the DOT\, Mr. Reynolds spent seven and a half years serving as aviation counsel on the Senate Commerce Committee. In 1997\, Mr. Reynolds took a six-month leave of absence from his Senate position to serve as General Counsel to the National Civil Aviation Review Commission (also known as the Mineta Commission). Prior to joining the public sector\, Mr. Reynolds worked as a litigator in a prominent law firm in the San Francisco Bay Area. \nMr. Reynolds has an undergraduate degree in Political Science from Stanford University and a law degree from the College of William and Mary. \nJill Harrelson\, Chief Counsel\, Democratic\, Committee on Transportation and Infrastructure\, U.S. House of Representatives \nJill Harrelson is the Chief Counsel for the House Committee on Transportation and Infrastructure Majority Staff\, where she manages Committee activities including hearings\, markups\, and consideration of legislation on the House floor\, and advises on how to implement the legislative priorities of the Chair. She joined the Committee in 2019 as the Director of Budget/Deputy Counsel before serving in her current role. Prior to joining the T&I Committee\, Jill worked for the Senate Budget Committee for five years\, holding a variety of positions including Counsel and Analyst for Transportation and Revenue. Jill’s career on Capitol Hill spans almost 14 years and prior to her committee work includes serving as a Legislative Assistant for Congresswoman Matsui and a Legislative Correspondent for Senator Bingaman. \nJill holds a B.A. from the University of New Mexico\, a J.D. from American University\, Washington College of Law\, and an L.L.M. in Taxation from Georgetown University. Proctor is the Assistant Administrator for Surface Operations\, which aligns surface transportation security operations under direct executive leadership to provide the most effective and efficient security solutions for the four modes of land-based transportation: mass transit\, freight rail\, highway motor carrier and pipeline.  Serving in TSA\, Ms. Proctor’s executive accomplishments have spanned the policy\, law enforcement and security operations areas. \nShe brings to TSA an extensive operational background in law enforcement and transportation security.  Ms. Proctor started her law enforcement career in the Nation’s Capital\, with the Washington\, D.C. Metropolitan Police Department. During her twenty-five-year tenure she served in the patrol and investigative ranks\, directing and leading the department through many city wide challenges\, including crime reduction\, civil disturbances\, sensitive investigations and significant departmental reorganization. She rose to command many key positions\, among them\, the Human Resources Bureau for the Department\, the Office of Internal Affairs\, and the Special Events Unit of the Special Operations Division\, which handles all major events\, Presidential escorts\, parades\, marches\, and demonstrations – scheduled and unscheduled – in the Nation’s Capital. She also served as Commander of the Third Police District\, often recognized for its broad diversity and model community policing approach she developed with her community partners. She served in every rank from patrol officer to Chief of Police\, retiring from the department\, after serving as the Chief of Police\, in an interim capacity. \nMs. Proctor went on to serve as the Chief of Police for the national Amtrak Police Department\, developing a new strategic blend of city policing in a passenger railroad environment. In conjunction with NYPD Commissioner Ray Kelly\, Ms. Proctor co-chaired the Northeast Corridor Coalition\, a group of law enforcement leaders along the Amtrak route between Washington\, DC and New York City to enhance post 9-11 security for passengers on that heavily travelled route. \nA graduate of the 130th session of the FBI National Academy and a life member of the International Association of Chiefs of Police\, she remains active in the national and international law enforcement community. Ms. Proctor earned her bachelor’s and master’s degrees from the Johns Hopkins University. \nMichael Stephens\, General Counsel and Executive Vice-President\, Tampa International Airport \nMichael A. Stephens serves as General Counsel & Executive Vice President for the Hillsborough County Aviation Authority and Tampa International Airport. In addition to being a member of the Authority’s executive leadership team\, he oversees all legal\, regulatory\, compliance and information technology matters. He is responsible for providing legal opinions and advice to the CEO and Board Members on a wide variety of legal matters related to all aspects of the Aviation Authority’s governance and operation of Tampa International\, Peter O Knight\, Plant City\, and Tampa Executive Airports. \nMichael has over 20 years of experience managing complex legal\, compliance\, human resources\, risk management and information technology issues. Prosnitz serves as Acting Deputy Assistant Administrator for Operations Support with the Transportation Security Administration.  Operations Support oversees various offices\, including policy\, intelligence and analysis\, vetting\, and technology capabilities. As an Assistant Staff Judge Advocate\, Bryan served as the Chief of Labor Law/Employment Law\, Chief of Military Justice\, Special Assistant United States Attorney (SAUSA)\, and Appellate Defense Counsel\, over multiple assignments. Bidwell\, Senior Vice President\, Security for Airports Council International – North America (ACI-NA) \nChristopher Bidwell was named Senior Vice President\, Security for Airports Council International – North America (ACI-NA) in January 2019. In this position\, he is responsible for leading the association’s efforts on aviation security and oversight of ACI-NA’s regulatory activities. Bidwell serves as a subject matter expert\, providing guidance on security policy\, monitoring domestic and international aviation security developments as well as regulatory actions and programs affecting security at North American airports. Bidwell represents industry aviation security interests as a member of several Department of Homeland Security (DHS) and Transportation Security Administration (TSA) committees and working groups. He chairs the DHS Aviation Sector Coordinating Council (ASCC) and serves as the vice chair of the TSA Aviation Security Advisory Committee (ASAC)\, providing recommendations to further enhance aviation security. \nThomas Bush\, Deputy Executive Assistant Administrator for Operations Support\, Transportation Security Administration \nThomas Bush was named the Deputy Executive Assistant Administrator for Operations Support in March 2020. He is currently leading the Business Resumption Task Force\, which is charged with the planning and coordination of TSA’s return to full operations\, as well as the future state of operations\, following the COVID-19 pandemic. He comes to Operations Support from the Intelligence and Analysis program office where he served as the Assistant Administrator since November 2015. He was previously the Deputy Assistant Commissioner for the Office of Intelligence with U.S. Customs and Border Protection. Prior to his role as CBP\, Bush served a two-year assignment as the Senior Advisor to the Secretary of Homeland Security on Vetting and Intelligence systems. Bush began his career in 1991 as a program analyst for the Department of Defense Strategic Defense Initiative and entered the U.S. Customs Service in 1994. During his tenure\, Bush served as a program manager for the Office of Field Operations\, the Director of Analytical Development for the Office of Strategic Trade\, and Director of Targeting and Analysis Systems in the Office of Information and Technology. In 2006\, Bush joined the Office of Anti-Terrorism\, where he served as the Deputy Executive Director. Bush was appointed to the Senior Executive Service in 2010 as the Executive Director for Intelligence and Targeting where he was responsible for supporting the counterterrorism mission of U.S. Customs and Border Protection through the collection and analysis of advance traveler and cargo information\, providing front line officers with targeting indicators on high-risk movements approaching the border. \nGraham Keithley\, Assistant General Counsel\, Airlines for America \nGraham Keithley is Assistant General Counsel for Airlines for America\, serving as legal counsel to member airlines on a range of regulatory issues at the international\, federal\, state\, and local levels.  His portfolio includes matters regarding safety\, security\, and public health regulations\, consumer protections\, accommodations for passengers with disabilities\, and drug and alcohol testing.  Prior to joining A4A in 2019\, Graham was an attorney in top aviation practices at major law firms\, including Baker McKenzie and Jones Day. \n  \nRonald A. Pavlik\, Jr.\, Chief\, Metro Transit Police\, Washington Metropolitan Area Transit Authority \nChief Pavlik rose through the ranks of the Metro Transit Police Department to be appointed Chief in 2013\, following 24 years of service with the Washington Metropolitan Area Transit Authority (WMATA).  Chief Pavlik leads the only tri-state police department in the United States\, with an authorized strength of 461 officers\, 144 special police officers and 89 civilian staff. Havranek\, Associate General Counsel\, Operations and Enforcement Law Division\, Department of Homeland Security (Moderator) \nJohn F. Havranek is the Associate General Counsel for Operations and Enforcement at the Department of Homeland Security\, Office of General Counsel. John is responsible for providing legal advice concerning DHS enforcement matters\, international law\, national security matters\, operations\, and all-hazards incident management\, including the provision of legal support to aid in the development and management of policies\, plans\, exercises\, training\, crises\, and incident management. John is also an Appellate Judge for the U.S. Coast Guard Court of Criminal. Chang\, Deputy General Counsel\, U.S. Department of Health and Human Services \nWill Chang is Deputy General Counsel of the U.S. Department of Health and Human Services.  In that role\, Will advises HHS’ senior leadership on high-priority public-health issues\, regulatory reforms\, litigations\, internal and external investigations\, and fraud-and-abuse matters.  Will’s portfolio includes several operating and staff divisions\, including the Centers for Disease Control and Prevention\, National Institutes of Health\, Health Resources and Services Administration\, and Office of the Assistant Secretary for Health. Before joining HHS\, Will was a white-collar defense and healthcare partner at an international law firm.  He has also served as a healthcare- and securities-fraud prosecutor with the U.S. Department of Justice\, Criminal Division\, Fraud Section \nElise J. Crawford\, Supervisory Attorney-Advisor\, Chicago\, Transportation Security Administration \nElise Crawford is the Transportation Security Administration’s Supervisory Attorney-Advisor in Chicago and is responsible for legal services to the Federal Security Directors and the Federal Air Marshals’ Supervisory Agents in Charge in Illinois\, Iowa\, Michigan\, Missouri\, Minnesota and Wisconsin.  Elise has been with TSA since 2002. Prior to joining TSA\, Elise was Senior Counsel for Enforcement at the U.S. Department of the Treasury\, where she assisted in providing legal services to the U.S. Secret Service\, U.S. Customs Service\, Bureau of Alcohol Tobacco and Firearms\, Federal Law Enforcement Training Center and the Financial Crimes Enforcement Network.  Prior to joining Treasury’s Office of General Counsel on a permanent basis\, Elise was an Honors Attorney there\, preceded by a Federal judicial clerkship with the Honorable Thomas F. Hogan in Washington\, DC.  Before beginning her legal career\, Elise spent several years as a management consultant with Arthur Andersen LLP\, focusing primarily on quantifying damages in complex litigation and government contract compliance. Elise has a B.B.A. in Finance and Economics from the University of Notre Dame\, and a J.D. from the University of California at Berkeley\, where she graduated with honors and was an editor on the Law Review.  She is a member of the California Bar. When not at work advocating on behalf of her TSA clients\, Elise volunteers as an advocate for people with intellectual disabilities.  She is happiest when living out of a tent and taking back country mountain hikes with her husband and their three children. \nPolly Hanson\, Senior Director\, Security\, Risk\, and Emergency Management\, American Public Transportation Association \nAPTA is the leading force in advancing public transportation in North America. To strengthen and improve public transportation\, Ms. Hanson coordinates with stakeholders to develop transit security\, risk and emergency management standards and policies. Hanson performs peer reviews and assists with safety audits and serves as an advocate for transportation security as well as a source matter expert on transit security\, risk and emergency management issues and concerns. Previously Ms. Hanson was the Chief of Police for AMTRAK where she led a national police department responsible for protecting over 30 million passengers and 20\,000 employees. Prior to Amtrak\, Polly was a career SES 1811 serving as the Director of the Office of Law Enforcement and Security for the Department of the Interior. At the Metropolitan Police Department in Washington D.C.\, Polly was the Executive Director\, Strategic Services Bureau where as a civilian Assistant Chief she oversaw the development of policy and procedures\, tactical crime analysis and research\, strategic planning\, applicant and promotional testing. Polly began her career at the Washington Metropolitan Area Transit Authority (WMATA) where she progressed through the ranks. As the Chief of the Metro Transit Police\, Polly led a tristate police department comprised of 1\,500 square miles and oversaw a budget of $50 million\, with 553 personnel and led the response to the terrorist attacks in Madrid and London\, help create public awareness campaigns and was an original member of the Peer Advisory Group (PAG) for the TSA Administrator. Polly received her Masters degree in Applied Behavioral Science from Johns Hopkins and her Bachelors degree in Communications from Temple University.  In addition\, Polly continued her education by attending the F.B.I. National Executive Institute\, the F.B.I. Law Enforcement Executive Development Seminar\, and the F.B.I. National Academy. Polly is working to obtain her FTA TSSP and SMS certifications. Polly is the recipient of WMATA’s Carmen E. Turner Award and was awarded a COMTO Women Who Move the Nation Award. Polly is a member of the Operation Lifesaver\, Inc. Board and is the Vice-Chair of the TSA Surface Transportation Security Advisory Committee. \nPeter J.
