SUMMARY:Qui Tam Section: [VIRTUAL] State FCA Investigations and the Role of NAMFCU
DESCRIPTION:**Program hosted in (ET) Time Zone** \nThe states’ Medicaid Fraud Control Units (MFCUs) are tasked with investigating and prosecuting Medicaid fraud. Many states also have analogous state FCA statutes and are commonly named in qui tam cases filed in federal or state courts. Through NAMFCU\, the states regularly collaborate\, investigate\, and litigate cases together. Perhaps most important\, NAMFCU teams regularly resolve and manage the settlement process in these multistate cases while working effectively with USDOJ and Relators\, under a system which treats every state equally and fairly\, including for states which have no qui tam statute. This process allows the states to share resources and efficiently investigate Medicaid fraud. This panel\, comprised of the Co-Chairs of the NAMFCU Global Case Committee (GCC) and the Co-Chairs of the NAMFCU Qui-Tam Subcommittee (QTS)\, will discuss the NAMFCU global process\, and how the NAMFCU global process benefits relators\, defendants\, and the United States. \nRegister Now!\nPresented by the FBA Qui Tam Section \n\nPresenters\n \nCandice M. SUMMARY:Qui Tam Section: [VIRTUAL] Battle of the Experts in FCA Litigation
DESCRIPTION:**Program hosted in (ET) Time Zone**\n\n\n\nExpert testimony may be pivotal in a False Claims Act case\, helping to establish the falsity (or not) of a claim — how evidence shows that a medical facility failed to comply with relevant regulations\, for instance\, or why it matters that body armor doesn’t meet military specifications. Experts also can testify about prevailing industry practices; they can help to quantify damages from a false claim; and they can help to establish the validity of statistical sampling methods in a case with thousands or millions of individual payments\, among other things. This panel will discuss pitfalls and best practices for working with experts in FCA matters\, including what makes a good expert; how to depose experts; how to defend or strike an expert for trial; and how to examine an expert before a judge or jury. \nRegister Today!\nPresented by the FBA Qui Tam Section \n  \n\nPresenters\nMODERATOR \n \nJanis G.
