SUMMARY:Qui Tam Section: [VIRTUAL] Working with Smaller Federal Agencies on FCA Cases
DESCRIPTION:**Program hosted in (ET) Time Zone** \nWhile False Claims Act practitioners are typically familiar with the many qui tam matters that arise in programs such as health care and procurement\, niche agencies less familiar FCA investigations do receive allegations of FCA violations involving their programs. Our panelists will discuss how to work with agency personnel investigating a qui tam complaint or other FCA allegations at agencies with lower volumes of FCA matters. Panelists will discuss\, among other topics\, challenges relators face in pursuing claims involving niche agencies\, unique avenues of defense or challenges defendants face\, and how the DOJ\, agency\, and IG approach strategic advantages and challenges presented in these cases. \nRegister Today!\n  \nPresented by the FBA Qui Tam Section \n  \n\nPresenters\nZachary Williams\, White & Case LLP (Moderator) \n \nAdam Kaplan\, United States Agency for International Development \n \nSean B. SUMMARY:Qui Tam Section: Litigation Finance in Qui Tam Cases
DESCRIPTION:**Program hosted in (ET) Time Zone** \nSo\, you may have heard about it and understand that it is something that appears\, every now and then\, in certain commercial cases or perhaps in personal injury cases for plaintiffs hoping for or waiting on a settlement. Its proponents call it a necessary tool for David’s going up against Goliaths. Its critics see it as a socially deleterious device encouraging spurious litigation. But did you know that litigation finance\, a/k/a third-party or non-party litigation funding\, can often find its way into FCA qui tam cases? Is that a good thing or a bad thing … for Relators and their lawyers now faced with having to finance a declined case coming out of seal against a Fortune 500 company? For those in the Relator’s Bar starting a new firm? For qui tam defendants and their counsel not quite sure of who they are up against? And for the government lawyers ultimately in charge of overseeing the case who may be concerned about who is calling the shots in the litigation? \nRegister Today! \n  \nPresented by the FBA Qui Tam Section \n  \n\nPresenters\nStephen J. Cox\, Alaska Attorney General \n \nDai Wai Chin Feman\, Parabellum Capital \n \nKenneth M. Harmon\, Law Office of Kenneth M. SUMMARY:Qui Tam Section: [VIRTUAL] FCA Liability for Non-Monetary Harms
DESCRIPTION:**Program hosted in (ET) Time Zone** \nIn numerous circumstances\, the Government pays out money not so it can receive a tangible benefit for itself but rather to promote a policy objective designed to benefit third-parties\, or society as a whole. Thus\, in exchange for receiving Government money\, program participants do not promise to provide the Government with a specific product or service\, but rather promise to conduct themselves in a particular fashion\, or to spend the money in a particular way. Examples abound: Government loans or grants with policy strings attached\, such as minority and veteran set-aside funding; HUD loans and grants conditioned on using funds to promote low-income housing and requiring that such properties be maintained in habitable conditions; Government regulations prohibiting kickbacks or labor trafficking; Government subsidies conditioned on compliance with environmental or regulations; Pandemic funding designed to mitigate hardships experienced by employees affected by lockdowns; and many others. \nWhen recipients of Government funds fail to comply with the strings attached to the funding\, qualitatively impacting the very purpose of the government program or policy\, do they violate the FCA? If so\, how is the violation proved\, and what is the Government’s measure of damages\, especially where there does not appear to be any tangible fiscal impact on the Government? Is the Government entitled to recover the full amount it paid out\, based on the notion that the payment is tainted by the policy violation\, or are damages calculations meant to assess the benefit of the Government’s bargain? If a conditional loan is disbursed\, and then paid back\, can the Government or a relator still assert an FCA claim based on the borrower’s failure to comply with the regulatory conditions for the loan? This Roundtable webinar will explore these and similar questions relating to FCA liability and damages where the violation harms the public policy\, not the public fisc. \nRegister Today! \nPresented by the FBA Qui Tam Section \n  \n\nModerator\nFranklin Amanat\, Motley Rice \n\nSpeakers\nDenise M. Barnes\, Bass\, Berry & Sims \n \nAri Yampolsky\, Whistleblower Partners \n \n  \n\nRegistration\nRegister Here! \n\nFBA Members: $0\nNon-Members: $0\n\n\nCLE\nPlease note that CLE credit is not offered for this webinar. \n  \n\nEmail Communication Policy \nBy registering for this event\, you agree to receive email communications from the Federal Bar Association and affiliated sponsors of the program concerning event details\, Continuing Legal Education certification\, programming changes\, upcoming events\, surveys\, and post-event communications. \nRecording Disclaimer \nBy registering for an FBA webinar\, you agree to the recording of audio and visual content presented during the live event and consent to subsequent use of the recording by the FBA. SUMMARY:Qui Tam Section: [VIRTUAL] Insurance Coverage for FCA Resolutions & Defense Costs
DESCRIPTION:**Program hosted in (ET) time zone**\n\n\n\nThis panel of insurance dispute litigators and former Department of Justice False Claims Act prosecutors will discuss an evolving field of litigation between policyholders and insurers over coverage claims from False Claims Act settlements\, judgments\, and defense costs. Whether you defend FCA investigations and litigation\, or represent relators\, potential sources of insurance coverage are an important consideration. The panel will discuss the types of policies that may provide coverage\, and disputes arising under those policies. For example\, at what point during an FCA investigation is a “claim” made under the policy? Do FCA settlements stem from “wrongful acts” that may be excluded from coverage? What aspects of an FCA resolution might constitute a “loss” that is insurable? The panel will also review notable case law discussing these issues and more. \nRegister Today!\nPresented by the FBA Qui Tam Section \n\nPresenters\n\n\n\n\nDerek Adams\, Potomac Law Group\, PLLC (Moderator) \n \nLilit Asadourian\, Barnes & Thornburg LLP \n \nCara Duffield\, Lavin Rindner Duffield LLC \n \nEllen London\, London & Naor P.C. \n \n\nRegistration\nRegister Here! \n\nFBA Members: $0\nNon-Members: $0\n\n\nCLE\nPlease note that CLE credit is not offered for this webinar. \n\nEmail Communication Policy \nBy registering for this event\, you agree to receive email communications from the Federal Bar Association and affiliated sponsors of the program concerning event details\, Continuing Legal Education certification\, programming changes\, upcoming events\, surveys\, and post-event communications. \nRecording Disclaimer \nBy registering for an FBA webinar\, you agree to the recording of audio and visual content presented during the live event and consent to subsequent use of the recording by the FBA.
