SUMMARY:Kansas and Western District of Missouri Chapter: From Murder to Museums: Current Controversies Over Nazi-Looted Art
DESCRIPTION:The program will kick off with a panel “introduction to art law” followed by Raymond Dowd’s presentation\, which recounts epic legal battles including the seizure of two\nstolen Schieles spotted at the Salon+Art Show at the Park Avenue Armory in\nNovember 2015. The seizure and return of the artworks garnered international\nheadlines upon their restitution to the heirs of Fritz Grunbaum\, a Viennese cabaret\nartist who was murdered in the Dachau Concentration Camp. The Schieles are now\nat Christie’s while Grunbaum’s heirs continue to fight the London art dealers’\nappeals. \nThe presentation traces Abraham Lincoln’s idea of taking the profit out of war\nthrough the Lieber Code Executive Order 100 of April 1863\, to the 1899 and 1907\nHague Conventions\, to the Nuremberg Trials\, demonstrating that returning stolen\nproperty to Holocaust victims is consistent with American ideals and foreign\npolicy. \nDowd discusses how 1. Confiscatory US tax laws\, 2. A fair market value deduction\nfor artworks donated to museums\, and 3. An unwillingness of museums to look gift\nhorses in the mouth led to the current situation: US museums with large\ninventories of unprovenanced works that left Europe after 1933\, but were created\nprior to 1946. History’s greatest robbery has long been concealed by history’s\ngreatest murder\, Congress passing the HEAR Act of 2016 extended the statute of\nlimitations for Nazi looted art claims and reaffirmed America’s commitment to\nrighting an historic wrong. \nKey note: Raymond J. Dowd: https://dunnington.com/raymond-j-dowd-2/ \nPanelists: Professor Michael H. Hoeflich https://law.ku.edu/people/michael-hoeflich \nKelly Anders (in her private capacity – not as a museum representative) https://www.linkedin.com/in/kellylynnanders/ \nMore panelists TBD \nIntro To Art Law/Holocaust Art Restitution At KU Spencer Museum Of Art With Raymond Dowd – Chapter for the districts of Kansas & Western Missouri (fedbarkanmo.org)

These new digital worlds promise to bring new avenues for product promotion and transactions\, but they also bring new challenges and obscurity to intellectual property law. NFT creators use trademarked images they claim to be “art” and profit from their sale\, but the owners of these trademarks contend that the use of these images does in fact constitute infringement. In a new age of globalized digital technology\, NFT and metaverse property disputes are relevant worldwide. \nThis panel will discuss how the use of trademarks in the art world is protected in the EU. Panelists will examine the implications of Hermes v. Rothschild and Nike v. StockX in trademark law worldwide. In house counsel will discuss trademark protection strategies and anti-counterfeiting considerations. \nSpeakers: \nEwa Abrams\, General Counsel\, Kering Americas\nJean-Baptiste Bourgeois\, Partner\, Rezac Law Group\nOlivera Medenica\, Partner\, Dunnington Bartholow & Miller LLP\nJean-Hyacinthe de Mitry\, Partner\, Gide Loyrette Nouel \nGreenwashing\, ESB focused Enforcement Actions\, and Sustainability in the EU: What Global Brands Must Know\n3:30pm – 4:30pm \nThe number of lawsuits concerning climate and environmental\, social\, and governance (ESG) issues has more than doubled globally since 2015. A growing sector of these lawsuits relate to “greenwashing\,” the practice of selling investments as more sustainable or environmentally friendly than they actually are. \nAgencies in both the U.S. and the E.U. have begun new ESG initiatives. In the U.S.\, the Securities and Exchange Commission’s new ESG task force began regulating in April of this year\, and in the E.U.\, legislators have taken similar regulatory action to prosecute “greenwashing.” \nEnvironmental concerns have also instigated a growing number of climate cases alleging over-reliance on “negative emission” or greenhouse gas removal to “offset” high-emission activities. Fashion and luxury retail brands are one of many industries being targeted with these climate and environmental suits. \nThis panel will examine the concept of greenwashing\, recent SEC investigations\, liability standards\, and comparisons to EU standards in relation to the fashion industry. \nSpeakers: \nJudith Bussé\, Counsel\, Edson\nMaria Vathis\, Of Counsel\, Bryan Cave Leighton Paisner LLP\nNicolas Walker\, Partner\, Reed Smith \nLicensing Success: Negotiation Strategies for a Better Brand Licensing Deal\n4:45 pm- 5:45pm \nThe process of negotiating a brand licensing deal requires skill and knowledge. Intellectual property lawyers and licensing professionals negotiate on behalf of brands seeking to lease trademarked or copyrighted materials. The role of negotiator is essential to procuring your client a better deal. \nAttendees will learn …\n• due diligence best practices\n• how to best understand the complexities of the law within the context of negotiations\n• brand strategies and goals\n• negotiation preparation and approaches\n• and many more tactics to achieve success in negotiations. \nIn this panel\, speakers will examine willing strategies to negotiate better deals for your clients. \nSpeakers: \nCéline Bondard\, Partner\, Cabinet Bondard\nSophie Divaret\, Commercial Legal Director\, PUIG\nAlexandra Varla\, Business Lawyer\, Founder: Tailored \n\nRegistration has Closed\n\nEarly Bird (prior to October 1\, 2022): 45 Euros\nGeneral Admission after October 1\, 2022: 55 Euros\nOn Site Registration: 65 Euros

SUMMARY:Webinar: Insights into the Two Most Popular Types of PTAB Proceedings: Appeals and Inter Partes Reviews
DESCRIPTION:Patent Trial and Appeal Board (PTAB) Appeals and PTAB Inter Partes Reviews are extremely valuable proceedings for inventors\, patent owners\, and the patent community generally. The pre-proceeding phase and decisions you make during that time are critical. Then\, your strategies and conduct during these proceedings will often lead to favorable results in the end for the client. This webinar will set forth data-driven\, thoughtful and specific insights for the two most-employed proceedings at the PTAB\, i.e.\, Appeals and Inter Partes Reviews. \nPresented by the Intellectual Property Law Section \n\n \nPanelists\nJoseph G. Piccolo \nIn 1985\, Joe Piccolo graduated from the University of Notre Dame with honors and received a B.S.E.E. From 1985-87\, Joe worked for the General Electric Company and then went on to law school. In 1988\, Joe began working in the intellectual property law field for the U.S. International Trade Commission. In 1990\, Joe graduated from NYU Law School and from 1990-91\, he clerked for the Honorable Alan D. Lourie at the U.S. Court of Appeals for the Federal Circuit. In 1991\, Joe was admitted to the USPTO Patent Bar and the New York State Bar. \nJoe then went on to practice law at the USPTO Solicitor’s Office\, where he orally argued 50 Federal Circuit appeals and drafted 88 Federal Circuit briefs for the USPTO. He was also co-counsel in 66 additional Federal Circuit appeals. Joe won scores of appeals\, including such significant appeals as In re Schreiber (1997 patent prosecution case cited innumerable times)\, In re Watts (USPTO achieving its long-sought victory on the legal doctrine of waiver)\, Zumbiel v. Kappos (a complicated inter partes patent reexamination appeal where Joe successfully argued both the patentability of certain claims and the unpatentability of other claims)\, and Shimano v. Rea (a complex inter partes patent reexamination appeal where Joe successfully defended the PTAB as to both its patentability and unpatentability determinations which centered on claim construction and written description). Joe also worked on approximately 90 district court civil actions involving the USPTO. Additionally\, Joe worked on multiple Supreme Court cases\, including Holmes v. Vornado (2002)\, MedImmune v. Genentech (2007)\, and SAS Institute v. Iancu (2018). While working at the USPTO\, Joe received an Exceptional Career Award and a Bronze Medal Award. \nIn 2021\, Joe became a partner at Davidson Berquist Jackson & Gowdey\, where he focuses largely on PTAB Appeals. In view of his thirty-year federal government career\, Joe is in a very strong position to analyze patent prosecution records to assess the viability of appealing USPTO examiner final rejection decisions to the PTAB. He can readily draft compelling appellate briefs and persuasively argue such appeals. Joe has given several presentations on the topic of PTAB Appeals. Joe also handles other types of prosecution matters \nJames T. Carmichael \nJames T. Carmichael is a former Administrative Patent Judge on the Board of Patent Appeals and Interferences (now the Patent Trial and Appeal Board). Jim was employed by the U.S. Patent and Trademark Office (PTO) for eight years\, including working in the electrical and computer division of the Board as an Examiner-in-Chief. Currently he represents inventors and patent challengers before the PTO in post-grant proceedings including Inter Partes Review and Reexamination. Jim regularly serves as an expert witness on PTO prosecution and post-grant procedures. \nBefore becoming a Judge\, Jim served for five years as an Associate Solicitor of the PTO. In that capacity\, he represented the agency in federal court litigation and argued more than thirty cases at the U.S. Court of Appeals for the Federal Circuit. The cases Jim handled included patentability and reexamination. He was also Coordinator of attorney discipline proceedings. Jim helped develop PTO procedures relating to the duty of disclosure as well as post-grant proceedings. \nPatexia scored Jim as one of the top three most-winning attorneys in IPRs at the PTAB (out of all 3\,462 attorneys representing patent owners) from 2014 to 2019\, while Carmichael IP was ranked the #1 firm. Jim graduated from Yale University in 1984\, and from University of Wisconsin Law School in 1987 with honors. During law school\, he served as an Associate Editor of the Wisconsin Law Review. \nJim is a registered patent attorney and admitted to the bar in Washington\, D.C \n\nRegistration\nRegistration for this event has closed.  \nRegistration Fees \n\nFBA Member: $0\nNonmember: $75\n\n\n\n\n\n\n\n\n\nLive Captioning: Closed captioning is available for all virtual webcasts. \n\n\nInternet Requirements: Virtual programs require suitable internet strength to stream online panels. SUMMARY:[Virtual] Fashion Law Conference
DESCRIPTION:The fashion industry is one of the world’s biggest fiscal heavyweights\, and this past year it has faced exceptional challenges.  The COVID pandemic has upended business as usual\, and has forced fundamental changes in supply chain strategies to adapt to the “new normal.”  It has also caused a boom in counterfeit products\, as the pandemic has created what some have described as a ‘perform storm” for the growth of counterfeits in the global market.  Bankruptcies and reorganizations have also dominated headlines\, as Neiman Marcus\, Brooks Brothers\, Lucky Brands\, JC Penney\, J. Crew and many others seek court protection to continue doing business.  Things are changing\, and with a new administration around the corner\, some are anticipating a tougher stance on social media\, advertising and ecommerce platforms.   This year\, legal professionals and leading industry representatives will thus explore diverse cutting-edge topics such as changes anticipated with the new Biden Presidency; the growth of counterfeits in ecommerce; issues pertaining to contract termination; liquidations and reorganizations; and what our path to returning to the office will look like in the employment and labor context. Although the arena of fashion has broadened in scope\, our lens of focus remains sharper than ever. \n\nAgenda\nMonday\, February 8 | 12:00 – 1:00 pm ET\nPandemic\, eCommerce\, and the Perfect Storm:  The Upsurge in Counterfeits\nThis panel will explore the pandemic’s effect on the sale of counterfeits online\, the existing framework to address it\, brand protection strategies and what we can anticipate with the new incoming Biden administration. \n\nModerator: Olivera Medenica\, Partner\, Dunnington Bartholow & Miller LLP\nJonathan Lasken\, Senior Trial Counsel\, Federal Trade Commission\nChristina Mitropoulos\, Manager\, Brand Protection & Manufacturing Initiatives\, American Apparel and Footwear Association\nCheryl Wang\, Counsel\, IP & Brand Enforcement\, David Yurman Enterprises LLC\n\nTuesday\, February 9 | 12:00 – 1:00 pm ET\nCutting Strings and Starting Anew:  Termination and Force Majeure Clauses\nThe first days of the pandemic\, lawyers were focused on force majeure clauses and how relationships could be instantly terminated using the pandemic as an excuse.  We are now almost a year into the pandemic\, and business relationships are still unstable.  Our panelists will explore how various business relationships have been impacted\, and will provide a general discussion of pending litigation addressing termination issues\, from licensing to commercial leases. \n\nModerator: Maria Vathis\, Of Counsel\, Bryan Cave Leighton Paisner LLP\nAnuj Kumar\, Founder & Editor in Chief\, Legal Desire\nDanielle C.
