SUMMARY:Webinar: Cutting Edge Developments at the Intersection of Bankruptcy and Intellectual Property Law
DESCRIPTION:The US Supreme Court has recently decided a case that will have profound effects on bankruptcy and IP practitioners (Mission Products). In addition to this case\, the panel will be discussing other significant cases that SCOTUS and other courts have decided that effect these areas\, as well as specific substantive areas that impact both BK and IP practitioners\, such as sales free and clear of licensing agreements\, and the enforceability of covenants not to compete and franchise agreements. \nRegistration for this event is now closed. \n\nAbout the Presenters\nThe Honorable Alan S. Trust\, United States Bankruptcy Judge for the Eastern District of New York \nThe Honorable Alan S. Trust ascended to the bench on April 2\, 2008\, and sits in the Eastern District of New York. He is an adjunct professor of law at the St. John’s University School of Law\, a past Chair of the Bankruptcy Law Section of the Federal Bar Association\, a member of the Board of Directors of that Section\, and has served as the CLE Committee chair. He is also President of the Eastern District of New York Chapter of the Federal Bar Association\, and serves as CLE Committee co-chair. He is a member of the Editorial Board of the American Bankruptcy Institute Journal\, is a coordinating editor for the Journal\, and for several years has had responsibility for the Dicta column. He is also a member of the American Bankruptcy Institute and the National Conference of Bankruptcy Judges. \nDuring his tenure on the bench\, Judge Trust has been designated by the Second Circuit Court of Appeals to mediate cases in the Southern District of New York and to sit in the District of Connecticut bankruptcy court. Judge Trust also serves on the Judiciary Data Working Group under the auspices of the Administrative Offices of the United States Courts. \nJudge Trust is a frequent speaker and author for numerous CLE events and seminars\, addressing bankruptcy\, mediation and ethics issues. He is a trained mediator\, and was instrumental in the creation of a Pro Bono Mediation Program and the formation of the Consumer Lawyer Advisory Committee adopted by the Bankruptcy Court for Eastern District of New York. \nJudge Trust attended Syracuse University\, graduating summa cum laude in 1981\, and as a member of Phi Beta Kappa. He attended New York University School of Law\, where he served on the Law Review from 1982-83\, and graduated cum laude in 1984. After graduation\, he relocated to Dallas\, Texas to begin his law practice. Judge Trust opened his own law firm (Trust.Law.Firm\, P.C.) in Dallas in December 1995\, and managed that firm until appointed to the bench. \n  \nRobert J. Rando\, Founder and Lead Counsel\, The Rando Law Firm P.C. \nRobert J. Rando is the founder and lead counsel of The Rando Law Firm P.C. Mr. Rando is a Fellow of the Academy of Court-Appointed Masters and\, since 2004\, has enjoyed the privilege and honor of judicial appointment as a Special Master in numerous cases involving complex patent law issues. He has also served as a Mediator in several private mediations all with successful outcomes and as a Neutral in patent and non-patent cases. He is a published author and frequent lecturer at law schools and CLE programs on patent law and other IP and constitutional law issues. \nHis professional experience spans thirty years as a federal civil litigator in matters ranging from intellectual property and antitrust\, to employment discrimination\, civil rights\, employment disputes\, ERISA and class action product liability cases. Primarily his experience has been focused on the litigation of patent infringement disputes in the Southern District of New York (“SDNY”)\, the Eastern District of New York (“EDNY”) and several other United States District Courts across the country. He has also filed Circuit Court of Appeals briefs and argued before the Appeals Court for the Second Circuit. Additionally\, he has authored\, co-authored\, and filed Amicus briefs before the United States Supreme Court and Federal Circuit on numerous IP law issues from 2006 to the present. \nHe is experienced in a wide range of technologies\, including: computer hardware and software\, silicon chip manufacturing\, biotechnology products\, medical devices\, pharmaceuticals\, chemical compounds\, food additives\, alternative energy products\, consumer electronics\, communications\, security\, Internet and e-commerce. \nHe is the immediate past Chair and current Board Member of the Federal Bar Association (“FBA”) Intellectual Property Law Section (“IPLS”)\, an active Member of the FBA Government Relations Committee and Charter Member of the FBA EDNY Chapter. He is also the past Treasurer and current Board Member of the New York Intellectual Property Law Association (“NYIPLA”)\, an active member of the NYIPLA Amicus\, Legislative Action\, Programs and PTAB Committees\, a Member of The Federalist Society IP Practice Group Executive Committee\, Master in the Honorable William C. Conner Inn of Court and President-Elect of the Association of Amicus Counsel. \nHe has worked closely with USPTO leaders on programming and outreach and is actively engaged in federal judiciary legislative initiatives. Along with other patent practitioners\, he developed and conducted a series of lectures in 2012 on the AIA and provided a lecture on Alice/Mayo/Section 101 patent eligibility issues in 2018 for the SDNY and EDNY Patent Pilot Program Judges\, Magistrate Judges and Law Clerks. He represented the FBA IPLS at the Tillis/Coons Section 101 Patent Law Reform Roundtable discussions and submitted written testimony included in the record at the June 11\, 2019 hearing. \nHe received his Juris Doctor\, with academic honors\, from St. John’s University School of Law in 1989. He was the Executive Publications Editor of the St. John’s Law Review and the recipient of an Academic Scholarship\, Civil Trial Institute Honors and the American Jurisprudence Award for Excellence in Constitutional Law. He received his Bachelor of Science\, with academic honors\, in mathematics and computer science\, from Hofstra University in 1983. Prior to entering the legal profession\, Mr. Rando was a computer systems analysis engineer for Sperry Systems (now Lockheed Martin) working on submarine navigation and weapons systems under a government required classified security clearance. \n  \nDaniel R. Fogarty\, Shareholder\, Stichter\, Riedel\, Blain & Postler P.A. \nDaniel R. Fogarty joined Stichter\, Riedel\, Blain & Postler P.A. in 2006 after graduating with high honors from the University of Florida College of Law and then serving as a law clerk for the United States Bankruptcy Court for the Middle District of Florida\, Tampa Division. \nMr. Fogarty regularly represents debtors\, committees\, creditors\, buyers\, and other parties in bankruptcy cases and out-of-court workouts. SUMMARY:Webinar: A SCOTUS Review of IP Cases in the Recent 2020 Term and its Implications for Constitutional Jurisprudence in Other Areas of Law
DESCRIPTION:As has been the case in several of the past terms\, the U.S. Supreme Court has rendered decisions involving intellectual property law issues that have broader implications which also touch upon other areas of law. So too\, in this most recent term\, with the Court’s opinions in United States v. Arthrex\, Inc. et al.\, 141 S.Ct. 1970 (2021) (Constitutionality of APJs under the Appointments Clause); Google LLC v. Oracle America\, Inc.\, 141 S.Ct. 1183 (2021) (Copyright fair use and application programming interface software (“API”)); and Minerva Surgical\, Inc. v. Hologic\, Inc.\, et al. 141 S.Ct. 2298 (2021) (assignor estoppel). This webinar will discuss these Supreme Court decisions within the IP law context as well as the potential impact of the decisions on other areas of law. \nThe webinar will also take a forward look at the next term for a case that\, although it was not decided in the current term\, and the petition for certiorari is still pending\, the Court has invited the Solicitor General to weigh in on at the petition stage. The American Axle & Manufacturing\, Inc. v. Neapco Holdings LLC\, et al.\, No. 20-891\, U.S. Sup. Ct. (March 1\, 2021)\, has generated a considerable amount of attention since it concerns a highly controversial issue of patent eligibility that continues to stymie congressional patent law reform efforts\, and which has a direct impact on U.S. economic and national security interests as well as innovators\, investors\, and entrepreneurs across the entire spectrum of industries from Pharma to Big Tech. \nPresented by the Intellectual Property Section \n\nAbout the Presenter\nRobert J. Rando\, Partner\, Greenspoon Marder LLP \nRobert Rando is a partner with the Greenspoon Marder’s Intellectual Property Department. DESCRIPTION:Patent Trial and Appeal Board (PTAB) Appeals and PTAB Inter Partes Reviews are extremely valuable proceedings for inventors\, patent owners\, and the patent community generally. The pre-proceeding phase and decisions you make during that time are critical. Then\, your strategies and conduct during these proceedings will often lead to favorable results in the end for the client. This webinar will set forth data-driven\, thoughtful and specific insights for the two most-employed proceedings at the PTAB\, i.e.\, Appeals and Inter Partes Reviews. \nPresented by the Intellectual Property Law Section \n\n \nPanelists\nJoseph G. Piccolo \nIn 1985\, Joe Piccolo graduated from the University of Notre Dame with honors and received a B.S.E.E. From 1985-87\, Joe worked for the General Electric Company and then went on to law school. In 1988\, Joe began working in the intellectual property law field for the U.S. International Trade Commission. In 1990\, Joe graduated from NYU Law School and from 1990-91\, he clerked for the Honorable Alan D. Lourie at the U.S. Court of Appeals for the Federal Circuit. In 1991\, Joe was admitted to the USPTO Patent Bar and the New York State Bar. \nJoe then went on to practice law at the USPTO Solicitor’s Office\, where he orally argued 50 Federal Circuit appeals and drafted 88 Federal Circuit briefs for the USPTO. He was also co-counsel in 66 additional Federal Circuit appeals. Joe won scores of appeals\, including such significant appeals as In re Schreiber (1997 patent prosecution case cited innumerable times)\, In re Watts (USPTO achieving its long-sought victory on the legal doctrine of waiver)\, Zumbiel v. Kappos (a complicated inter partes patent reexamination appeal where Joe successfully argued both the patentability of certain claims and the unpatentability of other claims)\, and Shimano v. Rea (a complex inter partes patent reexamination appeal where Joe successfully defended the PTAB as to both its patentability and unpatentability determinations which centered on claim construction and written description). Joe also worked on approximately 90 district court civil actions involving the USPTO. Additionally\, Joe worked on multiple Supreme Court cases\, including Holmes v. Vornado (2002)\, MedImmune v. Genentech (2007)\, and SAS Institute v. Iancu (2018). While working at the USPTO\, Joe received an Exceptional Career Award and a Bronze Medal Award. \nIn 2021\, Joe became a partner at Davidson Berquist Jackson & Gowdey\, where he focuses largely on PTAB Appeals. In view of his thirty-year federal government career\, Joe is in a very strong position to analyze patent prosecution records to assess the viability of appealing USPTO examiner final rejection decisions to the PTAB. He can readily draft compelling appellate briefs and persuasively argue such appeals. Joe has given several presentations on the topic of PTAB Appeals. Joe also handles other types of prosecution matters \nJames T. Carmichael \nJames T. Carmichael is a former Administrative Patent Judge on the Board of Patent Appeals and Interferences (now the Patent Trial and Appeal Board). Jim was employed by the U.S. Patent and Trademark Office (PTO) for eight years\, including working in the electrical and computer division of the Board as an Examiner-in-Chief. Currently he represents inventors and patent challengers before the PTO in post-grant proceedings including Inter Partes Review and Reexamination. Jim regularly serves as an expert witness on PTO prosecution and post-grant procedures. \nBefore becoming a Judge\, Jim served for five years as an Associate Solicitor of the PTO. In that capacity\, he represented the agency in federal court litigation and argued more than thirty cases at the U.S. Court of Appeals for the Federal Circuit. The cases Jim handled included patentability and reexamination. He was also Coordinator of attorney discipline proceedings. Jim helped develop PTO procedures relating to the duty of disclosure as well as post-grant proceedings. \nPatexia scored Jim as one of the top three most-winning attorneys in IPRs at the PTAB (out of all 3\,462 attorneys representing patent owners) from 2014 to 2019\, while Carmichael IP was ranked the #1 firm. Jim graduated from Yale University in 1984\, and from University of Wisconsin Law School in 1987 with honors. DESCRIPTION:The program will kick off with a panel “introduction to art law” followed by Raymond Dowd’s presentation\, which recounts epic legal battles including the seizure of two\nstolen Schieles spotted at the Salon+Art Show at the Park Avenue Armory in\nNovember 2015. The seizure and return of the artworks garnered international\nheadlines upon their restitution to the heirs of Fritz Grunbaum\, a Viennese cabaret\nartist who was murdered in the Dachau Concentration Camp. The Schieles are now\nat Christie’s while Grunbaum’s heirs continue to fight the London art dealers’\nappeals. \nThe presentation traces Abraham Lincoln’s idea of taking the profit out of war\nthrough the Lieber Code Executive Order 100 of April 1863\, to the 1899 and 1907\nHague Conventions\, to the Nuremberg Trials\, demonstrating that returning stolen\nproperty to Holocaust victims is consistent with American ideals and foreign\npolicy. \nDowd discusses how 1. Confiscatory US tax laws\, 2. A fair market value deduction\nfor artworks donated to museums\, and 3. An unwillingness of museums to look gift\nhorses in the mouth led to the current situation: US museums with large\ninventories of unprovenanced works that left Europe after 1933\, but were created\nprior to 1946. Freeman\, Northern District of California \nJudge Beth Labson Freeman is a Judge on the Federal Court in the Northern District of California\, appointed by President Obama in 2014.  Judge Freeman sits in the San Jose Division\, hearing a broad array of cases including antitrust\, civil rights\, consumer class actions\, commercial litigation and technology cases including patent\, trademark\, copyright and trade secret cases.  She serves on the Northern District’s patent local rules and jury instruction committees. Judge Freeman previously was a Superior Court Judge in San Mateo County\, California from 2001 to 2014. Judge Freeman served as Presiding Judge and Assistant Presiding Judge of the San Mateo Court. \nPrior to her appointment to the bench in 2001\, Judge Freeman was deputy county counsel in San Mateo County\, and an associate attorney at Lasky\, Haas and Cohler in San Francisco and Fried\, Frank\, Harris\, Shriver and Jacobson in Washington\, D.C. Judge Freeman is a graduate of the Harvard Law School and University of California\, Berkeley. \n \nDistrict Judge Paul J. Oetken\, Southern District of New York \nPaul Oetken has been a United States District Judge for the Southern District of New York since his appointment in 2011. He graduated from the University of Iowa in 1988\, where he majored in philosophy\, and received a J.D. from Yale Law School in 1991. He served as a law clerk to Justice Harry A. Blackmun on the United States Supreme Court in 1993-1994\, after clerking for Judge Richard D. Cudahy (U.S. Court of Appeals for the Seventh Circuit) and Judge Louis F. Oberdorfer (U.S. District Court for the District of Columbia). Following his clerkships\, Judge Oetken worked as an attorney at Jenner & Block in Washington\, DC. He then served as attorney-adviser in the United States Department of Justice Office of Legal Counsel from 1997 to 1999. \nIn 1999\, Judge Oetken joined the White House Counsel’s Office\, serving as Associate Counsel to President Bill Clinton until the end of President Clinton’s term in January 2001. Judge Oetken then worked as an attorney at Debevoise & Plimpton in New York from 2001 to 2004\, leaving to become head of litigation at Cablevision Systems Corporation\, where he was Senior Vice President and Associate General Counsel until his appointment to the bench. Judge Oetken is an Adjunct Professor at NYU Law School and previously taught at Fordham Law School. He was appointed by the Chief Justice to serve on the Judicial Conference Committee on the Federal Rules of Bankruptcy Procedure. He serves as President of the William C. Conner Inn of Court and as a Director of the Federal Judges Association. While in private practice he served on the Media Law Committee of the New York City Bar Association \n \nDistrict Judge Anuraag Singhal\, Southern District of Florida \nOn December 20\, 2019\, Raag Singhal received his judicial commission to serve on the United States District Court for the Southern District of Florida.  Judge Singhal is the first Asian American in history to serve as an Article III judge in the jurisdiction of the Eleventh Circuit (Alabama\, Georgia and Florida). \nImmediately prior to becoming a federal judge\, Judge Singhal spent eight years as a State Circuit Court Judge in Broward County\, Florida\, having been appointed by then-Governor Rick Scott in 2011.  While on the state bench\, Judge Singhal served\, at times\, in the criminal\, civil and mental health divisions and was fortunate enough to sit as an Associate Judge on Florida’s Fourth District Court of Appeal on four occasions. \nAs a lawyer\, Judge Singhal gained experience at a civil litigation firm followed by three years as an Assistant State Attorney.  After that\, Singhal ran a successful criminal defense practice in Fort Lauderdale for eighteen years.  During that time\, he handled more than two hundred jury trials including thirty first-degree murder cases. \nJudge Singhal has had leadership roles in many law-related groups.  He is past-President of the Broward Association of Criminal Defense Lawyers and the Stephen H. Booher Chapter of the American Inns of Court.  He was on the Board of Directors of the Broward County Bar Association\, and is a frequent speaker at events for various local Bar groups such as the Asian Pacific American Bar Association and the Federalist Society.  Singhal was also Associate Dean of the Florida College for Advanced Judicial Studies at the time of his appointment  to the federal court system. \nJudge Singhal received his law degree from Wake Forest University School of Law in 1989 where he was very active in Moot Court activities\, and was on the winning team of the J.
