SUMMARY:Webinar: Confidentiality in Mediating Federal Administrative Law Cases
DESCRIPTION:Alternative dispute resolution (ADR) reference materials often cite “confidentiality” as a critical feature of ADR processes.  Confidentiality encourages candid discussions that open the door to negotiated resolutions-  but when ADR programs and neutrals promise confidentiality\, they must know the bounds of their promise under the law and applicable ADR agreements.  This presentation will review statutes\, caselaw\, and ADR agreements so mediators don’t promise more confidentiality than they can deliver.  The program will focus on federal administrative cases with an emphasis on FAA issues\, but will be useful to practitioners in all fields. \n  \nPresented by the Alternative Dispute Resolution Section & Transportation & Transportaion Law Section \n  \nRegistration is Closed \n\nPresenters\nIntroduction & Q&A – James Downey\, Chair\, ADR Section\n \nJames Downey is an Attorney/Advisor for the Department of the Army. He is a Lieutenant Colonel in the Judge Advocate General’s Corps in the Massachusetts Army National Guard and serves on the panel of neutrals for: the Better Business Bureau; FINRA; the Department of Defense; and MWI Inc. He is a graduate of the University of Rhode Island and Suffolk University Law School. He has completed various ADR certificate trainings at among other places: Harvard Law School and the Defense Equal Opportunity Management Institute. He is an instructor in mediation with Quabbin Mediation in Orange\, MA and a member of the Massachusetts Bar. He is a member of the Town of Braintree’s Planning Board and the American Legion Post 86. \nJudge John A. Dietrich\, Director and Chief Administrative Judge\, Office of Adjudication/Office of Dispute Resolution for Acquisition & Federal Aviation Administration (FAA)\n \nJohn Dietrich is an attorney and mediator with a wide range of experience in federal acquisition\, workplace disputes\, aviation enforcement\, and environmental law.  He currently leads FAA Office of Adjudication\, which adjudicates and mediates civil penalty appeals\, other enforcement cases\, contract claims\, and bid protests.  Before joining FAA\, he served in several civilian positions for the Department of the Navy.  These included serving as a Senior Trial Attorney in the Navy Litigation Office and later as the Assistant General Counsel (ADR).  For several years he has been an author and active speaker on ADR matters.  He has served in leadership positions for the Interagency ADR Working Group\, the ADR Committee of the American Bar Association’s Section of Public Contract Law\, and the National Conference of Administrative Law Judiciary. \n\nRegistration\nRegistration is Closed \nRegistration Fees \n\nFBA Member: $0\nGovernment Employees: $0\nNonmember: $75\n\n\n\n\n\n\n\n\n\nLive Captioning: Closed captioning is available for all virtual webcasts. \n\n\nInternet Requirements: Virtual programs require suitable internet strength to stream online panels.
