SUMMARY:Webinar: COVID Immunity Issues Impacting Healthcare Providers-The PREP Act and State Immunity Orders-A Get Out of Trouble Card or More Trouble Than Its Worth?
DESCRIPTION:The COVID-19 Crisis has created unforeseen and unavoidable circumstances in healthcare delivery that has compelled the Department of Health and Human Services to expand the Public Readiness and Emergency Preparedness Act (PREP) for certain COVID medical countermeasures by licensed healthcare professionals and for certain covered persons and entities. Some States similarly have issued immunity orders for COVID related circumstances or have proposed immunity legislation. Even limited immunity that excludes gross negligence and willful conduct is controversial and may prove an illusory protection from liability assertions from many different stakeholders.  This webinar will explore the scope of the PREP Act and State immunity orders and what impact these limited governmental immunities may have on tort\, regulatory and enforcement exposures for the health industry and what risk management actions make sense now. \nRegistration is now closed. \n\nAbout the Presenters\nGregory N. Etzel\, Partner\, Morgan Lewis\, & Bockius \nGregory N. Etzel concentrates his practice on the representation of hospitals and other healthcare providers in a variety of complex legal transactions and regulatory litigation.  Prior to joining Morgan Lewis\, Greg spent four and a half years in-house as the vice president of legal affairs at The University of Texas Medical Branch (UTMB)\, providing legal counsel and representing the entire institution on a wide range of issues involving strategic initiatives\, hospital and medical school operations\, transactions\, litigation management\, public information\, and international affairs. \nIn his UTMB capacity\, he also served as the general counsel for Medical Branch Innovations Inc.\, a nonprofit corporation established and governed by UTMB to pursue public-private partnerships for innovative healthcare solutions. \nKathleen McDermott\, Partner\, Morgan Lewis & Bockius \nKatie McDermott is a Partner in the Washington\, D.C. office of Morgan\, Lewis & Bockius LLP and has been involved in health industry enforcement and compliance matters for over 28 years. She has served as an Assistant U.S. Attorney and DOJ Health Care Fraud Coordinator\, and is a recipient of the HHS-OIG Inspector General’s Integrity Award for her work in government health care fraud matters. \nKatie has a national corporate defense practice in the health industry and is lead counsel in several government investigations and litigations related to violations of the False Claims Act and parallel criminal and administrative statutes. She has been designated on several occasions as a DC Super Lawyer in white collar matters\, a LMG Life Sciences Star in Fraud and Abuse matters and a Benchmark National Litigation Star in White Collar Enforcement. Katie’s extensive compliance practice assists senior management and corporate boards navigate internal investigations and government disclosures. She provides guidance on global anti-bribery compliance\, and transparency and conflicts of interest issues\, including the AdvaMed Code of Ethics. \nKatie is active in teaching\, publishing and speaking on health industry government enforcement and corporate compliance matters and serves as adjunct faculty at the University of Maryland Francis Cary School of Law\, teaching the healthcare fraud seminar. She currently serves on the Advisory Board of the Bloomberg BNA Medical Device Industry Publication and is Chair of the Federal Bar Association Health Law Section. She is licensed to practice law in the District of Columbia\, Massachusetts and Maryland and has been admitted in various federal and state court proceedings.
