DESCRIPTION:Enacted in October 2018\, the Eliminating Kickbacks in Recovery Act (EKRA) aimed to combat the opioid crisis by\, among other things\, the solicitation or receipt of kickbacks in exchange for referrals to three entities – all laboratories\, recovery homes and clinical treatment facilities. In January 2010\, the United States Attorney for the District of Kentucky released a statement indicating that Theresa C. Merced’s “EKRA conviction is believed to be the first in the nation.” The purpose of this webinar is to provide the following: (1) an overview of EKRA; (2) an analysis of the Merced case; (3) a comparison of the EKRA and AKS safe harbors; and (4) an explanation of the proposed changes to the AKS safe harbors. \nRegistration is now closed. \n\nAbout the Presenters\nPatrick Ouellette\, Esq.\, Assistant General Counsel\, Massachusetts Executive Office of Health and Human Services\, Boston\, Massachusetts \nMr. Ouellette focuses on healthcare technology transactions and has broad legal experience with healthcare providers\, state government and employee benefit plans. \n  \n \nRachel V.
