Moot Court Competition

The competition, designed for two-person teams, will focus on written briefs as well as oral arguments. This year’s topic will address emerging issues in federal law. Arguments will be heard in Washington, D.C., in conjunction with the Federal Bar Association’s mid-year meeting.

2016 Thurgood Marshall Memorial Moot Court Competition Problem

The Problem raises some of the legal issues as presented to the Supreme Court this term in Musacchio v. United States, which were undecided issues at the time of the Problem's writing. The Supreme Court issued a decision in that case on January 25, 2016. For purposes of this year's Problem, teams are to assume that the issues in Musacchio remain undecided throughout the competition, and neither the teams nor the judges are to rely on or refer to the since-issued Supreme Court decision or any case law or other legal authorities decided or issued after January 24, 2016.
