Litigation Impacts: The GDPR, the California Consumer Privacy Act and a Possible Federal Privacy Act


FBA’s International Law Section co-sponsored a panel with the FBA’s LA Chapter and the Beverly Hills Bar Association on April 25th. The panel, entitled “Litigation Impacts: The GDPR, the California Consumer Privacy Act and a Possible Federal Privacy Act,” was held at the Beverly Hills Bar Association and was moderated by U.S. Magistrate Judge Suzanne Segal. Jeff Tsai, a partner with DLA Piper, addressed the scope and impact of the European Union’s General Data Protection Regulation (GDPR), including rights for individuals and obligations of companies under the law. Dominique Shelton Leipzig, Co-Chair of Perkins Coie’s Ad Tech Privacy and Data Management Group, spoke about her testimony before the California State legislature regarding the new California Consumer Privacy Act (CCPA), and addressed the scope of the new law and business obligations under the law. Joel Richlin, Vice President, Deputy Counsel, and Chief Litigation Counsel at Prime Healthcare, addressed the impact of data privacy laws on private industry, the requirements for compliance with those laws, and the challenges to the healthcare industry.  Judge Segal addressed the impact of data privacy laws on federal litigation, as well as federal privacy law proposals.

First Bi-National Mexican-American Conference

On May 8, 2018, FBA ILS Human Rights Committee Chair, Judy Wood, chaired the First Bi-National Mexican-American Conference on Immigration at Centro Cultural Tijuana, Mexico. Entitled "Justice and Full Human Rights for Immigrants," the program featured a panel of speakers from both countries on the topic of human rights protections under international human rights law and procedure. Fordham Law Mock Interview Program

On April 13, 2018, the FBA International Law Section (ILS) is conducting another of its expanding FBA Video Conferencing Mock Interview Programs. Coordinated through the University of Georgia (UGA), School of Law LL.M. program, and with the support of FBA ILS Student Liaison, Adriana-Maria Sarria, Graduate Research Assistant and UGA LL.M. Candidate, nine University of Georgia LL.M. students are participating in individualized 1/2 hour video conferencing mock interview sessions with volunteers members of the FBA ILS leadership. This program builds on a program developed by Dean Toni Jaeger-Fine, Fordham University School of Law and FBA ILS Board Member, Raymond Dowd, former FBA General Counsel, Vice President for the Second Circuit, member of the Board of Directors, and President of the Southern District of New York Chapter, and Susan Kilgore, Membership Chair, FBA ILS. During the program, FBA volunteers conduct multiple video conference mock interviews, and provide individualized and detailed feedback to fine-tune student interviewing skills.

Jessup International Moot Court “Qualifying Rounds” Competition

Immediate Past President Brian C. Murphy is currently completing his second Fulbright Scholarship in Sofia, Bulgaria. TFL readers will recall that he reported about his prior work and the Fulbright Program in general, in The Federal Lawyer March 2018 International Law Theme Issue. During the weekend of February 16-18, 2018, Past President Murphy presided over the Jessup International Moot Court “Qualifying Rounds” Competition held at the Supreme Court of Cassation, Sofia, Bulgaria, which is the final court of appeal in the Republic of Bulgaria.

Fordham International Law Affinity Event

On January 22, 2018, Fordham Law School Dean and FBA International Law Section Board Member Toni Jaeger-Fine and FBA SDNY Chapter Board Member Ray Dowd hosted a Fordham International Law Affinity Group training and networking event at Fordham Law School. The program involved a series of Mock Interviews with leaders in the legal community, followed by a presentation by the Honorable Denny Chin, and a cocktail reception. FBA International Law Section Chair Mimi Tsankov participated, as well. In addition, I'm proud to report that Susan Kilgore, Membership Chair, FBA International Law Section, went the extra mile, and conducted a series of Mock Interviews via Skype from Texas for students who were unable to participate in the actual event.

FBA SDNY Chapter Co-Sponsored Presentation at Fordham Law School

On November 2, 2017, FBA International Law Section and FBA SDNY Chapter Board Member Mimi Tsankov presented an informal talk to LLM students at Fordham Law School on opportunities within the FBA for law students and younger lawyers. The program is part of an ongoing relationship between Fordham, the FBA, longtime FBA national leader Raymond Dowd, Esq. and Dean Toni Jaeger-Fine, Board Member, FBA International Law Section. The students were excited to join the FBA and learn more about FBA's application for United Nations Consultative Status. Many of them will be participating in the following upcoming jointly-sponsored program: An historical reenactment of "The Case of 22 Lewd Chinese Women: Chy Lung v Freeman" -- an immigration case that reached the Supreme Court in the 1870s. Second Circuit Court of Appeals Judge Denny Chin will be presiding over the Reenactment. That program will take place on March 14, 2018 and will be co-sponsored with the Asian American Bar Association of New York (AABANY).

Fordham Law School - Human Rights Adjudication and the FBA

Provided an introduction to human rights adjudication in the US, the role of stakeholders, such as the FBA, in shaping policy and informing debate, and the pending FBA application for UN Consultative Status. DACOR Luncheon with Ambassador Paul Bremer, May 18, 2017

Former U.S. Ambassador and Presidential Envoy to Iraq, The Honorable L. Paul Bremer III, at the Diplomatic Club, DACOR, in Washington, D.C., on May 18, 2017.

Ambassador Bremer spoke about America's Indispensable Leadership Role in the World at a program sponsored by the FBA International Law Section, on May 18, 2017, in Washington, D.C.

Ambassador Bremer cited former U.S. Secretary of State, Henry A. Kissinger, for the proposition that America is the only country founded on an idea, on a rules-based liberal democratic order.

He cited the historical antecedents of leadership in the world, including that of the British Empire, from which the USA. took the mantle of leadership.

He asked, who, if not the USA, would assume the leadership role in and for the world.

His remarks were well received, with one long-time FBA leader writing that we should invite Ambassador Bremer to share his insights regularly, noting that she would come again and again!
