John G. McCarthy is a Partner in the Litigation Practice and Commercial and Bankruptcy Law Practice of Smith, Gambrell & Russell, LLP in its New York office. He received his A.B. degree in Biology from Fordham University and he served as an International Trustee of Circle K International, the college level of Kiwanis International. He graduated from the Fordham University School of Law, where he served as Managing Editor for its International Law Journal and as a member of its Moot Court Board. He has been published multiple times in The Federal Lawyer and the Fordham International Law Journal. Mr. McCarthy has a wide range of experience representing domestic and foreign clients in all aspects of business litigation in a variety of areas, including business torts, contract disputes, corporate law and governance, director and officer liability, professional malpractice, banking, products liability, real estate, intellectual property, unfair competition and trade secrets. He has extensive experience in litigation matters in bankruptcy court representing trustees, creditors, committees and other interested parties. Mr. McCarthy has tried or participated in dozens of trials in federal and state court. He is AV Rated by Martindale-Hubbell. Mr. McCarthy was elected an FBA Circuit Vice President in 2011; serves as Co-Chair of the Federal Rules of Procedure and Trial Practice Committee of the FBA’s Federal Litigation Section; and is a past Chapter President of the Southern District of New York Chapter. He is a past President of The Fordham College Alumni Association.
