The Five Sense: Non-Traditional Trademarks in the Fashion Industry
The utilitarian functionality of clothing has brought challenges for designers to traditionally trademark their products. Designers are facing challenges in protecting their wares, as non-traditional trademarks are more expensive to obtain and enforce. This panel will examine the limits of trademark and trade dress protection within the fashion industry. Panelists will examine the latest litigations in the U.S. and France and will engage in comparative analysis of both jurisdictions.
